Starting in 1987, Let’s Look Over 23 Years of Herpes Lawsuits

In 1987 Tony Bennett made headlines when he was ordered by the courts to undergo medical tests to determine if he could have given a woman genital herpes. Bennett said he didn’t have herpes and that his doctors report confirmed this. Her lawsuit was for $95 million and he, naturally, was counter suing for $100 million.

I can find many references to the filing of this case, and none to how it was eventfully settled .

Also in 1987, this was making headlines:

The decision upheld the right of Jane Maharam, 56, to sue her former husband Robert, 56, on her claim that he had herpes and did not tell her. The court found that such partners have a legal duty to inform each other about their venereal diseases.

1992 was another big year in herpes lawsuits:

One of the big news items was that a 1986 lawsuit filed again the actor/comedian Robin Williams was finally settled. That’s 6 years later after the herpes lawsuit was filed! The case was settled out of court for an “undisclosed sum.”

The 1992 article in The New York Times, “Pillow Talk ” brings up much that is still hotly being debated today:

1. Mr. Williams s lawyer, argued in court papers that a person who doesn t ask and doesn t insist on prophylactics should assume the risks.

2. So, legal experts have begun to ask whether the responsibility for taking precautions should be shared. Everybody should be on notice that unprotected sex creates risks of all sorts, and you shouldn t rely totally on the good-faith disclosure of a partner, said Catherine O Neill of the Legal Action Center.

3. He also noted that judges have not come right out and described what they would consider a legally acceptable way to break the bad news to a lover. They haven t exactly spelled out a kind of Miranda warning for these cases, Mr. Rabin said.

4. In herpes litigation, the claims against partners have ranged from those who sinned by omission, keeping mum about their status, to those who, when asked if they had a sexually transmitted disease, lied. In a 1984 opinion in a herpes case, a California appellate court acknowledged that while rulings on bedroom behavior infringed the right to privacy, public-health-policy concerns loomed larger. Courts have decided that if someone is infected, aware of it and sexually active, that person has a duty to inform a partner, who by extension, has a right to know.

2004 Herpes Lawsuits

In 2004 it was alleged NOT that Liza Minnelli had actually given David Gest herpes, but that Liza Minnelli had not told him that she had herpes until months after they had been married. Essentially, what was put forth was that this would make the prenuptial agreement invalid as the agreement would have been based on fraud… not all the information was given to Gest when signing the prenup.

2006 Herpes Lawsuit

Michael Vick, the football player who was later went to jail for dog-fighting and animal cruelty, settled a lawsuit filed by a woman who said he knowingly gave her herpes. The name “Ron Mexico” became infamous as that was the fake name Vick is reported to have used when seeking treatment for herpes.

2007 Herpes Lawsuit

In Los Angeles CA, Elizabeth Mazzocchi filed a herpes lawsuit against NYPD Blue actor Esai Morales. Once again, you only can find reference to the announcement of the lawsuit, and no reference to its outcome .

2009 Herpes Lawsuit

A woman was awarded $7 million in a suit filed by a 56 year old woman who was infected with herpes by a 77 year old man. Interesting here is the woman said she was denied health insurance after getting infected with herpes. The77 year old man said he would appeal.

2010 Herpes Lawsuit

A woman from Chicago filed a herpes lawsuit seeking $50,000 against her husband. The 1987 Tony Bennett lawsuit was for $95 million. Now, lawyers will take cases for $50,000. It seems it’s getting easier and easier to sue for herpes.

Where there is blood in the water, you are sure to find sharks. Lawyers seem to be more actively chasing the herpes ambulance.

WHAT DOES THE FUTURE HOLD FOR HERPES LAWSUITS?

MORE HERPES QUESTIONS THAT LAWSUITS MAY DECIDE:
• Is there a double standard for oral herpes and genital herpes? Is this fair?

• Should people have to disclose that they have oral herpes before kissing another person?

• Can you be sued for having HSV-1 (usually oral herpes) and having oral sex, and not telling the other person?

• If you give a person HSV-1 through oral sex can you be sued?

• Can you be sued for KISSING another person and giving them HSV-1 oral herpes?

• Do you have to tell that you have genital herpes if you practice safe sex and it’s a one night stand?

• If you are participating in RISKY BEHAVIOR, does that mean you assume the risk? (Could a prostitute sue someone for giving her herpes?)

• Do porn stars have a right to know if the person they are working with has herpes?

• Must you tell the truth of your STD status if the other person asks? In other words, “Is LYING the same as simply not telling?”

• Is the responsibility of discussing herpes and other STDs a one way street? Is only a person who knows they have or have had an STD required to bring it up?

• Is a person who has unprotected sex with lots of people required to be truthful about this when asked? After all, it’s the risky behavior that makes a STD more likely. People that get tested are simply being responsible. Must the responsible people bear all the responsibility simply because they got tested?

• Does a person have a LEGAL responsibility to know their STD status? If a person is having unprotected sex with multiple partners, shouldn’t they know that they may be passing on STDs to other people, even if they haven’t received an official test? A reasonable person would know this.

• Is a person who has a STD but fails to get tested still legally responsible for giving the other person their STD? (The ignorance is bliss excuse is an excuse…)

Consequences of a Hit and Run Accident

Getting into a vehicle accident can spur some pretty basic human instincts: If we feel we ve done something wrong, our first impulse could be to flee the scene. But it should come as no surprise that fleeing the scene of a car accident can result in very serious ramifications down the road. We’ll look at those consequences in this article.

What is Hit and Run?

Generally speaking, a hit and run is defined as being involved in a car accident (either with a pedestrian, another car, or a fixed object) and then leaving the scene without stopping to identify yourself or render aid to anyone who might need assistance. At least a few states also include in the definition of hit and run any collision with an animal.

In most states it doesn t matter whether you caused the accident or not. The act is committed simply by leaving the scene. If you must leave the scene of an accident to access emergency assistance — by going to a nearby hilltop to get a cell phone signal, for example — most states do not consider that to be a hit and run, as long as you return immediately to the accident scene.

Most states do not require that the hit and run occur on a highway or public road. Many states extend hit and run laws to cover parking lot collisions. For example, if you back into an unoccupied car in a parking lot and fail to leave a note with your contact information on the windshield, the laws of many states treat this as a hit and run.

Criminal Penalties for Leaving the Scene of a Car Accident

The criminal penalties imposed for a hit and run vary from state to state. Many states classify the criminal penalties for a hit and run as either felonies or misdemeanors, depending on the circumstances. Felony hit and run is defined by most states as leaving the scene of an accident where there is any type of injury to a person, whether the injured person is a pedestrian or an occupant of a vehicle.

