Nurse managers oversee a specific unit in a hospital, such as intensive care or the emergency room. They’re responsible for both the clinical and administrative aspects, including supervising nurses and addressing the concerns of patients and their families. Nurse managers not only require specialized nursing expertise, but they also need strong people and communication skills and the ability to take charge.

Supervising Nurses

The nurse manager makes all assignments for the nurses she supervises, taking into account their strengths and weaknesses, their experience levels, the types of cases and number of patients requiring care. Using this information, she’ll assign nurses to specific cases or tasks, and set schedules for all nurses in the unit. She also ensures all nurses fulfill their duties and meet the hospital’s expectations. If a nurse does not provide adequate care, is rude to a patient or does not fulfill her assigned tasks, the nurse manager may take disciplinary action and give her directions for improvement.


Nurse managers often play a mentoring role, especially to new or young nurses. They frequently supervise these less experienced nurses closely, praising them for a job well done and offering suggestions and advice for improving the quality of care they deliver and their interactions with patients and hospital staff. They also guide veteran nurses, and must be available if one of their nurses needs feedback regarding her job performance or insight into a difficult case. If questions arise regarding a patient’s treatment, it’s usually the nurse manager who makes the final decision or consults the patient’s doctor for a second opinion.

Leadership and Conflict Management

Effective nurse managers set clear expectations for the nurses in their unit, explaining exactly what’s expected of them and outlining guidelines for how they behave toward each other and toward patients and family members. However, even in teams who normally work well together, conflicts occasionally arise. It’s the nurse manager’s responsibility to defuse the conflict before it harms the team or hinders patient care. She may call in the conflicted parties for a meeting, encouraging them to discuss their dispute and creating a plan for resolving the conflict in a way that benefits the individual nurses, the team and patients.

Patient Relations

When patients or their families have issues about the quality of their care, they often take their concerns to the nurse manager. They may simply be confused or have questions about their treatment plan, or they may feel nurses have treated them rudely or given them sub-par care. Even if a patient or family member is irate, the nurse manager must take time to listen to his concerns and answer his questions. She must also let him know she takes his concerns seriously and wants to ensure he receives the best care possible. During her meeting with the patient or family member, she should also outline the steps she’ll take to investigate his complaint and remedy the situation.

Can I bring a lawyer to small claims court?

In a handful of states, including California, Michigan, and Nebraska, you must appear in small claims court on your own. In most states, however, you can be represented by a lawyer if you like. But even where it’s allowed, hiring a lawyer is rarely cost efficient. Most lawyers charge too much compared to the relatively modest amounts of money involved in small claims disputes. Happily, several studies show that people who represent themselves in small claims cases usually do just as well as those who have a lawyer.

If I lose my case in small claims court, can I appeal?

The answer depends on the state in which you live. Many states allow either party to appeal within a certain period of time, usually between 10 and 30 days, and obtain a new trial. In many states, appeals must be based solely on the contention that the judge made a legal mistake, and not on the facts of the case. Other states have their own unique rules. Are there time limits in which a small claims court case must be filed?

Yes. States establish rules called “statutes of limitations” that dictate how long you may wait to initiate a lawsuit after the event giving rise to the lawsuit occurs. How much can I sue for in small claims court?

The limit is normally between $3,000 and $10,000, depending on your state. For instance, the maximum is $5,000 in New York, $10,000 in California, $7,500 in Minnesota, and $5,000 in Vermont. Where should I file my small claims lawsuit?

Assuming the other party lives or does business in your state, rules normally require that you sue in the small claims court district closest to that person’s residence or headquarters. In some instances, you also may be able to sue in the location (court district) where a contract was signed or a personal injury occurred (such as an auto accident). Check with your small claims clerk for detailed rules.

If a defendant has no contact with your state, you’ll generally have to sue in the state where the defendant lives or does business. Because of the distance involved, out-of-state small claims lawsuits tend to be expensive and unwieldy.

What can I do to resolve my problem without going to small claims court?

If you want what’s owed to you, but you don’t want to take on the trouble of bringing a lawsuit, you have a couple of options to consider. First, make a demand in the form of a straightforward letter, concluding with the statement that you’ll file in small claims court in ten days unless payment is promptly received. In addition, many states offer community- or court-based mediation designed to help parties arrive at their own compromise settlement with the help of a neutral third party. Mediation works best where the parties have an interest in staying on good terms, as is generally the case with neighbors, family members or small business people who have done business together for many years. Will I get paid if I win the lawsuit?

Not necessarily. The court may decide in your favor, but it won’t handle collection for you. So before you sue, always ask, “Can I collect if I win?” If not, think twice before suing.

Ask yourself whether the person you’re suing has a steady job, valuable real property, or investments. If so, it should be reasonably easy to collect by garnishing his wages if you win.

But some people and businesses are “judgment proof” — that is, they have little money and few assets and aren’t likely to acquire much in the foreseeable future. If they don’t pay voluntarily, you may have a hard time collecting your judgement. For people who seem to have no job or assets, ask whether they are likely to be more solvent in the future, since court judgments are good for 10 to 20 years in many states and can usually be renewed for longer periods. If I’m sued in small claims court but the other party is really at fault, can I countersue?

In some states, you can countersue as long as your claim arises out of the same event or transaction. In fact, in some states you must file a countersue if you have a claim against the other party; in those states you cannot sue over the same dispute in a later lawsuit.

If the amount you sue for is under the small claims limit, your case will probably remain in that court. If, however, you want to sue for more, check with your small claims clerk for applicable rules. Often, you’ll need to have the case transferred to a different court that has the power to handle cases in which more money is at stake.

What should I do to prepare my small claims case?

