Department of Transport Vehicle Codes

Code 1 – New

New vehicles delivered by a dealer to the first owner.

Code 2 – Second-Hand

Used vehicles with one or more previous owners.

Code 3 – Repairable

Code 3 vehicles are Code 1 or Code 2 vehicles that have been involved in an accident. Code 3 vehicles have to go through roadworthy to be licensed for road use.

Is it worth it to buy a Code 3 vehicle?
‘Yes’, if the price is very low, and ‘No’ in that the cost of repairs plus the cost of the damaged car might be more than buying an equivalently aged, legal and on-the-road version of the same vehicle.

Code 4 – Permanently Demolished

A vehicle falls into this category when the chassis of the motor has been either compacted, compressed, melted, destroyed or damaged to such degree that it cannot be made roadworthy.

If the damage has been restored or repaired a previously ‘unfit’ car completes a roadworthiness examination, it is then legally allowed to be driven again. Contrary to popular belief, it IS possible to insure a Code 3, but not for more than 60 or 70 percent of normal market value.

Physicians at Icon Medical’s Car Accident Clinic in Miami will decide which of our treatments will be the most beneficial to you.

There are two factors that our physicians use to determine which of the aforementioned treatments you receive:

1. The amount of pain you are experiencing.

2. How long the physician thinks your pain will last.

Transcutaneous Electrical Nerve Stimulation

Many times this device is referred to as a TENS unit. It delivers minute electrical pulses to your back. These pulses encourage your body to produce endorphins, thus preventing pain signals from reaching your brain. These pulses are delivered via small electrodes with adhesive on the back of them that are placed on your skin.

Manual Therapy

Our physicians utilize numerous kinds of manual therapy at Icon Medical’s Car Accident Clinic in Miami. These therapies include massage, manipulation and mobilization. The professionals at our Car Accident Clinic in Miami have the knowledge and skills necessary to perform each of these manual therapies.

Therapeutic Ultrasound

Therapeutic ultrasounds are not the same as the diagnostic ultrasound that hospitals use. This therapeutic device delivers heat deep into your tissues, which in turn increases blood flow to that area. The increased blood flow encourages tissue repair and accelerates your body’s healing processes.

Motrin/ibuprofen is often effective in relieving pain. However, some patients will experience muscle spasms following their Miami car accident. When the muscles begin to spasm, pain will follow. Because of this, some patients may require a muscle relaxer to reduce their pain level. Our physicians at Icon Medical’s Car Accident Clinic in Miami can assist you in obtaining the medications necessary to decrease your pain.

Lumbar Supports

Once you injure your low back, lumbar support is crucial. It helps relieve your back pain while offering your back the support it needs. At Icon Medical’s Car Accident Clinic in Miami, our physicians will be able to help you obtain the proper back support for your particular condition. Some of the supports frequently recommended by our physicians include braces, pillows and cushions.

Understanding the Treatments Offered at Icon Medical’s Car Accident Clinic in Miami

Regardless as to whether you are suffering with short-term or long-term back pain, you will receive heat and ice therapy at our car accident clinic in Miami. Physicians request the therapists to perform ice therapy treatments to reduce inflammation. The reduction in inflammation usually helps decrease the amount of pain a patient experiences.

Physicians request for therapists to perform heat therapy to help your tissues and muscles relax. Heat therapy also brings blood to the targeted area. The therapists at Icon Medical’s Car Accident Clinic in Miami have experience with using heat and ice to reduce your pain.

You might even need to pay someone to help around the house while you re recovering.

The Accident Protector policy is available for individuals or families.

This is an accident only policy and does not provide benefits for loss due to sickness.

Common Construction Injury Types #construction #accident #lawyer, #construction #injuries

Common Construction Injury Types

The construction injury carries significant risks of injury to construction workers. According to the CDC, of the 3.3 million nonfatal injuries and illnesses reported in 2009, more than 9% were experienced by construction workers. Construction workers experienced 4.3 nonfatal injuries and illnesses per 100 full time workers. Falls accounted for 22% of these injuries and illnesses construction workers reported.

Causes of Construction Injuries and Some Legal Remedies

The causes of construction injuries are numerous and varied. While some of these causes are easy to spot, others are less obvious. Familiarizing yourself with common injury types will help you avoid injury and identify any injuries you may have already suffered. Below, you’ll find explanations of some of the most common construction injury types.

One of the most common types of construction injuries are falls. Construction workers are at risk from falls from scaffolding, cranes, roofs, ladders, and other heights at work. If you’re injured in a fall, you may want to file a Workers’ Compensation Claim and possibly a personal injury lawsuit against your employer or another party.