The penalties for felony hit and run can be quite severe. Most states impose fines of between $5,000 and $20,000. And there is very real potential for incarceration as punishment for a felony hit and run. Depending on the nature of the accident and the injuries that resulted, in some states a felony hit and run is punishable by up to 15 years in prison.

Remember, a hit and run might be classified as a misdemeanor instead of a felony. While the term misdemeanor sounds relatively minor to some people, in most states misdemeanors are punishable by a significant fine of up to $5,000 and also by up to one year in jail.

Administrative Penalties for Leaving the Scene of a Car Accident

In addition to the criminal penalties for hit and run, almost every state imposes administrative penalties related to your driver s license. These penalties are often imposed through the individual state s Department of Motor Vehicles.

Any conviction for hit and run, regardless of whether it s for a felony or misdemeanor, typically results in an automatic suspension or revocation of your driver s license for a period of six months or so. In some states the revocation can be as long as three years. Depending on the state in which you live, and the nature and circumstances of the car accident in which you were involved, the penalty for hit and run may include a lifetime revocation of your driver s license. These administrative penalties are in addition to any criminal punishment that might be imposed for hit and run.

Civil Penalties for Hit and Run

If you have caused the accident, it is possible that another person involved in the crash may sue you in court for the damages they suffered. Such a lawsuit may ask for monetary compensation for medical bills, lost wages, and property damage.

Of course, this kind of lawsuit is likely to happen anyway even if you did not commit a hit and run at the scene of the accident, if you are deemed at fault for the car accident. But if you are liable for hit and run on top of having caused the accident, the damages that a court orders you to pay will almost surely be increased. Many states will impose treble damages on you. What this means is that any damages awarded to the plaintiff are automatically tripled, mainly to punish the defendant’s bad behavior.

For example, if the jury in a civil suit awards the plaintiff $10,000 in damages, the judge will automatically triple that amount to $30,000 because the hit and run amounts to particularly reckless and egregious conduct. In most instances, treble damages of that nature are not covered by your car insurance policy. In other words, you will have to pay that amount out of your own pocket.

One of the nice things around the rising tide of OWIN in the .NET ecosystem is that it literally supports пїЅhosting anywhere пїЅ as long as thereпїЅs a viable host!пїЅ. For fans of TDD, the great thing about this is пїЅanywhereпїЅ includes пїЅinside your unit testsпїЅ.

This lets you build a really powerful development workflow where you can lean entirely on your test runner while building your APIs, and not have to bother with the painful cycle of breaking out into external tools. You get to execute the entire WebAPI stack, from inside your acceptance or unit tests and get rapid feedback.

This only works if youпїЅre using WebAPI hosted пїЅusing OWINпїЅ, and allows you to write tests that look like this:

Combined with manipulation of your container registrations, you can execute full stack tests with a single mocked out component like your data store like this:

Powerful right? Lets take a look at how we put this together over a vanilla WebAPI controller, with a single DIпїЅd dependency.

WeпїЅre going to use a few nuget packages пїЅ the ones provided by Microsoft to host OWIN components in IIS, some testing helpers that support in process hosting of OWIN components outside of IIS, and Ninject an IoC container.пїЅ We have a packages.json that looks like this:

There are a couple of important pieces here пїЅ the WebAPI app with itпїЅs OWIN Startup file, a Ninject dependency resolver to hook up IoC into WebAPI, and the controller described earlier. In addition to this we have the interface IGetValues implemented by ValueService. For this example, ValueService is very simple:

Your OWIN startup class is effectively your пїЅGlobal.asaxпїЅ пїЅ it bootstraps your app and configures components.

YouпїЅll see that weпїЅre configuring routes, creating a new Ninject пїЅStandardKernelпїЅ IoC container, and using the Ninject.Extensions.Conventions library to bind up all our components пїЅ in this case just our IGetValues service. IпїЅll skip over the implementation of the Ninject dependency resolver, but all it does is delegate calls to create components to the Ninject standard kernel.

Pressing F5 in Visual Studio will launch the WebAPI app in IIS Express, and you can visit it in a browser

Now we have a working WebAPI app, lets see how we can test it in memory. We want to build a test that runs the whole of the WebAPI stack in memory, and asserts on its response.

To do this, we need to use a couple of packages пїЅ the Microsoft Owin HttpListener package, the Owin Hosting package and Owin testing package, alongside our test framework (NUnit).

With those packages installed, we can write a test that wires all these components together.

What weпїЅre doing here is using the Owin hosting components to invoke our apps Startup class, hosted over HttpListener, on localhost on the port 8086. WeпїЅre then using a regular HTTP client to connect to this server, execute a request, and assert on a response. ItпїЅs a small marvel that we can do this at all, but TDDers will be cringing at the amount of noise in the test distracting you from the meaningful parts of your test пїЅ the preconditions and assertions. We can do better than this!

A Less Noisy Approach

Consider this class

Firstly, itпїЅs a base class that tidies all the noise out of the way пїЅ all the boilerplate code is moved into a test fixture setup and teardown, and weпїЅre detecting the first available free port to ensure that tests written execute on any machine theyпїЅre executed on. Using this class, our previous test becomes

instantly becoming readable and exposing only the things we really care about in the test пїЅ what weпїЅre asking our code to do, and what the response is. We can pretty much use this base class everywhere because itпїЅs bootstrapping our entire application for each text fixture.

Given how hard itпїЅs previously been to test the full ASP.NET web stack, this is a revelation пїЅ you can write full stack acceptance tests without an installed web server, and with no additional infrastructure or support.

In real world examples your application likely has many components that connect to and use external resources (databases, web services) that youпїЅll want to isolate and replace with test doubles. With some creative use of our IoC container, we can get the best of both worlds and execute full stack acceptance tests (because at this point, weпїЅre definitely not пїЅunit testingпїЅ) while swapping out пїЅjustпїЅ your data access component or пїЅjustпїЅ an API client library to provide fake responses.

To do this, we want to rebind parts of our application stack for each test, and luckily, Ninject (and pretty much any other good container) makes this quite easy. Consider the following additions to our base class

ItпїЅs a little bit long winded, but what weпїЅre doing is maintaining a dictionary of Mock objects (using Moq) and providing some helper methods for use in our unit tests. When a unit test calls the method пїЅMockOutпїЅ a mock is generated and returned for the test to use. This Mock is пїЅfrozenпїЅ for the duration of the test fixture and rebound into our IoC container.

What this means is that we can bootstrap our entire stack, and then re-register a single component to a Mock, letting us manipulate a single external resource. This becomes exceptionally useful in our broad acceptance tests

Here you can see weпїЅre replacing the implementation of IGetValues with a mock that returns a known value, and asserting that the full stack call returns a body with that value in it. The test is synthetic, but the application is very real пїЅ you could mock out API calls to third parties, mock out your entire data store or a single component and verify the full execution of your entire system.