Whether you are a plaintiff (the person suing) or the defendant (person being sued), you need to back up your story with evidence. One of the best ways to prove your case is with letters or in-person testimony from eyewitnesses or expert witnesses. What’s the best way to present my small claims case to a judge?

First, understand that the judge is busy and has heard dozens of stories like yours. To keep the judge’s attention, get to the point fast by describing the event that gave rise to your claim. Immediately follow up by stating how much money you are requesting. After you have clearly stated the key event, double back and tell the judge the exact events that led up to your loss. Can any kind of case be resolved in small claims court?

No. Small claims courts primarily resolve small monetary disputes, and in a few states, evictions and restitution of property. No state allows you to use small claims court to file a divorce, guardianship, name change, or bankruptcy, or to ask for emergency relief (such as an injunction to stop someone from doing an illegal act). A few states also prohibit small claims suits based on libel, slander, false arrest, and a few other legal theories.

Google Chrome: Put the Home Button on the Toolbar

Google s Chrome browser gives you the option whether or not you want a button on the toolbar to bring you back to your homepage. Here is how to add (or remove) the Home button from the browser s toolbar.

I am frequently asked where is my Home button? by new Chrome users. Traditionally, all web browsers have had a Home button that when pressed takes the user back to their set homepage. However, as most users have gotten away from using homepages, the Home button is slowly being removed from browsers to simplify the toolbar. Here are the steps for getting it back.

1. Open Google Chrome.

2. Click the three horizontal lines icon in the upper-right corner of the toolbar and select Settings. Older versions of Chrome may have a wrench icon instead.

3. Under the Appearances section and check the Show Home button checkbox.

Immediately when you check or uncheck the setting, the Home button will appear (or disappear) from the toolbar.

The methods for placing and removing the Home button have changed as google has rolled out new versions of the Chrome browser. If this tutorial does not work for you, please be sure you have updated to the latest version. If you are running the latest version, just drop us a note in the comments. We ll be glad to update the tutorial again.

I am not given an Option or a Preference button on the Wrench Icon. I am only given drop-down s Bookmarks and Tools , but neither of them show HOME info. there.

Are there different versions of Chrome that add or don t had the home button? I thought Chrome was going to be way clever, but with this simple issue made way complicated, that I had to go search for help on how to find HOME and still not able to do it, leads me to believe Chrome does not know what they are doing. Did they think people just decided not to use HOME anymore? I wonder what were their reasoning?

I am having trouble with the homepage icon. I have it working such that when I bring up Chrome it goes to my homepage, but then at any time later, I click the homepage icon, it goes to a New Page. (using Chrome Version 24.0.1312.57 m on Windows 7) If I go to settings then appearance then show home page and try to change the homepage URL it is greyed out and locked on Use the New Tab page . If I click the diamond shaped note thingy ) it says this setting is set by your administrator .

I just downloaded Chrome before I started to set it up and I am an administrator on the machine. Did some type of administrator from the company network reach in as soon as I loaded Chrome (they told us to do it) and lock it up. Is there some place that I can go (as the administrator) and reset the option.

I for one am grateful. I too was a homepage addict 12 months ago, but now find myself using my homepage less as I get used to having a search available directly in the browser. There are billions of users, and we all have different preferences; courtesy costs nothing. Please avoid expresing your frustration with Chrome towards someone who wants to help you.

Struggling to get basic functionality in chrome like browsers that were standard in classic browsers. How come. Instead tons of literally useless extensions. Missing home buttons clean like context menu, drop context menu for extension sort out and list goes endless. The Dorothy Ley Hospice in Etobicoke, Ontario is committed to offering support to individuals and their families facing a terminal illness to help them live with comfort, meaning, dignity and hope. All their services are provided without charge. As a community-based organization it is designed to help people remain at home for as long as they choose. The Hospice supports the person who is ill, the family and other caregivers.

The Hospice was initiated by the Outreach Committee of St. George’s on-the-Hill Anglican Church in 1985. The hospice was incorporated in 1987 and began serving clients in 1990. Since then, The Dorothy Ley Hospice has provided support services to more than 300 clients (to 1994).

The Hospice is a non-profit organization funded by donations from individuals, churches, service clubs, companies, foundations and bequests. It offers an interdisciplinary team of health care professionals and trained volunteers dedicated to:

• providing high quality care in the home;

• alleviating pain and other symptoms;

• providing assistance with daily activities;

• providing spiritual support through clergy from many different religions with a special interest and training in palliative care;

• collaborating with existing services;

• counselling patients and their families;

• offering support and understanding to the bereaved as long as necessary after the death of a loved one;

• offering educational programs, research opportunities, a newsletter and a speakers’ bureau for explaining community hospice care to people in Etobicoke.

In response to a call for assistance, a Hospice team member will visit a patient t home or in the hospital. A personalized care plan is then developed for each patient in consultation with the attending physician, other agencies providing care and the family.

Volunteers receive 30-hours of training provided in collaboration with Humber College. Men and women of all ages and backgrounds come to the hospice as volunteers. They are provided with ongoing training, education and group support.

The Dorothy Ley Hospice

Fostering hope and dignity through exemplary care, advocacy, education and research for individuals living with the challenges of a life-limiting illness or loss.

The Dorothy Ley Hospice is a volunteer-based community service organization offering compassionate care to people living with the challenges of a life-limiting illness or loss. Our goal is to provide comfort and help them manage so they can live every day to the fullest with dignity, meaning and hope. All of our services are offered at no cost to the individual thanks to the generosity of our donors, government funding and the support of our community partners.

Our programs and services meet a variety of support needs for individuals, families and care providers. Any individual facing the challenges of a life-limiting illness, regardless of age or medical condition, can access hospice support. We also provide support services for their family members.

The Dorothy Ley Hospice has two key programs — a community program and a residential program. Services offered through out community program are available from the time of diagnosis of a life limiting illness. The residential program is available to people who have three months or less to live.