Construction workers are at risk of being struck by objects from above, for example, tools used above the worker or construction materials that aren’t properly secured. Brain and spinal injuries can occur, even if you’re wearing appropriate safety equipment such as hardhats.

Equipment Related Accidents

Heavy machine equipment used on construction sites can fail or be dangerous. For example, a forklift could fail to work properly, a dumpster could fall over unexpectedly, or a nail gun could misfire. If equipment is unsafe or dangerous and that caused your injuries, you may wish to discuss with your attorney a legal theory called product liability . That’s the law about who’s responsible for defective or dangerous products.

Backovers and Crushed –Betweens

Workers are at risk of being run over by large trucks backing out of construction sites. They are also sometimes crushed between large vehicles and walls or concrete. These types of accidents can be related to supervisor neglect in controlling a work site.

Fires and Explosions

Construction sites often contain hazardous conditions such as exposed wiring, leaking pipes, and flammable chemicals that could lead to fires and explosions. Less common than some other types of accidents, these can, however, be fatal or result in serious injuries.

Trench or Building Collapses

Another common type of construction injury is when a trench that’s being built collapses on the workers inside. A building that’s being demolished or that’s under construction can suddenly or unexpectedly collapse, killing or seriously injuring those inside. Even if the cause of the accident can’t be directly determined, a negligence legal theory of res ipsa loquitur may apply and you can still be compensated without proving who was negligent or in what way.

Repetitive Motion Injuries, Heat Stroke, and Other Overexertion

Due to the hard physical labor required for construction work, employees in this industry often have injuries related to overexertion, including:

  • Repetitive motion injuries
  • Muscle and joint damage due to overuse
  • Heat stress in hot conditions that can lead to brain, heart, or kidney damage or death
  • Hypothermia or frostbite resulting in the loss of fingers, toes, and parts of the face in cold climates

High Lead Levels

Unsafe construction sites and work practices can lead to work exposures to lead. Construction workers represented 16% of elevated blood lead concentration cases in 2002-2008.

From 1990 to 1999, more than 1,000 construction worker died from pneumoconiosis. Pneumoconiosis is legally defined as a chronic dust disease of the lung arising out employment, usually in coalmines. The most common pneumoconiosis conditions that have led to death in construction workers are Asbestosis. Coal Workers’ Black Lung. and Silicosis. If you’re suffering from one of these respiratory conditions, you may have a product liability claim against your employers or the manufacturers or suppliers of asbestos, silica, or other product that harmed you.

Types of Medical Conditions Caused by Construction Injuries

The construction injuries described above can lead to medical conditions including:

  • Amputation of a finger, toe, or limb
  • Broken bones or fractures
  • Burns for fires, explosions, or electrocutions
  • Cuts or lacerations from exposed nails, tools, machinery, etc.
  • Death, in which case the construction worker’s family should consider a wrongful death claim to be compensated the loss of their loved one
  • Eye injuries or loss of vision from being impaled by objects, such as shrapnel from grinding metal, can also lead to loss of vision, or dangerous chemicals or gases
  • Shoulder, knee, or ankle injures such as sprains or overuse damage
  • Loss of hearing from the loud noises on construction sites or failure to wear hearing protection while using machinery like a jack hammer
  • Paralysis and other spinal cord injuries, especially from falls
  • Post-Traumatic Stress Disorder (PTSD) from the experience of a traumatic accident, such as when fellow workers are also injured or killed
  • Toxic exposure to chemicals, such as from welding jobs
  • Head or traumatic brain injuries (TBI) often from falls or having objects dropped on a construction worker on the job site

Get an Initial Review of Your Claim at No Charge

If you’ve been injured at your construction site, it’s in your best interests to consult with a construction accident attorney to protect your legal right to compensation. Typically, your employer’s workers’ compensation plan will cover your injuries and the time away from work, but every case is unique and you may need additional legal firepower. If in doubt, have an attorney provide an initial review of your claim today at no charge.

Consequences of a Hit and Run Accident #accident #attorney #albuquerque

Consequences of a Hit and Run Accident

Getting into a vehicle accident can spur some pretty basic human instincts: If we feel we ve done something wrong, our first impulse could be to flee the scene. But it should come as no surprise that fleeing the scene of a car accident can result in very serious ramifications down the road. We’ll look at those consequences in this article.

What is Hit and Run?

Generally speaking, a hit and run is defined as being involved in a car accident (either with a pedestrian, another car, or a fixed object) and then leaving the scene without stopping to identify yourself or render aid to anyone who might need assistance. At least a few states also include in the definition of hit and run any collision with an animal.