These broad acceptance tests, combined with unit tests of individual components give you the perfect mix of high level пїЅfeature focusedпїЅ tests (you can add a BDD framework of choice if thatпїЅs your thing) that assert on behaviour not implementation and regular пїЅTDD Unit TestsпїЅ around the components that your system is composed from.

There are lots of parts of ASP.NET vNEXT that are пїЅcoming soonпїЅ or пїЅwait and seeпїЅ, but the community effort around OWIN and the maturation of some of the middleware frameworks makes this a technique you can and should adopt now.

While not quite as completely end to end as the solution you have provided, you can also assign an HttpServer instance to be the HttpMessageHandler of an HttpClient, which allows you to use an HttpClient in exactly the manner you have described here, but without using any system resources to bind the site to an actual port (which has a happy side effect of not requiring you to run the tests as an administrator). Additionally, this lets you test sites which are not currently OWIN-hosted.

What Does a Sports Psychologist Do?

A sport psychologist might spend his time in two different aspects of this field – research or counseling.

Research in sport psychology involves studying and observing athletes in order to find out what motivates them to keep pushing on, and what gives them the thirst for landing in the winner’s circle. A sport psychology researcher might also try to find ways for athletes to perform better and with fewer obstacles. The knowledge gained through this research can then be applied during counseling sessions with athletes.

In order to help an athlete, a sport psychologist must be able to first identify the problem that the athlete is facing. An athlete might benefit from a counseling sport psychologist in a number of situations. Some athletes, for instance, may be having trouble concentrating due to a number of personal issues, such as family problems or relationship problems. Sport psychologists typically work in facilities that cater to and accommodate athletes of all different shapes, sizes, and ages.

High schools and colleges might hire a sport psychologist to talk with and counsel their student athletes, for instance. Some sport psychologists may even work exclusively with professional sports teams and other professional athletes. METHODOLOGY

For most categories, NerdWallet averaged rates from the largest insurers for 30-year-old men and women in 10 ZIP codes and with 100/300/50 liability insurance limits, 100/300 uninsured and underinsured motorist bodily injury coverage, and $50,000 uninsured and underinsured property damage coverage. We used a 2012 Toyota Camry in all cases.

Our sample retired driver was 67 and drove 50% fewer annual miles than other groups. Our sample young driver was 22 and carried the minimum required coverage. These are sample rates generated through Quadrant Information Services. Your own rates will be different.

Texas SB4 Immigration Enforcement Law: 5 Things to Know

The state of Texas has passed a law that has been described as a ban on “sanctuary” cities, but there is much more to the law that doesn’t get captured by that term.

Opponents say it not only puts immigrants in the cross hairs of law enforcement, but also U.S. citizens, legal residents, public officials and law enforcement officers. The law’s supporters say it is designed to boost public safety by enforcing laws already in place.

The Texas law, which goes into effect in September, follows one passed in Arizona that also tried to use local and state law enforcement to question the immigration status of residents. The Supreme Court gutted the Arizona law and a settlement removed a “show me your papers” provision requiring officers to investigate a person’s immigration status if they had “reasonable suspicion” the person was illegally in the U.S.

The legal fight over the law has already begun, so here are five things to know about the law:

It’s not just police who will enforce immigration

The law enlists city council members, members of county commissions or other local governing bodies, sheriffs, district and city attorneys and even police on the campuses of colleges and universities in the effort. It prohibits them from adopting any policy to prohibit or “materially limit” a corrections officer, commissioned peace officer, booking clerk, magistrate, district attorney, criminal district attorney or other prosecuting attorney from checking into a person’s immigration status and reporting that information to the feds or another local entity.

Government officials or campus police in those positions also can’t stand in the way of federal immigration officers enforcing immigration laws at a local jail.

Officials can be removed for not complying with the law

Some officials have said the law doesn’t mandate that local entities investigate a person’s immigration status, but it permits it.

But the law allows state officials to remove from office any elected or appointed official who prohibits or “materially limits” enforcement or cooperation with immigration federal officials. Uncooperative sheriff, police chief, constable or jail administrators could face Class A misdemeanor charges. Defiance could mean fines of between $1,000 to $1,500 for the first violation and $25,000 to $25,500 for each one after that.

Thomas Saenz, president and general counsel for the Mexican American Legal Defense and Educational Fund (MALDEF) said the state is treading precarious ground with those provisions. He argues a local official who voices disagreement with the provision could be seen as obstructing police officers from immigration enforcement. The provision may not stand up against First Amendment protections, he said.

But Texas Governor Greg Abbott said the law has “already been tested at the United States Supreme Court and approved there.”

It encourages people to turn in their local government or university officials

The state’s cops, sheriffs and government officials may have to keep looking over their shoulder. Employees of the local governments or colleges and universities can turn in any employer who is not following the law. Then, the attorney general can order compliance or take the entity to court.

Victims and witnesses could be asked about their immigration status

There are protections for crime victims or witnesses from being questioned about immigration status. But the law also provides some exemptions.

Officers can ask the victim or witness about their nationality or immigration status if the officer has “probable cause” to believe the victim or witness committed another crime. (Entering the country without inspection is a misdemeanor, so that would constitute as a crime).

It promises to defend those who are sued for complying with the law

The law says the state attorney general will defend anyone who is sued for complying with the law. The governor says it’s about public safety.

“This bill will help keep dangerous criminals off our streets and protect innocent lives. For every ounce of criticism, there is a pound of praise from Texans who simply want laws to keep them safe,” stated a spokesperson for Abbott.

Civil rights organizations like MALDEF say there is no question there will be litigation. They say public officials and law officers that honor detainers are certain to face Fourth Amendment legal challenges because there often isn’t sufficient cause for local officials to hold someone in detention beyond a release date. There also are certain to be civil rights and racial profiling accusations.

Texas taxpayers will be footing state costs for defending the law and its enforcers.

“It’s an open checkbook and there are going to be lots of suits,” said Saenz. “Why a fiscally conservative governor and legislature would write a check like that is the untold story.”

With an embedded deductible, each family member has an individual deductible/out-of-pocket amount. Any deductible amount contributed by an individual will apply to the family deductible amount, but no individual family member is required to contribute more to the family deductible than their individual deductible amount. The out-of-pocket accumulates on an embedded basis as well. With a non-embedded deductible product, all family members have a shared deductible and out-of-pocket family maximum. The entire deductible must be satisfied before coverage can begin for any individual family member. And, the entire out-of-pocket maximum must be satisfied before the family has satisfied the out-of-pocket maximum. Plans with a deductible component will have the deductible included in the out-of-pocket maximum.

    Cell phones have practically become an extension of our bodies — they’re our phones, computers, cameras, watches, alarm clocks, game systems and more. But getting one can be difficult if you don’t have credit.