Most of us – including our friends and family members – will ultimately face a life-limiting illness and loss. In fact, as the population ages and the structure of our health care system evolves, there are few options for the terminally ill who need physical, emotional and spiritual support. The Dorothy Ley Hospice fills that critical void.

Thanks to the generosity of donors, the Hospice is able to provide services at no cost to the individuals we serve. This is why every dollar we receive from individuals, foundations, corporations, organizations, churches and special events is appreciated and valued.

Our total budget to serve more than 3,000 individuals a year is almost $3 million. The provincial government funding covers 60 per cent of our costs and we need to fundraise the remaining 40 per cent or $1.1 million a year from the community.

It wasn t until the release of her second album that Suzanne Vega achieved fame, scoring an unlikely Top Forty hit with Luka, a song about child abuse. But the singer s 1985 debut album, Suzanne Vega, had already awakened listeners to a fresh new voice, reviving the folk-music genre after nearly two decades of dormancy. For Vega, who was then twenty-five years old, the album was cause for uncertainty and isolation as much as triumph. I felt a little bit like a novelty act, she says of her auspicious introduction.

Vega was certainly an anomaly during the mid-Eighties, softly strumming an acoustic guitar and singing introspective ballads while the rest of the music world was caught up in bigger-is-better events like Live Aid and Bruce Springsteen s Born in the U.S.A. mega-tour. In retrospect, however, Vega s intimate first album proved to be a significant milestone in this decade, ushering in a flock of female folk singers, including Tracy Chapman, Melissa Etheridge, Michelle Shocked, Tanita Tikaram and the Indigo Girls.

Having taught herself guitar at the age of eleven, Vega began writing her own songs when she entered her teens. After graduating from Barnard College in 1982, she began playing small coffeehouses in Greenwich Village the same area of New York City where nearly every Sixties folkie first tuned up his Gibson. But Vega, a child of the Eighties, hardly fit the protest-singer mold. Even though she carried an acoustic guitar, her hero wasn t folk icon Bob Dylan but punk godfather Lou Reed. There were other differences as well. After years on the Northeastern club circuit, she had developed a direct, emotionally tempered style that she has said was inspired as much by novelist Carson McCullers and painter Edward Hopper as by romantic balladeers Leonard Cohen and Laura Nyro.

Weaving these diverse influences into a deeply moving album were producers Lenny Kaye (formerly Patti Smith s guitarist) and Steve Addabbo (Vega s manager), who brought modern touches to Vega s straight-ahead style, enhancing the singer s sparse sound with subtle electric guitars, graceful violins and even New Age synthesizers, all of which added gentle textures to her haunting material.

Vega s prowess with simile and metaphor dominates the entire album, perhaps most effectively on songs like Undertow, Freeze Tag and Straight Lines. But Vega s sphinxlike wordplay reaches its apex on Small Blue Thing, a ballad more reflective of an intangible feeling than a literal object. The song is actually pretty straightforward it s not a riddle, she says with a laugh. I never try and be tricky. At the time, I felt like a small blue thing. I never expected that people would think that it stood for something. Some people even asked if it s a fetus. It s not that at all it s a mood.

The structures behind folk music and folk songs are very elemental, sort of like water, Vega adds. You go through your fads with wine and soft drinks and everything else, but water is the basic thing you always go back to.

And while some shot-gunners will read this and begin to rant and rave about “cheap” this and that; they can go ahead and use their “collector’s model”, artist engraved, sleek, precision. yada, yada, yada. $3000 guns. I’ll just keep blasting away with my $200 Mossberg. As will thousands of other shooters who have discovered this attractive, durable, and dependable pump shotgun.

The Mossberg 500 shotgun is a mil-spec manufactured shotgun, meaning that it is not your collector’s “finely tuned” gun. It means that it is produced to military specifications which emphasize generous tolerance, durability and dependability.

The 500 pump shotgun is one of the most versatile shotguns on the market with interchangeable barrels. That allows the owner to change from sporting clay, to turkey, to waterfowl to deer without having to buy a half dozen guns. Important to the average hunter and shooter that is not wealthy.

And the gun will keep on shooting due to the attention to the manufacturing particulars that matter.

My Mossberg 500 shotgun is the all purpose field model and sports a 28 inch ribbed and factory ported barrel. Stocks are wood.

My gun is chambered for 12 gauge shells up to 3″. I don’t hunt at this point, with my use of the gun being sporting clays, that I love to shoot.

And the light, fast pumping gun with front bead sight comes up and around quickly making even my average skills look more impressive than they are when busting lots of clays.

The gun sports a convenient safety on the top of the gun. It can be quickly accessed with your strong hand thumb while your hand is in the shooting position.

The Mossberg 500 pump shotgun has a capacity of 5 in the magazine and one in the chamber for a total of 6 rounds ready to shoot. Recoil with this shotgun is average for a 12 gauge which means that shooting a hundred or so rounds gives you a satisfyingly sore shoulder. As far as speed goes, the gun is as fast as any pump, and utterly dependable. It comes in the box with 3 chokes and a wooden dowel plug for states that restrict the capacity of a shotgun when bird hunting. The wooden plug is a nice piece to throw away. After market metal plugs are available and are desirable if you have the misfortune to live in a state that requires it.

BOTTOM LINE: The Mossberg 500 is a shotgun that is dependable and durable, manufactured by military specific standards. It is a fun, worry free gun that is a load of fun to shoot clays or hunt with. Mossberg makes a wide range of accessories including barrels that allow you to turn your gun into anything you want it to be. Those are the most important things. Then, you only have to pay about $200 for one new in the box. That means you have the added benefit of being able to throw it in the back of your truck, lay it down in the field, drop it, swat bugs with it or paddle a boat with it and not worry about hurting it. And that’s worth a lot.