In most states it doesn t matter whether you caused the accident or not. The act is committed simply by leaving the scene. If you must leave the scene of an accident to access emergency assistance — by going to a nearby hilltop to get a cell phone signal, for example — most states do not consider that to be a hit and run, as long as you return immediately to the accident scene.

Most states do not require that the hit and run occur on a highway or public road. Many states extend hit and run laws to cover parking lot collisions. For example, if you back into an unoccupied car in a parking lot and fail to leave a note with your contact information on the windshield, the laws of many states treat this as a hit and run.

Criminal Penalties for Leaving the Scene of a Car Accident

The criminal penalties imposed for a hit and run vary from state to state. Many states classify the criminal penalties for a hit and run as either felonies or misdemeanors, depending on the circumstances. Felony hit and run is defined by most states as leaving the scene of an accident where there is any type of injury to a person, whether the injured person is a pedestrian or an occupant of a vehicle.

The penalties for felony hit and run can be quite severe. Most states impose fines of between $5,000 and $20,000. And there is very real potential for incarceration as punishment for a felony hit and run. Depending on the nature of the accident and the injuries that resulted, in some states a felony hit and run is punishable by up to 15 years in prison.

Remember, a hit and run might be classified as a misdemeanor instead of a felony. While the term misdemeanor sounds relatively minor to some people, in most states misdemeanors are punishable by a significant fine of up to $5,000 and also by up to one year in jail.

Administrative Penalties for Leaving the Scene of a Car Accident

In addition to the criminal penalties for hit and run, almost every state imposes administrative penalties related to your driver s license. These penalties are often imposed through the individual state s Department of Motor Vehicles.

Any conviction for hit and run, regardless of whether it s for a felony or misdemeanor, typically results in an automatic suspension or revocation of your driver s license for a period of six months or so. In some states the revocation can be as long as three years. Depending on the state in which you live, and the nature and circumstances of the car accident in which you were involved, the penalty for hit and run may include a lifetime revocation of your driver s license. These administrative penalties are in addition to any criminal punishment that might be imposed for hit and run.

Civil Penalties for Hit and Run

If you have caused the accident, it is possible that another person involved in the crash may sue you in court for the damages they suffered. Such a lawsuit may ask for monetary compensation for medical bills, lost wages, and property damage.

Of course, this kind of lawsuit is likely to happen anyway even if you did not commit a hit and run at the scene of the accident, if you are deemed at fault for the car accident. But if you are liable for hit and run on top of having caused the accident, the damages that a court orders you to pay will almost surely be increased. Many states will impose treble damages on you. What this means is that any damages awarded to the plaintiff are automatically tripled, mainly to punish the defendant’s bad behavior.

For example, if the jury in a civil suit awards the plaintiff $10,000 in damages, the judge will automatically triple that amount to $30,000 because the hit and run amounts to particularly reckless and egregious conduct. In most instances, treble damages of that nature are not covered by your car insurance policy. In other words, you will have to pay that amount out of your own pocket.

Your Insurance Company

In addition to the other penalties we’ve already touched on, many insurance companies have a practice of cancelling your automobile insurance policy if you are guilty of a hit and run. Learn more about the role of car insurance in a car accident case .

Car Crash Phone Scam Circulating Colorado Springs #car #accident #scams, #car #crash

Car Crash Phone Scam Circulating Colorado Springs

A telephone scam is circulating our area. It’s dramatic and personal. It is about family, and any of us could easily be a target.

11 News is talking to a man who almost fell victim.

Deon got an alarming phone call from a number he didn’t recognize. The caller said there was a bad accident involving a truck, an SUV and a car that happened in downtown Colorado Springs.

“As soon as he said downtown, my heart jumped and I was very upset,” Deon said.

Deon’s wife drives a 4-door car and was supposed to be headed downtown to a hair appointment. But then there was an interesting twist. The caller’s brother was also in the crash. The caller said his brother is a fugitive and was holding Deon’s wife hostage.

“He stated if I got some money to his brother, he could get out of town and he could get my wife.”

When Deon pressed the caller for answers, it just didn’t add up.

“He couldn’t tell me the color of the vehicles, he couldn’t tell me the name of my wife or anything like that.”

Deon hung up and called police. He’s hoping others will learn from this and not fall victim.

This scam has been circulating in the Pikes Peak region for the past few weeks. The El Paso County Sheriff’s Office issued a warning about this same scam earlier in February .

Colorado Springs police say they have briefed all their officers on this scam. The criminals might know a few simple facts about you, such as your marital status, or what part of town you live in. That’s stuff that is easy to find out, and it could draw you in to the story.

If you receive a call like this, call police. Officers can actually verify traffic crashes, even if they are in a different city.