    Carriers want to avoid customers racking up huge bills and then not paying them. To this end, many major cell phone companies will check your credit to evaluate your financial responsibility and ability to pay each month.

    If you have bad credit or no credit history, you may have to jump through some extra hoops, but you can get a cell phone with no credit check.

    1. Go with a prepaid carrier

    Prepaid cell phone plans don’t require a credit check. That’s because you pay in advance for your service, usually on a monthly basis, so there s no risk for the cell phone provider. The four major carriers — Verizon, AT T, Sprint and T-Mobile — offer prepaid plans, often for less than their traditional plans.

    One downside: Because there is no commitment with a prepaid plan, you can’t pay for your phone in installments like you would with a traditional plan. The price can range from less than $1 to more than $500, depending on the phone you choose. But you may be able to avoid the upfront cost of a new phone by using your existing one.

    2. Join a family plan

    Most carriers offer family cell phone plans. and some let you have as many as 10 lines on one plan. Although the main account holder must pass a credit check to establish service, those using the additional lines do not. The main account holder is also the one ultimately responsible if you don’t pay your bill, so take care not to miss any payments.

    If you do join a family plan, you won’t just bypass a credit check, you may also save some money. Traditional individual plans start at $40 to $50, depending on the carrier, but a family plan split four ways can run as low as $25 per person, before taxes, fees and add-ons like insurance.

    3. Pay a security deposit

    You can often get a cell phone plan with no credit history if you first pay a deposit. Deposit amounts will vary based on the carrier and your credit score, but they could run up to several hundreds of dollars. And deposits are generally per line, so if you want multiple phones on your account you will pay multiple deposits. Most carriers will refund your deposit after a year if you consistently pay your bill on time.

    4. Find a co-signer

    Similar to getting a personal loan with bad credit. you can often get a cell phone plan with bad or no credit if you have a co-signer with good credit. Unlike a personal loan, however, the account would be in the co-signer’s name, meaning that person is on the hook if you don’t pay your bill.

    The co-signer can eventually move the account into your name. Most carriers will run your credit when you do so, but that doesn’t mean you’ll have to pay a deposit. With T-Mobile, for example, you can usually move the account into your name after 60 days. Although the carrier will check your credit, it won’t require a deposit because the account is already open. Just keep in mind that each carrier handles this differently.

    You have options

    A prepaid plan is often your best bet if you want a cell phone plan but have no credit or bad credit. If the upfront expense of a phone is too much, though, try joining a family plan. That way you can share the plan cost while you work to build your credit enough so you can venture out on your own plan.

    You’re 18, you have a driving licence and access to a car – you’ve got the world at your feet –but you’ve also got some of the most expensive motor insurance premiums holding you back.

    Statistically speaking, young drivers are among those most likely to be involved in an accident and therefore make a claim on their insurance. Car insurance companies set higher premiums for younger drivers to offset the increased risk of having to pay out.

    You could actually be a very safe driver, but you’ve probably not got a lot of proof of that. Even if you passed your test pretty soon after turning 17, you’ll still only have a year’s worth of no claims bonus, at best.

    But you’re not necessarily doomed to pay sky-high prices for cover, as there are things you can do to help bring costs down. Here’s a look at the cost of car insurance for 18 year olds, and how you can save money on it.

    Is cheap car insurance for 18 year olds possible?

    The amount you pay for car insurance is based on how likely it is you’ll make a claim for damage or theft.

    Insurance companies have a lot of data on car insurance claims and the people who make them. They use this information to assess how likely it is you’ll make a claim. The data they use concerns things like your age, driving experience, location and occupation.

    As young drivers are more likely to be involved in an accident than middle-aged drivers, perhaps due to their relative lack of experience on the roads, they tend to pay more for cover.

    As you get older, earn your no claims bonuses and get more experience on the roads, you’ll start to see your motor insurance premiums fall. In the meantime, however, there are things you can do to reduce your premiums.

    It used to be that young women paid less for cover than young men, as once again statistics show men are more likely to be involved in an accident. However, the European Court of Justice’s (ECJ) Gender Directive means that insurers can no longer discriminate on the grounds of gender.

    Types of cover

    There are three basic levels of car insurance cover and, generally speaking, you’ll find that, as the cover gets more comprehensive, the price goes up.

    The lowest level of cover you must legally have before taking a vehicle on the road is third party cover. This type of cover only protects you against damage to other people and their property.

    It might be the cheapest of the three options, but if you have third party only cover and you’re involved in an accident, you’ll have to pay for repairs to your own vehicle out of your own pocket.

    Next is third party, fire and theft cover, which also protects you against fire damage and theft, but not against damage to your vehicle caused by a road traffic collision.

    Finally, there’s fully comprehensive cover, which protects you against everything already mentioned, plus any damage caused to your own vehicle.

    Of course you can opt for a lower level of cover to save money, but it could prove a false economy if you’re involved in an accident and end up with a huge repair bill.

    With any policy there are also the optional extras such as a courtesy car, breakdown cover and legal expenses cover, which will inflate your premiums. You can always forego these extras to keep your costs down, but think carefully about whether or not you’ll need some of them.

    Consider telematics car insurance

    If you feel unfairly persecuted by the cost of car insurance for 18 year old drivers, you might want to consider telematics car insurance. Otherwise known as ‘black box’ insurance, telematics policies give you a tailored quote based on how you drive.

    A small device is fitted to your vehicle which, using satellite technology, measures your speed, braking, acceleration and mileage – giving the insurer a comprehensive and accurate impression of how you drive. If you are a good driver and don’t travel very far, it could result in cheaper car insurance for 18 year old drivers.

    If you’re 18, you may be off to university soon, and only want to use your car when you’re back at home. In that case, temporary car insurance for 18 year olds may be the answer. Typically this short term car insurance covers you for between 1 and 28 days and is therefore cheaper than insuring a vehicle for a full year.

    As young drivers are penalised for having relatively little experience on the roads, you could always take an advanced driving course to show insurers you have a bit more experience behind the wheel. The Driving Standards Agency’s Pass Plus course can help to bring your costs down by up to 35% with some insurers.

    Keeping your vehicle secure will reduce the chances of it being stolen or damaged and earn you cheaper cover. For example, keeping your car in a locked garage overnight is more secure than having it parked on the street, and is reflected in cheaper premiums. Similarly, installing insurer-approved security equipment such as steering wheel locks and immobilisers should bring down the cost of your insurance.

    And finally, driving safely and without making a claim will earn you a no claims bonus at renewal time, as doing so demonstrates to insurers you are a good driver.