Configuring Exchange 2013 and 2016 Mailbox Limits

As with Exchange 2010 and Exchange 2007, you can configure how much email users can store in their mailboxes in Exchange 2013 and Excange 2016. You can configure the limits so it issues a warning when it approaches its limit, so it stops receiving email at a limit and specify how long deleted items are kept. A new feature of Exchange 2013/2016 (at least via the EAC ) is that you can now see how much mail a user has in their mailbox in graphical form, this has not been present since Exchange 2003.

Configuring Exchange 2013 /2016 Mailbox Store Limits

As mentioned, these limits are done at a store level so these settings we specify apply to ALL USERS who have their mailbox in the store we limit. To configure we log into the EAC then select the servers option ion the left hand menu.

We then select the databases option in the center console.Once done highlight the Exchange 2013 mailbox database that you would like to apply limits to. Then select the pencil sign to edit the options.

You are now presented with the Mailbox database properties, select the third option down which is limits. As you can see below, you can now specify when to issue a warning. when to stop allowing the user to send mail and finally when to actually stop the users mailbox from receiving email. You can also really annoy your users by sending them a pop up message on their screen warning them to remove old emails if you want to.

Onc you have decided on limits for you Exchange 2013 organization click save. We can now take a look at how much email is in a users mailbox .

To check in graphical form we use the EAC, go to recipients on the left hand menu then select mailboxes. Yo will now get a list of your users. Select the user who you would like to see how much space they have in their mailbox by highlighting the user and clicking the pencil to edit.

As you can see on the screen below after selecting Mailbox Usage. you can now see how much space the user has left available to them, however when you select more options. you can choose to individually configure the users mailbox limitations. Again configure as required then click save. we can also view various statistics for mailboxes via powershell

Drone jobs are in high demand.

Big companies, such as Amazon and Facebook. are looking for pilots who fly drones and engineers with experience in building the unmanned aircraft. And they are willing to pay top dollar for the right stuff.

Federal regulations currently prohibit the use of drones for commercial purposes. But all that will change soon, with the Federal Aviation Administration expected to soften rules next year to allow certain light-weight drones to make commercial flights up to 400 feet.

Enter drone industry jobs.

As many as 100,000 new jobs will be created in the first 10 years after unmanned aircraft are cleared for takeoff in U.S. airspace, according to a 2013 report from the Association for Unmanned Vehicle Systems International.

Large employers are already paying up for drone pilots — about $50 an hour, or over $100,000 a year — according to Al Palmer, director of the center for Unmanned Aircraft Systems at the University of North Dakota.

The university is gearing up to meet the hot demand and Palmer expects the drone industry to grow exponentially as companies discover new uses for drones.

And the tech companies are excited at the prospect.

Facebook is bulking up its drone team. Amazon has said it wants to use drones to deliver small packages over short distances. And Google acquired Titan Aerospace. which makes high-altitude, solar-powered drones.

Why Google bought a drone company

At the University of North Dakota, most of the first 61 drone pilots who graduated have gone to work at major drone manufactures, such as Northrup Grumman ( NOC ). Lockheed Martin ( LMT ). General Atomics and Boeing ( BA ).

Palmer expects drones to be used in agriculture, public safety, oil and gas exploration, and even in the film industry, among others.

University donors are getting excited too. The University of North Dakota, which started its bachelor’s degree course in unmanned aircraft systems in 2008, recently received a $25 million endowment (it’s largest ever) to build a new drone research and training facility.

Defendant in LeMond cybersquat suit issues heated denial, points to identity thief

A Twin Cities marketing expert accused in a lawsuit of cybersquatting on dozens of website domains associated with cycling legend Greg LeMond is claiming innocence, contending that some mystery identity thief must have hoarded the web addresses for future financial gain.

In a written response filed this week in U.S. District Court in Minneapolis on behalf of himself and his son, Frederick H. Stinchfield is denying the allegations leveled by LeMond and wants the lawsuit, which seeks upward of $6.6 million, dismissed.

Stinchfield, 66, of Orono, also is demanding in the court filing that LeMond and his attorney acknowledge publicly [that the] proceeding against me was erroneous and inappropriate, since these defamatory actions injure my reputation and ability to succeed in business.

One of LeMond s attorneys at the Greene Espel firm, Larry Shapiro, told the Star Tribune Thursday, We have no additional comment at this time.

In a letter Stinchfield shared with the Star Tribune that is addressed to the presiding judge, John Tunheim, the defendant makes the same denials and further claims that someone he doesn t know has stolen my identity relating to taking and registering these names. My 32-year-old son, who bears the same name, has told me he did not use my identity.

In any event, the letter continues, the elder Stinchfield said he informed LeMond s attorney that he can prepare a form where I give up any rights I may have in such marks or names.

In response, Shapiro said Thursday that LeMond will not make any public comment about any settlement discussions.

The son also is a defendant in the lawsuit, which LeMond filed earlier this month alleging that the two illegally created and bought 66 web addresses using the three-time Tour de France champion s trademarked name and his Grail carbon-fiber technology business. Among the website names are, and

LeMond announced his business venture in August 2016, and within two months, the domain names were registered by the father and son, according to the suit.

In words and photos included in the suit, the plaintiffs are alleging that the Stinchfields run a website titled LeMond Industries, which features the athlete s likeness, name and derogatory information about LeMond and his business.

The website has advertising that presumably generates revenue for the father and son and also an offer to sell the domain names in violation of the federal Anticybersquatting Consumer Protection Act, the suit reads.

An online service that verifies domain registrations lists the elder Stinchfield as the holder of

Tunheim granted the 56-year-old LeMond, who lives in Medina, a temporary restraining order that bars the Stinchfields from registering any additional domain names tied to LeMond or his business or transferring or selling the ones in dispute.