    I have a restored 1974 V35B and this is far in a way the best maintenance I’ve found in California. Additionally, Alan owned a G35 for many years, so he is extremely knowledgeable about older V-tails. I found them because the ABS hosted a service clinic at their facility last year, and you couldn’t help noticing that everything, (including the white epoxy floor) was spotless

    If you haven’t been to Santa Ynez, it’s a nice visit – a small valley with good wineries. It’s actually quite similar to Napa 20 years ago, and only 30 minutes from Santa barbara beaches. (sumbitted by ag)

  • Noise: It’s the same old story. The airport was built in the middle of nowhere. Developers build homes on adjacent land and sell them to unknowing homeowners-to-be. Complaints start, etc. The fact that the airport preceeded the homes, interesting as it may be, is not necessarily relevent. In any event, perhaps it’s a good idea to be a good neighbor.     I’m new to the area. How do I get water service?

    You can establish an account by placing a deposit with us at North Miami Beach City Hall, Customer Service, 17011 N.E. 19th Avenue, Lobby. Hours of service: Mon-Fri, 8:15am – 4:15pm.

    If you call in advance, they can give you the exact amount of the deposit required. Their number is 305-948-2960. They ask that you provide proof of ownership or a copy of a valid lease. They are pleased to initiate service for you the same day if we receive the deposit by 3:00 p.m.

    How do I discontinue my water service?

    To terminate your water service, call Customer Service at 305-948-2960 to request the date you wish your service to be discontinued. Next day service is available Monday through Wednesday. Terminating your water service includes our getting a final meter reading, credit of your initial deposit to your final bill, and mailing a final bill to your forwarding address. If any refund is due, a check will be included with your final bill.

    a. All bills rendered or charges made by the City which are in arrears as provided in these rules shall be delinquent accounts.

    b. All delinquent accounts, including meter water supply service, may result in the service of the City being discontinued and the water supply shut off from and to the premises of the owner or consumer of such account if in arrears immediately upon such account becoming delinquent or as soon thereafter as practicable and such service will not be resumed or the water turned on to such premises until the amount of the delinquent account and the sum of twenty-five ($25.00) dollars for shutting off and twenty-five ($25.00) dollars for restoring service has been paid.

    c. When an owner or consumer vacates or sells his property leaving a delinquent bill against such property vacated or sold, the City may, at its option, refuse service on any other service the same owner or consumer may be using or intends to use in the future until the date the original account is paid, regardless of whether the other account or consumer is in good standing or not.

    d. Charge for broken locks shall be $25.00.

    e. After the water has initially been turned off by the City, if water is turned back on by the customer without sufficient payment and/or the City’s authorization, progressive turn off methods and devices up to and including a turn off at the main may be implemented. These attempts to turn off water will result in additional fees as follows.

    3. 4th or more – $250.00 for each occurrence

    My water was turned off because of a late payment. How do I get it turned on again?

    If your water service is terminated due to delinquent payment, the delinquent amount and any turn-off, and turn-on fees will have to be paid before water service is established again. Please call Customer Service at 305-948-2960 to request a turn-on. and to notify that your payment has been made.

    In order to provide same day turn-ons, your payment must be received by 3pm.

    Who do I call if I have a water leak?

    The City is not responsible for leaks that occur on private property. You will probably need to contact a plumber. If you are unsure if you have a leak, or need to report a leak outside your property, or inside the meter box, call Customer Service at 305-948-2960.

    What do I do if I have a sewer backup?

    During regular business hours, you can call the Wastewater Division Office (305) 624-1177. After-hours, you can call (305) 652-6460. Our staff will take your information and someone will be dispatched to your home or business to investigate the situation. If the problem is determined to be inside your plumbing system, you have the option to hire your own plumber to clear the line or utilize our crew for a nominal fee ($100 during business hours and $150 for after-hours, nights, weekends and holidays).

    On October 6, 2015, the Centers for Medicare Medicaid Services (CMS) and Office of the National Coordinator for Health Information Technology (ONC) released final rules that simplify requirements and add new flexibilities for providers to make electronic health information available when and where it matters most and for health care providers and consumers to be able to readily, safely, and securely exchange that information. The final rule for 2015 Edition Health IT Certification Criteria (2015 Edition) and final rule with comment period for the Medicare and Medicaid Electronic Health Records (EHRs) Incentive Programs will help continue to move the health care industry away from a paper-based system, where a doctor’s handwriting needed to be interpreted and patient files could be misplaced.

    To help eligible professionals, eligible hospitals, and critical access hospitals (CAHs) successfully participate in the Medicare and Medicaid Electronic Health Record (EHR) Incentive Programs in 2015, CMS has posted new resources on the CMS EHR Incentive Programs website .

    How to successfully recover data from a failed RAID

    Recovering data from a failed RAID can easily turn into a costly ordeal. Please read this page carefully before proceeding. If you would like to get help from experts, please consider using our fee-based RAID recovery service.

    First determine whether the RAID is hardware-based or software-based. The recovery procedures are very different.

    Recovering a hardware RAID

    First determine if the problem is caused by the underlying RAID mechanism. If it is not, follow the simpler recovery procedures for an ordinary drive. The following causes of problem are not related to the RAID:

    • Virus attacks.
    • The volume being deleted, resized, reformatted or otherwise changed in Disk Manager or other disk management utilities.

    Hospice Africa is a Merseyside based UK registered charity (no. 1024903) which promotes palliative care (i.e. pain control) for patients in Africa suffering from cancer.

    Hospice Africa provides funding for patient care and training medical staff at Hospice Africa Uganda (in Kampala, Mbarara and Hoima) and clinics in Malawi, Cameroon, Nigeria and Ethiopia. Since 1993 we have treated over 28,125 cancer patients in Uganda, trained 10,053 nurses, doctors and medical students in the use of oral morphine for pain control and prepared 873 community volunteers to help patients and their families. We have sent £3.8 million to Africa to pay for this. In the year to 31 March 2016 our income was £299,034, and we sent £307,785 to Africa. Our expenses (publicity, fund raising, accounting and AGM costs) were £3,082, about 1% of our income. We do not employ anyone in the UK.

    Dear Imli, sorry to know what you are going through. As I understand, that is the way this disease progresses. The patient switches to coma later and then passes away in sleep. When death is close, breathing pattern changes and the color of urine goes darker due to lack of sufficient oxygen in the body. Death is usually painless.

    My mother is in the end stages of GBM. She is currently completely bedridden, cannot talk or comprehend and sleeps all the time. When she does open her eyes, her gaze is unfocussed and glazed. Her vitals are strong, and she is being fed via a tube. Has a catheter- Urine and stools normal. I know this is progression of the disease, but I am still at a loss and its hard to see a loved one deteriorate. We were told that the symptoms in her case were due to edema and swelling post Gamma knife, may not be the tumor. This has been going on for 5 weeks now.How long can this go on? I know a lot of you have lost loved ones to the disease, and am hoping your collective response can give me a better picture on how much more time she has. She is diisplaying symptoms ( of the timeline chart on brain hospice) of 1-2 weeks for over 1 month now.