Stinchfield s court filings also include copies of an e-mail exchange he had with another LeMond attorney soon after the suit was filed. He told that attorney, Karl Procaccini, that the suit is wildly inaccurate, false and defamatory.

He went on to scold Procaccini because you should have checked your facts and discussed them with me.

Procaccini held off responding to Stinchfield s demands and allegations, but he did ask for contact information for Stinchfield s attorney.

Stinchfield responded that he can t afford an attorney, but he will seek one later to sue you and your client. for defamation and improper litigation.

A biographical outline on Stinchfield s business website describes him as a promotion industry veteran of several decades whose previous clients include Pepsi, Unilever, Olympus and R.J. Reynolds.

LeMond and his wife, Kathy, came to live in the Twin Cities full time in the early 1990s. She grew up in La Crosse, Wis.

Sit on the porch and watch sunset come to the birches and firs and remember how travel was in a 1950’s station wagon.

We had been camping and wanted to not spend the night in the rain and started looking for a motel. There were no vacancies anywhere but we were lucky enough that someone canceled their reservation. It’s close to restaurants, the Flume Gorge and Cannon Mountain. It was a comfortable room and you could here the rushing of the river.

My family and I needed a motel to use as an overnight staging area before a hike. We selected this facility based upon location and availability yet found we were totally charmed once we arrived.

The proprietor was gracious and friendly, and the two-bedroom cabin we stayed in was charming. It was typical 50s-motel decor with few outlets, but it had a small screen porch at the entrance, two very comfortable full beds in separate rooms that accessed a common bathroom, and the cabin sat above a bank of the tree-shaded and babbling Pemigewasset River.

All for $80 on a midsummer Sunday night!

What is your bedrock platform?

Although it may sound like something out of the Stone Age, this is actually a very important question for any business in the 21st century, and one clarified by Webmaster and Research Scientist Tasha Beauchamp, the presenter for a training webinar Three Top Internet Marketing Strategies for Hospice, hosted by hospice letter .

During the program Beauchamp coached listeners on the best ways for their hospice or palliative care organization to maintain a strong online presence.

I think the two things that really make the Internet different and powerful as a media are the interactivity: the ability for the publisher and the viewers to talk back and forth with each other; and the searchability: the ability for you to be found through Google or one of the first [search] engines, said Beauchamp.

The Internet is accessible 24 hours a day, seven days a week, and doesn’t take holidays. Things posted on the Internet have a permanence, emphasized Beauchamp. These are the benefits and dangers of this medium.

The initial stage of a hospice website, for most, is modeled off of the organization’s brochures, she said. It’s a good way to put information out, but even with the inclusion of a video or another feature, websites may not be utilizing the full potential of user interactivity.

Ask for input, use e-mail links, forms and surveys, urged Beauchamp. If there is a call to action, that’s definitely interactivity and that is really making your website perform. So where I’ve seen this, and [it’s] very wisely improving with hospices, is the online donation.

Beauchamp encouraged hospice professionals to keep in mind that with the Internet, you also have a pre-qualified audience: people looking at your online materials because they already have an interest in your area of expertise, unlike TV or radio where your message is reaching people who may not be really interested in what you’re offering, and you’re paying for that.

Also, keep in mind your pre-hospice audience: people who may not even recognize their hospice need until they review educational reference materials or resources available on your site. That’s content marketing, said Beauchamp.

Funds for marketing hospices have generally been down because of the nation s economy. As a result there has been a decrease in donations and fundraising participation.

Health Care Systems – Four Basic Models

An excerpt from correspondent T.R. Reid s upcoming book on international health care, titled We re Number 37!, referring to the U.S. s ranking in the World Health Organization 2000 World Health Report. The book is scheduled to be published by Penguin Press in early 2009.

There are about 200 countries on our planet, and each country devises its own set of arrangements for meeting the three basic goals of a health care system: keeping people healthy, treating the sick, and protecting families against financial ruin from medical bills.

But we don t have to study 200 different systems to get a picture of how other countries manage health care. For all the local variations, health care systems tend to follow general patterns. There are four basic systems:

The Beveridge Model

Named after William Beveridge, the daring social reformer who designed Britain s National Health Service. In this system, health care is provided and financed by the government through tax payments, just like the police force or the public library.

Many, but not all, hospitals and clinics are owned by the government; some doctors are government employees, but there are also private doctors who collect their fees from the government. In Britain, you never get a doctor bill. These systems tend to have low costs per capita, because the government, as the sole payer, controls what doctors can do and what they can charge.

Countries using the Beveridge plan or variations on it include its birthplace Great Britain, Spain, most of Scandinavia and New Zealand. Hong Kong still has its own Beveridge-style health care, because the populace simply refused to give it up when the Chinese took over that former British colony in 1997. Cuba represents the extreme application of the Beveridge approach; it is probably the world s purest example of total government control.

The Bismarck Model

Named for the Prussian Chancellor Otto von Bismarck, who invented the welfare state as part of the unification of Germany in the 19th century. Despite its European heritage, this system of providing health care would look fairly familiar to Americans. It uses an insurance system the insurers are called sickness funds usually financed jointly by employers and employees through payroll deduction.

Unlike the U.S. insurance industry, though, Bismarck-type health insurance plans have to cover everybody, and they don t make a profit. Doctors and hospitals tend to be private in Bismarck countries; Japan has more private hospitals than the U.S. Although this is a multi-payer model Germany has about 240 different funds tight regulation gives government much of the cost-control clout that the single-payer Beveridge Model provides.

The Bismarck model is found in Germany, of course, and France, Belgium, the Netherlands, Japan, Switzerland, and, to a degree, in Latin America.