    An update on the situation and a little confused. Mom had been sleeping and opening her eyes for a few minutes at most, occasionally-when she was physically moved. This has been the situation for approx 6 weeks. No response to any other stimuli, no recognition or cognition. Last week she had low grade temperature for a few days and still feels warm occasionaly. Since the last 3 days however, her eyes are open and gazing at the ceiling for hours. Her breathing sounds like she is snoring lightly.Her last MRI was in Nov ’09 which showed lots of Edema, post Cyber knife ( Aug 2009). CT in Dec ’09-showed heavy midline shift, when she became paralysed. bedridden and non-cognizant after which she was given steroids that only marginally helped her.
    I’m not sure what to make of this, in that she has gone from sleeping continuosly, to opening her eyes and gazing for hours. Is this a sign of improvement? Should I push for another MRI?

    Hi Imli. I don’t know what it means that your mother now has her eye open for a long time but still not responding to others. Does she track? That is, if you put your finger in front of her eyes and move it, do her eyes follow your finger? If not, she is probably not really seeing anything just sleeping with her eyes opened. She needs to blink her eyes or they will dry. In hospitals, some times they go so far as to tap eyes closed when someone sleeps with their eyes open so that they do not dry.

    In terms of getting an MRI. for sure you need to make her doctor aware of this change and let him/her advise you on what needs to be done.

    Sorry imli, as far as my experience with this disease goes, it appears that the disease is spreading within the brain and is taking away your mom slowly. I am not sure if scans can reveal anything since growth and spreading could be at microscopic level. A doctor would be able to advise you better. Sorry again, it is painful to observe the patient at this stage.

    Over 3.2 million adults living in nursing homes and other long term care facilities in the U.S. As many as 40 percent of all adults will enter a nursing home at some point during their lives and as the U.S. population ages, the number of nursing home residents is expected to grow. Many of these elders are well-cared for but many may be the victims of abuse.

    Elder abuse, particularly when it involves a patient in a residential care facility, can be difficult to detect and for every reported case of abuse, more than five cases may go unreported.

    Nursing home abuse is a serious concern and seniors who have been abused have a 300 percent greater chance of death in the 3 years following the abuse than those who aren’t abused. Up to 1 in 6 nursing home residents may be the victim of abuse or neglect every year.

    Though many residents are well-cared for, abuse continues to be more prevalent than most people wish to believe and over three-fourths of the cases of nursing home abuse are perpetrated by caregivers.

    A congressional report showed that an examination of nursing home records conducted over a two-year period showed that nearly 1 in 3 nursing homes were cited for violations that had the potential to cause harm and almost 10 percent of all nursing homes have violations that caused actual harm, serious injury or placed them in jeopardy of death.

    A survey of nursing home residents showed that up to 44 percent of nursing home residents reported that they had been abused at some time in residency and nearly all of those surveyed (95%) had seen another resident neglected.

    A study conducted by the U.S. General Accountability Office revealed that state regulators are likely to miss signs of abuse. The GAO found that 70 percent of state surveys missed significant deficiencies and 15 percent missed notice of actual harm or immediate jeopardy of a nursing home resident.

    Due to reports like these, legislatures in all 50 states have passed anti-elder-abuse laws but nursing home abuse continues to occur.

    Nursing home abuse can involve:

    Physical Abuse is a condition or event that causes physical harm. Physical abuse may be intentional such as hitting or pinching or it may be due to neglect including overuse of restraints and lack of physical care.

    Sexual Abuse is unwanted sexual attention or exploitation. This includes sexual attention given to a patient who is unable to express his or her wishes or is cognitively compromised such as the patient with dementia.

    Psychological Abuse is not easily identified but can include yelling, criticizing, humiliating or otherwise shaming the patient. Patients who are experiencing psychological abuse may exhibit behavioral changes.

    Financial Exploitation occurs a caregiver takes advantage of access to a patients financial matters, steals or otherwise compromises the patient’s financial status. This could include direct theft, theft from banking accounts or applying for credit in the patient’s name.

    Neglect is often unintentional and a result of inadequate staffing. Neglect occurs when a patient’s needs are not taken care of such as personal hygiene care or when the patient is not provided food, clothing or water. Neglect can contribute to a number of medical conditions such as bed sores, skin infections, malnutrition and dehydration.

    Resident to Resident Abuse occurs when one resident is allowed to abuse another. Resident to resident abuse may be physical, sexual or psychological. Nursing home patients should be protected from other residents.

    Signs of nursing home abuse may include:

    • Broken bones or fractures
    • Bruising, cuts or welts
    • Bed sores
    • Frequent infections
    • Signs of Dehydration
    • Mood swings and emotional outbursts
    • Reclusiveness or refusal to speak
    • Refusal to eat or take medications
    • Unexplained weight loss
    • Poor physical appearance or lack of cleanliness
    • Changes in mental status
    • Caregivers that do not want patient to be left alone with others

    Not all patients with these symptoms have been subject to nursing home abuse but any sign should be cause for further investigation.

    Getting your HVAC certification online is a quick and easy for you to further your career – or even venture into a new one. While education in the field isn’t required for some jobs, becoming HVAC certified means you’ll make more money and have more credibility in your job. Whether you choose to become an HVAC technician or plan to specialize in the field as a duct system installer or refrigeration specialist, getting your certification will benefit you. According to the Environmental Protection Agency, there is a steady job outlook for people that are considering getting an online certification for HVAC. However, before you get started it’s imperative to check your state’s regulations and requirements for certification.

    How Long Will Your Certification Take?

    Online HVAC courses can take anywhere from 6months to 2 years, depending on your course load and whether or not you intend on taking classes to get your associates degree or you simply want to take the certification program. Two-year programs are more in-depth than a 6 month certification course and benefit you if you intend to specialize in one area.

    How Much Do Classes Cost?

    As of December, 2010, course costs range anywhere between $700 and $3500. This also depends on the type of course you’re taking. Cheaper courses are designed to cover the basics of the industry, while more expensive courses are longer and discuss different areas in-depth. Keep in mind that less expensive courses often don’t cover the Environmental Protection Agency (EPA) certification portion that is on the HVAC certification state exams. Also, the EPA regulates those working in refrigeration or air conditioning on a national level, so if you plan to go into these areas of the field and choose to take a basic course, you’ll need to take the EPA certification courses once you’re finished with the basic HVAC certification courses.

    If you attend an accredited online university, then you can apply for federal funding. Accredited universities offer all of the same funding programs that are available to those attending class in a traditional college atmosphere. As long as you can prove that you have a financial need, a Federal Pell Grant will be available to assist you in paying for the course.