The National Health Insurance Model

This system has elements of both Beveridge and Bismarck. It uses private-sector providers, but payment comes from a government-run insurance program that every citizen pays into. Since there s no need for marketing, no financial motive to deny claims and no profit, these universal insurance programs tend to be cheaper and much simpler administratively than American-style for-profit insurance.

The single payer tends to have considerable market power to negotiate for lower prices; Canada s system, for example, has negotiated such low prices from pharmaceutical companies that Americans have spurned their own drug stores to buy pills north of the border. National Health Insurance plans also control costs by limiting the medical services they will pay for, or by making patients wait to be treated.

The classic NHI system is found in Canada, but some newly industrialized countries Taiwan and South Korea, for example have also adopted the NHI model.

The Out-of-Pocket Model

Only the developed, industrialized countries perhaps 40 of the world s 200 countries have established health care systems. Most of the nations on the planet are too poor and too disorganized to provide any kind of mass medical care. The basic rule in such countries is that the rich get medical care; the poor stay sick or die.

In rural regions of Africa, India, China and South America, hundreds of millions of people go their whole lives without ever seeing a doctor. They may have access, though, to a village healer using home-brewed remedies that may or not be effective against disease.

In the poor world, patients can sometimes scratch together enough money to pay a doctor bill; otherwise, they pay in potatoes or goat s milk or child care or whatever else they may have to give. If they have nothing, they don t get medical care.

These four models should be fairly easy for Americans to understand because we have elements of all of them in our fragmented national health care apparatus. When it comes to treating veterans, we re Britain or Cuba. For Americans over the age of 65 on Medicare, we re Canada. For working Americans who get insurance on the job, we re Germany.

For the 15 percent of the population who have no health insurance, the United States is Cambodia or Burkina Faso or rural India, with access to a doctor available if you can pay the bill out-of-pocket at the time of treatment or if you re sick enough to be admitted to the emergency ward at the public hospital.

The United States is unlike every other country because it maintains so many separate systems for separate classes of people. All the other countries have settled on one model for everybody. This is much simpler than the U.S. system; it s fairer and cheaper, too.

Note – Reid s Beveridge model corresponds to what PNHP would call a single payer national health service (UK); Bismark model refers to countries that PNHP would say use non-profit sickness funds or a social insurance model (Germany); and National health insurance corresponds to single payer national health insurance (Canada, Taiwan). Reid s out-of-pocket model is what PNHP would call market driven health care. Some countries have mixed models (e.g. Sweden has some features of a national health service such as hospitals run by county government; but other features of national health insurance such as physicians being paid on a FFS basis). This explains why Reid might classify the Scandinavian systems as Beveridge while PNHP classifies them as single payer national health insurance.

What is a ‘Fixed Annuity’

A fixed annuity is a type of annuity contract that allows for the accumulation of capital on a tax-deferred basis. In exchange for a lump sum of capital, a life insurance company credits the annuity account with a guaranteed fixed rate of interest while guaranteeing the principal investment. A fixed annuity can be annuitized to provide the annuitant with a guaranteed income payout for a specified term or for life.

BREAKING DOWN ‘Fixed Annuity’

Fixed annuities are contracts issued by life insurance companies to individuals looking for guaranteed rates of return without any risk to principal. Because they are a type of insurance contract issued by a life insurance company, they enjoy some of the same tax benefits of life insurance policies, such as tax-deferred growth of earnings. Withdrawals made prior to age 59 ½ may be subject to a tax penalty of 10% in addition to ordinary income taxes .

Guaranteed Income Payments: Fixed annuities may be converted to an immediate annuity at any time to generate a guaranteed income payout for a specified period of time or for the life of the annuitant.

Safety of Principal: The capital invested in a fixed annuity is guaranteed by the life insurance company. For that reason, investors should only consider investing with life insurance companies rated A or better for their financial strength.

If you wish your Windows 2012 R2 server to respond ping commands but not by disabling the complete firewall service, here is the simple guide about how to enable ping on Windows server 2012 R2 firewall.

It is always an good idea to enable ping response in Windows 2012 R2 servers, so it will be easy to monitor and manage the network and IPs. Simple Way to Enable Ping on Windows Server 2012 R2

The below method is applicable for Windows 2012 server also.

1) Go to control panel from Windows charm bar or search for ‘control’. Open ‘Windows Firewall’.

3) We need to create a firewall rule to allow ICMP echo packets which used in ping command. Luckily the rule is already there in Windows 2012 server and it just needs to be enabled.

To enable inbound rule of allowing ICMP packets, select ‘Inbound Rules’. Find out and right click on ‘File and Printer Sharing (Echo Request –ICMPv4-In’), select Enable Rule .

That will allow incoming ping requests in Windows 2012 R2 server and respond to them without completely disabling firewall service.

Below screen shot shows how the Windows 2012 R2 server started responding ping request when the above rule was enabled.

Health Homes

The Affordable Care Act of 2010, Section 2703, created an optional Medicaid State Plan benefit for states to establish Health Homes to coordinate care for people with Medicaid who have chronic conditions by adding Section 1945 of the Social Security Act. CMS expects states health home providers to operate under a whole-person philosophy. Health Homes providers will integrate and coordinate all primary, acute, behavioral health, and long-term services and supports to treat the whole person.

Who Is Eligible for a Health Home?

Health Homes are for people with Medicaid who:

  • Have 2 or more chronic conditions
  • Have one chronic condition and are at risk for a second
  • Have one serious and persistent mental health condition

Chronic conditions listed in the statute include mental health, substance abuse, asthma, diabetes, heart disease and being overweight. Additional chronic conditions, such as HIV/AIDS, may be considered by CMS for approval.