    Online HVAC Courses Benefits and Structure

    Like with other degrees an online learning atmosphere appeals to those with hectic schedules or those who simply prefer not to attend classes. The online HVAC courses cover the same information as regular classes; however it’s up to you to discipline yourself enough to get the required work done on time. You work at your own pace, as long as you get your work completed and turned in within the allotted time.

    Online HVAC typically have various sections and you have a set amount of time to complete each section of the course. The courses run in six-month increments, rather than the standard “semester” time period other degree programs adhere to. So, if you have four classes in one term, you would have six months (or 120 days) to complete all the work required for those four classes. You can opt to take as many or as few classes as you want during each six month period. However, if you take less than 12 credit hours it affects your financial aid, and you may not finish the program in the time frame the online school suggests. Regardless of how long it takes, when you’re finished with the classes you are ready to take your state exam.

    Disable the Internal Microphone on your Mac

    All Macs have a microphone included in them, but if you want to disable the internal microphone on your Mac, you can do so through a variety of methods. We ll cover the two easiest approaches to turning off the microphone; reducing the input volume so that no sound is picked up by the microphone, and also by selecting a different and nonexistent audio input source so that the Mac will not detect audio whatsoever. Both methods effectively disable the microphone on a Mac

    Note these work to disable the Macs internal built-in microphone in all versions of Mac OS X and with just about every Mac. To disable an external microphone, simply unplug it from the Mac.

    How to Disable the Internal Microphone on Mac by Reducing the Input Volume to 0

    1. Launch System Preferences from the  Apple menu in the upper left corner
    2. Click on Sound preference panel
    3. Click on the Input tab
    4. Drag the Input volume slider all the way to the left, as seen in the included screenshot you can test the microphone has been disabled by talking and you ll notice the mic indicator no longer moves
    5. Close System Preferences as usual

    This method works to turn off the microphone by reducing the audio input to zero, effectively making the internal microphone unable to capture any sound.

    This control panel for the Microphone looks a little different depending on the version of Mac OS X used on the Mac, but it always allows users to change the microphone input level to zero thereby disabling the ability to pick up sound.

    If you want to basically disable the internal microphone s ability to hear audio entirely, use the below method instead.

    How to Disable the Internal Microphone on Mac by Selecting a Different Audio Input

    On older versions of Mac OS X you can also just select a different audio input like line-in, even if another mic is not connected to the Mac. This is not an option in newer versions, however, newer Macs can always just plug in a different line-in source and then select that and reduce the volume as described above.

    • Launch the System Preferences
    • Click on Sound
    • Click on the Input tab
    • Select Line-in
    • Close System Preferences

    This works by changing the audio input to the line-in, also known as the audio input port on your Mac. As long as you don t actually have any audio input device connected, such as an external microphone or some other line-in device, this method is very effective.

    Similarly, users can choose to disable the Mac camera or you can simply put tape over the camera and the microphone as well, with the latter serving a dual purpose of preventing camera visuals and also muffling sound input from laptop microphones.

They use sign language and they are required to videorecord themselves, where the sound is not vital to language development. Therefore, imagine when there are sounds associated with the sign language and some of them like to turn on the microphone to annoy and they don t know any better.

    How to disabled the mic on a mac. Your internal mic is on by default also the built in speakers. goto system tag the speaker cymbal, goto input and tag line in then tag line in. If you have a built in camera and mic at the top center tap on the left of the camera where the mic is and you shouldn t see any bars indicating sound is present. If this is true now you know how to disable the mic so that it will not be heard while recording. Caution. You must check all preferences in all other programs and make sure your device is tagged and that you have APPLIED it before closing. You then may need to close the program and then go back in to see that out the changes are correct.sometimes restarting helps. Helpful hint always tap the mic on you monitor while record is enabled making sure the mic is not being record on your trac. hope this helps

    I have a good mic attached but sometimes the mac auto decides to switch back to the built-in. Hard to detect since you still have signals on your recording. Therefore I want to DISABLE the built-in, not just mute it, so that OSX can NEVER re-enable it. How do you do that?

    Vitas Innovative Hospice Care Opens at Silver Cross Campus

    Vitas Innovative Hospice Care. an end-of-life care provider, has opened an office in New Lenox.

    A provider for adults and pediatric patients with life-limiting illness, Vitas Innovative Hospice Care is planning an open house from 4:30-7 p.m. Sept. 26 at its newest location, Silver Cross Hospital Campus. 1890 Silver Cross Boulevard.

    The meet and greet is planned for the Silver Cross Hospital Pavilion A in the Conference Room on the lower level. Attendees are asked to call 815-729-9352 to RSVP by Sept. 25.

    Spokesperson Michelle Bacon said VITAS Innovative Hospice Care provides end-of-life care for adult and pediatric patients with life-limiting illnesses. We work with patients and families to provide comfort and preserve dignity in the face of terminal illness, according to the website.

    About 90 percent of all hospice care takes place in the home, she said. Vitas assists families with that undertaking.

    While business hours in New Lenox are from 8 a.m.-5 p.m. Monday-Friday, Vitas is available 24 hours a day. Clients need only call 815-729-9352 for immediate assistance.

    2016 begins with a new drive to raise support for students at IHPCA (Institute for Hospice anad Palliative Care in Africa). Each year The Institute receives many applications from students who meet the entrance qualifications and who can be provisionally offered places. Most students cannot fund themselves and only a small proportion of students are funded by government health services. As a result many of the applicants struggle to find funding to support their proposed studies and a significant proportion fail. We are looking to raise funds for student bursaries for fees and for travel expenses (air fares and subsistence) especially for non-Ugandan students. Funding a student today is a key investment inspreading palliative care.

    More news of the Anne Merriman Hospice Africa Foundation

    As Hospice Africa has grown it has become evermore important to develop connections between its different parts. There are fund raising organisations in the USA, Ireland, UK, and France; not to mention Hospice Africa Uganda and the Institute for Hospice and Palliative Care in Africa, which provide the services. To bring this diaspora together; and to coordinate its work whilst preserving the Hospice Africa ethos “The Anne Merriman Hospice Africa Foundation” will be launched on the Founders birthday in 2016. We will keep you posted on how this event will be celebrated. We plan to use the white “peace poppy” as our emblem and hope that you like the idea.

    Hospice Africa Uganda faces a major challenge!

    In September this year HAU’s longstanding collaboration with USAID came to its scheduled end. USAID has been a major donor for the work of HAU and the end of their support has been a severe challenge. HAU is working to find alternative donors to keep the work going and of course we will help. Inevitably, there have been some cutbacks in Uganda but we are all trying to keep patient services protected as far as possible. In the UK we are trying to increase our fund raising so that we can help support HAU whilst continuing to fund work in other African countries.