  • States can target health home services geographically
  • States can not exclude people with both Medicaid and Medicare from health home services

Health Home Services

  • Comprehensive care management
  • Care coordination
  • Health promotion
  • Comprehensive transitional care/follow-up
  • Patient family support
  • Referral to community social support services

Health Home Providers

States have flexibility to determine eligible health home providers. Health home providers can be:

  • A designated provider: May be a physician, clinical/group practice, rural health clinic, community health center, community mental health center, home health agency, pediatrician, OB/GYN, or other provider.
  • A team of health professionals: May include physicians, nurse care coordinators, nutritionists, social workers, behavioral health professionals, and can be free-standing, virtual, hospital-based, or a community mental health center.
  • A health team: Must include medical specialists, nurses, pharmacists, nutritionists, dieticians, social workers, behavioral health providers, chiropractics, licensed complementary and alternative practitioners.

Reporting Requirements

Health Home service providers must report quality measures to the state. States are also required to report utilization, expenditure and quality data for an interim survey and an independent evaluation.

Health Home Financing

States have the flexibility in designing their payment methodologies and may propose alternatives.

States receive a 90% enhanced Federal Medical Assistance Percentage (FMAP) for the specific health home services in Section 2703. The enhanced match doesn t apply to the underlying Medicaid services also provided to people enrolled in a health home.

The 90% enhanced FMAP is good for the first eight quarters the program is effective. A state can get more than one period of enhanced FMAP, but can only claim the enhanced FMAP for a total of eight quarters for one enrollee.

The Health Home Information Resource Center located on provides useful information to States considering the health home Medicaid State Plan option HHIRC. Technical assistance is available to support state Medicaid agencies in developing and implementing health home programs under Section 2703 of the Affordable Care Act.

Home Health Hospice Aide Exam

The Oregon Association for Home Care developed the online Home Health Hospice Aide Competency exam as a standard for our industry. This examination tests the basic competencies of individuals who have received training in accordance with the Oregon Nurse Practice Act, to work as nursing assistants. The examination format is based on the Oregon Administrative Rules and the federal Medicare Conditions of Participation with nine points of emphasis relating to home care. The areas of emphasis include:

  • Communication Skills;
  • Observation of, reporting of and documentation about the patient and care provided, including basic elements of body functioning and changes in body function that must be reported to the aide’s supervisor;
  • Physical, emotional and developmental needs of, and ways to work with the population served by the home health agency, including the need for respect for the patient, his/her privacy and his/her property;
  • Maintenance of a clean, safe and healthy environment;
  • Basic infection control procedures;
  • Basic nutrition and food preparation techniques as appropriate;
  • Recognizing emergencies and knowledge of emergency procedures;
  • Reading and recording temperature, pulse and respiration;
  • Basic elements of body functioning and changes in body function that must be reported to an aide’s supervisor.

Biennially the OAHC Education Committee revises the examination and the Board of Directors approves the examination. Each test version has a two-year validity for competency of Aides. The committee provides a bibliography of resources which agencies can use to address specific training needs of the Certified Nurses Assistant or Home Health Hospice Aides.

Educational programs or agencies other than licensed agencies may purchase the testing packet for use in competency testing of aides, providing the purchasing entity has an RN available who is qualified to competency test Home Health Hospice Aides and certifies that he/she will follow the OAHC guidelines. These entities will also have use of the materials for the two-year time frame and must purchase a new packet for use beyond the stated expiration date. Licensed and certified agencies should only accept competency testing done by these agencies or programs only if agency policy allows. The entire procedure for test packet request shall be the same for non-licensed agencies as for licensed agencies, with the exception that non-licensed and certified entities will not receive the OAHC Home Health Hospice Aide certificates with their purchase of the test packet.

It was a result of my research activity that I ended up pursuing an interest in forensics. In 2000 I was involved in collaborative research with teams of forensic odontologists (dentists) in the UK, US and Canada.

Forensic odontologists carry out body identification work from dental remains at accident and crime scenes, and at mass casualty sites. For instance in the aftermath of a plane crash and at The World Trade Center post 9/11. The research we conducted was primarily to examine the emotional and psychological impact of this kind of work. We also explored the forensic implications of biting behavior within the context on a criminal investigation; given that bitemarks are often found on the victims of violent and sexual crime.

Common Construction Injury Types

The construction injury carries significant risks of injury to construction workers. According to the CDC, of the 3.3 million nonfatal injuries and illnesses reported in 2009, more than 9% were experienced by construction workers. Construction workers experienced 4.3 nonfatal injuries and illnesses per 100 full time workers. Falls accounted for 22% of these injuries and illnesses construction workers reported.

Causes of Construction Injuries and Some Legal Remedies

The causes of construction injuries are numerous and varied. While some of these causes are easy to spot, others are less obvious. Familiarizing yourself with common injury types will help you avoid injury and identify any injuries you may have already suffered. Below, you’ll find explanations of some of the most common construction injury types.

One of the most common types of construction injuries are falls. Construction workers are at risk from falls from scaffolding, cranes, roofs, ladders, and other heights at work. If you’re injured in a fall, you may want to file a Workers’ Compensation Claim and possibly a personal injury lawsuit against your employer or another party.

Construction workers are at risk of being struck by objects from above, for example, tools used above the worker or construction materials that aren’t properly secured. Brain and spinal injuries can occur, even if you’re wearing appropriate safety equipment such as hardhats.

Equipment Related Accidents

Fires and Explosions

Construction sites often contain hazardous conditions such as exposed wiring, leaking pipes, and flammable chemicals that could lead to fires and explosions. Less common than some other types of accidents, these can, however, be fatal or result in serious injuries.

Trench or Building Collapses

Another common type of construction injury is when a trench that’s being built collapses on the workers inside. A building that’s being demolished or that’s under construction can suddenly or unexpectedly collapse, killing or seriously injuring those inside. Even if the cause of the accident can’t be directly determined, a negligence legal theory of res ipsa loquitur may apply and you can still be compensated without proving who was negligent or in what way.