Today Uganda has risen to 35th in this world ranking. “Targeted education programmes for palliative care specialists have produced an informed medical culture in Uganda. Problems remain particularly regarding the availability of professionals and inadequate public financing” says the report, but even so Uganda is rated highly amongst all the low income countries and is higher than some East European countries.     And a New York mother watches in horror as her dying boy suffers seizures. The young, inexperienced hospice nurse witnessing her first death doesn’t give the boy a drug to stop the convulsions. The mother is told later that the understaffed hospice took her son’s case for the “memorials” the charitable cash donations that often follow a death.

    Hospice care traditionally has been viewed as a charitable service offered by professionals whose aim is to ease the suffering of the dying. And while that’s still true to a point, big changes in health care have had an impact, and hospice care has become big business.

    As a result, hospice care, like the rest of health care, has become prone to mistakes, as the needs of patients are balanced against the financial bottom line.

    “Hospice used to be a volunteer service that was done out of great dedication and love,” says Ron Panzer of the Michigan-based Hospice Patients Alliance. “Medical ethics has turned a corner so we’re not trying to do everything for the patient, but we’re trying to save money.”

    It’s easy to abuse the system. The patient always dies, and no one can complain that a hospice program should have saved the life. But some families are beginning to come forward and charge that care was negligent, that pain was not eased, that suffering if not inflicted was at least allowed to continue needlessly.

    The families want more oversight of the nation’s hospice programs. And they are not alone. The Institute of Medicine (IOM) is urging the medical community to take a closer look. A report from the prestigious arm of the National Academies, which gathers independent scientists to advise federal policy-makers on matters of science, called in June for sweeping efforts to improve end-of-life care for those “who are dying nameless and faceless without a priority.”

    Among the recommendations: studies to show exactly how hospice care is being delivered in the USA.

    “We are in the throes of social change, and we don’t have much measurement,” says Joanne Lynn, who was on the panel and also serves as director of the RAND Center to Improve Care of the Dying, based in Arlington, Va. “We should do a random sampling of hospice care and learn what we are doing.”

    The business of dying

    For a hospice, death means money.

    Most people think of hospice care the way it began in the late 1960s and early 1970s, as a charitable service.

    But a major shift came in the 1980s when Medicare started paying for such care. The number of for-profit hospices soared, and by 1998, hospice care had become the fastest-growing benefit in the Medicare program.

    From 1992 to 1998, the number of Medicare beneficiaries who used hospice care more than doubled, from 143,000 in 1992 to 360,000 in 1998, according to a General Accounting Office analysis. As the federal tax dollars flooded into what had been largely a volunteer segment of health care, fraud sometimes followed.

    The government focused on hospice fraud as part of its Operation Restore Trust, a Clinton administration program aimed at stopping Medicare fraud.

    The stakes were raised. Suddenly, any hospice that took Medicare money, non-profit or for-profit, faced audits.

    “The regulations pile as high as our heads,” says Esther Goodrich, CEO of Genesee County Hospice of Batavia, N.Y. a non-profit hospice that is facing a lawsuit from family members angry over the care given to their dying son. “If you fill out a form incorrectly, and if you do it intentionally, you can end up in jail. Hospices have been taking a beating.”

    Length of hospice care declining

    A major challenge in hospice care is helping people cross the rugged terrain that lies between hope for a medical miracle and the acceptance of death. Crossing that mountain of denial takes time. But time with the dying and their families is something that hospice lacks these days.

    One of the areas under constant federal scrutiny is the length of time that patients stay in a hospice before they die. Hospices must be able to prove to regulators that the end was near for each patient.

    When hospices began, workers often entered a home months before a death with plenty of time to help the family prepare emotionally for the death.

    But the average length of stay in a hospice fell from an average of 90 days in 1990 to 48 days in 1999, according to the IOM. Half of Medicare hospice users received care for 19 days or less, the General Ac-

    counting Office found in a review last year. A week or less was common.

    Today’s shorter hospice stays don’t give some families enough time to prepare for the death. And the tighter time frame costs a hospice money.

    Medicare pays a flat fee for hospice care about $100 a day. The first days and the final days require the most time from hospice workers. In the first days, a hospice must get up to speed with the patient, the family, the doctor and anyone else involved in the care. In the patient’s last days, hospice workers may be at the bedside 24 hours a day. In between are days when the hospice may only send a worker by the house to offer support and make small adjustments to care that is provided by the family.

    When it works, it’s medical magic. Experienced hospice nurses know how to ease a patient and a family toward death.

    “There are times when hospice is the best care you can get,” Lynn says. “Where else in the system can you call and a nurse will show up with your medical record?”

    But she says that trying to get a patient and a family ready for death fast is difficult and prone to error.

    “I call it brink-of-death care,” says Lynn, a former hospice medical director who is now president of Americans for Better Care of the Dying, a Washington-based patient advocacy group. “This is a very difficult time of life. People are terribly sick. There are nursing shortages and financial shortages. Everything is weighted in a system that has no give.”

    “These cases are just the tip of the iceberg in a big iceberg field,” says Panzer, the former Michigan hospice nurse who quit to become a patient advocate in 1997. His Web site, hospicepatients.org, has become an unofficial clearinghouse for hospice information. “The reality is that hospice is no different than any other part of health care; it’s just not being reported.”

    Goodrich says that mistakes sometimes are made. But she says that hospice care is an emotional, heavily regulated business. Sometimes hospices become the target of the intense anger that comes with a family’s grief, she says. She sees such complaints as part of a job that is fraught with emotional risks.

    “You are stepping into the middle of somebody’s anguish. You are dealing with grief in action,” Goodrich says. “What you don’t see is that grief is a process. One way that grief takes its toll is it finds a place for blame.” It is not uncommon, she says, for hospice workers to become the target of that intense emotion.

    “That’s OK,” Goodrich says. “You have to look at that and say that is a need. They need to be able to do this, and we need to be big enough to let that happen.”

    More attention on end-of-life care

    The National Hospice and Palliative Care Organization, a Virginia-based non-profit group that represents hospice programs, has begun a two-year study aimed at measuring pain control and respiratory care and assessing whether the 1,800 patients in the study died with dignity and without unnecessary pain.

    The $750,000 study of 15 hospices, funded by the Robert Wood Johnson Foundation, is just one of several underway. The IOM wants much more.

    In its June report, “Improving Palliative Care for Cancer,” the IOM called for more of the nation’s annual $3.3 billion war on cancer to go to research on improving end-of-life care.

    With 550,000 cancer deaths each year and about one in four of all deaths occurring while in hospice care, improving the quality of palliative care is a huge issue.

    “Not a lot of research has been done,” says Stephen Conner, who is heading the national hospice study. “We have neglected the whole field of palliative care in favor of delivering new cures for disease and high-tech treatments.”