Repetitive Motion Injuries, Heat Stroke, and Other Overexertion

Due to the hard physical labor required for construction work, employees in this industry often have injuries related to overexertion, including:

  • Repetitive motion injuries
  • Muscle and joint damage due to overuse
  • Heat stress in hot conditions that can lead to brain, heart, or kidney damage or death
  • Hypothermia or frostbite resulting in the loss of fingers, toes, and parts of the face in cold climates

High Lead Levels

Unsafe construction sites and work practices can lead to work exposures to lead. Construction workers represented 16% of elevated blood lead concentration cases in 2002-2008.

From 1990 to 1999, more than 1,000 construction worker died from pneumoconiosis. Pneumoconiosis is legally defined as a chronic dust disease of the lung arising out employment, usually in coalmines. The most common pneumoconiosis conditions that have led to death in construction workers are Asbestosis. Coal Workers’ Black Lung. and Silicosis. Types of Medical Conditions Caused by Construction Injuries

  • Post-Traumatic Stress Disorder (PTSD) from the experience of a traumatic accident, such as when fellow workers are also injured or killed
  • Toxic exposure to chemicals, such as from welding jobs
  • Head or traumatic brain injuries (TBI) often from falls or having objects dropped on a construction worker on the job site

N.Y. Education Law Article 129-B Notice of Audit Issued to New York Colleges and Universities

Many institutions are reporting receipt of a letter dated June 26, 2017 from the New York Office of Campus Safety with an attached Notice of Audit (“Notice”) pursuant to New York Education Law Article 129-B (N.Y. Educ. Law §§ 6439–6449). The Notice seeks data submissions relating to the provision of Article 129-B and it includes 23 separate requests for information and documentation. The response to the Notice must be postmarked no later than July 7, 2017.

This audit comes at a time when key institutional personnel, including student affairs professionals, are away from the office on vacation and some institutions are closed. In addition, the short turnaround requested (fewer than 10 calendar days over a major holiday weekend) gives very little time to gather the responsive materials, let alone review and redact them if necessary. The time period is far less than what is required to respond to a discovery demand under the New York Civil Practice Law and Rules.

We believe that it is unclear whether FERPA permits the release of personally identifiable student information to the New York Office of Campus Safety, which is an office of the New York Division of Criminal Justice Services and not an office of an education agency.

The statute at § 6449 provides only for the collection of aggregate data, consistent with the statute’s emphasis on confidentiality and respect for the privacy of those involved in the process. Section 6449(3) emphasizes that, even when collecting aggregate information “the department shall not release the information, as provided for in this section, if it would compromise the confidentiality of reporting individuals or any other party….”

Eleven of the 13 requests in the Notice contain statutory references to the applicable section of Article 129-B as authority for the requested data. Two of the requests, numbers 9 and 10, contain no reference to the statute and there does not appear to be any specific section of the statute that supports the sensitive nature of the data sought in requests 9 and 10. Additionally, request number 4 seeks copies of all “no contact orders” issued by the institution, although there does not appear to be a statutory basis for such a request. Number 6(a) seeks data on all students subject to interim suspension, although that request also appears to be beyond the scope of the referenced statutory section.

Notwithstanding the unrealistic time frame to respond to the audit requests and credible questions about the statutory basis for specific requests, institutions must begin to prepare a response.

Request an Extension

We encourage institutions that do not anticipate that they will be able to comply with the aforementioned deadline to contact Deputy Director Stacey Hamilton by telephone to request an extension and follow up with a written request and/or confirmation.

Prepare Materials for Submission

Institutions should plan to submit easily accessible data such as policies, blank forms, website material by July 7, 2017, or the extended deadline, and include a cover letter indicating that, where applicable, additional materials will follow as soon as possible. In that cover letter, the institution may articulate the factors, if applicable, that make it difficult to respond within the narrow time frame allotted. One of those factors may be that the materials have to be carefully reviewed in order to redact confidential information in accordance with the privacy considerations emphasized in Article 129-B and other privacy laws.

We suggest that with regard to request numbers 1, 2, 3, 5, 6(b), 7, 8, 11, 12 and 13, institutions collect the documents and data developed over the past academic year (Fall 2016 to Spring 2017). Note that for request number 12 regarding campus climate assessments, institutions should exercise care when preparing a response to prevent the identification of any particular student.

Concerns with Respect to Disclosure

Request number 4 asks for information and documents regarding each request for a “no contact order” received by the institution. Institutions may decide to provide a copy of the institution’s template “no contact order” language, rather than specific orders, together with data on the number of orders issued and the number of orders that were changed. Although the New York State Office of Campus Safety appears to be seeking copies of specific “no contact orders” that include the names of the students, it is unclear that they have the right to this personally identifiable information under FERPA.

Similar consideration applies to request number 6(a). It may be acceptable in the initial response to provide aggregate data on interim suspensions and not data that could identify a specific student. In light of the statute’s emphasis on confidentiality and privacy, and the fact that the statute refers to aggregate data, the Office of Campus Safety may not have the authority to receive personally identifiable information.

A separate issue is the scope of request numbers 9 and 10, which seek an academic year’s worth of records relating to all reports of incidents covered by Article 129-B and all records involving misconduct hearings covered by Article 129-B. These requests are overly broad, are seriously inconsistent with the statute’s emphasis on confidentiality and privacy, and are not in accord with the statute’s authorization to collect aggregate data. Institutions should be consistent in the documentation provided for each case and should make sure information does not contain personally identifiable information about students while this issue remains unresolved.

In a letter to the Office of Campus Safety dated June 29, 2017, the Commission on Independent Colleges Universities in New York (CICU) has raised the question of redacting personal information pertaining to students.
