    Expunging or Sealing Adult Criminal Records in Colorado

    In Colorado, it is not usually possible to expunge or “seal” a conviction from your criminal record, even if you have completed probation. There are, however, exceptions for some offenses involving controlled substances. (Colorado Statutes 24-72-308.5 and -308.6)

    If you were arrested but released without being charged with a crime, or were arrested and charged with a crime but not convicted, you can probably have your records sealed. After sealing, it is as though the arrest or charge never occurred, and you don t have to disclose the information if you are asked about it. (Colorado Statutes 24-72-308.)

    Here is a summary of Colorado s laws governing expungement of adult criminal records.

    Expungement of Criminal Records if You Were Not Convicted

    You may petition to have your criminal record sealed if:

    • you were arrested but not charged with a crime
    • the case against you was dismissed, or
    • you were found not guilty of the charges brought against you.

    There are some exceptions to this rule. If you were not charged because of a plea agreement in another case, or if your case was dismissed because of a plea agreement in another case, your record cannot be sealed. In addition, your record won’t be sealed if you have failed to meet all the conditions of your sentence.

    In addition, sealing is not possible for records concerning:

    • Class 1 or 2 misdemeanor traffic offenses
    • Class A or B traffic infractions
    • convictions for driving under the influence
    • convictions for offenses based on unlawful sexual behavior, or
    • convictions involving the holder of a commercial driver s license or the operator of a commercial motor vehicle.

    (Colorado Revised Statutes 24-72-308.)

    Expungement of Offenses Involving Controlled Substances (on or after July 1, 2008 and before July 1, 2011)

    If you were convicted of an offense involving a controlled substance and you have satisfied all the conditions of your sentence, you may petition to have your records sealed if:

    • it has been at least ten years since the end of all criminal proceedings against you or your release from supervision concerning a criminal conviction, and
    • you have not been charged with or convicted of a crime during that ten year period.

    There are some limitations on the types of controlled substance offenses that may be sealed under this law. Carefully read Colorado Statutes 24-72-308.5 or consult a criminal law attorney.

    Expungement of Offenses Involving Controlled Substances (on or after July 1, 2011)

    If you were convicted of an offense involving a controlled substance and you have satisfied all the conditions of your sentence, you may petition to have your records sealed if the offense is:

    • a petty offense or a Class 2 or 3 misdemeanor ; and it has been three years since the end of all criminal proceedings against you or your release from supervision concerning a criminal conviction
    • a Class 1 misdemeanor; and it has been five years since the end of all criminal proceedings against you or your release from supervision concerning a criminal conviction
    • a Class 5 or 6 felony drug possession offense; and it has been seven years since the end of all criminal proceedings against you or your release from supervision concerning a criminal conviction, or
    • another offense, and it has been ten years since the end of all criminal proceedings against you or your release from supervision concerning a criminal conviction.

    There are some limitations on the types of controlled substance offenses that may be sealed under this law. Carefully read Colorado Statutes 24-72-308.6 or consult a criminal law attorney.

    Expungement of DNA Evidence or Other Biological Substance Records

    If a law enforcement agency collected a biological sample from you while investigating a crime, you can petition to have that evidence expunged in some circumstances. Consider a petition for expungement if:

    • the charges against you were dismissed
    • you were acquitted of the crime, or
    • the charges resulted in a conviction other than a felony.

    This law does not apply if you were arrested, charged with, or convicted of a separate offense for which collection of a biological sample was permitted. (Colorado Revised Statutes 16-23-105.)

    PEX REPIPE SPECIALIST

    What is PEX?

    PEX is an acronym for crosslinked polyethylene. It is a flexible, durable, proven piping product that has been used in plumbing systems for more than 20 years. PEX tubing won’t pit, scale or corrode and, because of its flexibility, it also offers potential freeze-damage protection.

    Uponor Pex plumbing systems feature PEX-a tubing, which is considered the superior PEX tubing manufacturing method in the industry. PEX-a is the most flexible of all PEX types, and because of its shape and thermal memory, it can use ProPEX expansion fittings which are the only fitting system that actually gets stronger over time – making it highly leak resistant.

    1) Repiping in a home begins at the transition point.

    2) The transition point is the point where the potable water system enters the building from the exterior of the building.

    3) Repiping a potable water system means you totally abandon the existing potable system and replace it with a new system.

    4) The first step in repiping your home is masking or “covering” the floors, and this must be completed before the walls are masked off. This overlap “ enveloped ” system allows the plastic sheeting to be rolled up in one continuous motion.

    5) Cutting the sheetrock: You will be shocked at how little sheetrock has to be removed for the layout and installation of a new potable water system. A real Pex Plumber is an expert at HVAC, framing, plumbing, and electrical layout, and will lay out the home pex repipe in the most effective route. The better the repiper. the smaller and fewer the drywall holes!

    6) A “GREEN REPIPE” potable water system refers to a Pex repipe potable system only – such as UPONOR or ZURN with corrosion resistant fittings. CPVC and copper systems are not green systems.

    7) The drywall pieces that are removed must be used in the patching process as each texture is a little different in thickness. This gives you a uniform surface thickness as you start the repair process. Each piece goes back in the hole it came from.

    8) Repipe with an approved material. There are currently three main materials used in pex repiping jobs across the US: copper pipe and fittings, CPVC pipe and fittings, and PEX repipe and fittings. (DO NOT USE CPVC, IT IS THE NEXT POLYBUTYLENE)

    9) Repipe inspections must be performed by the local building inspectors after the repipe is completed, with the system under full water pressure.

    10) The signed inspection card must be given to the homeowner after the PEX repipe inspection is completed.

    11) Drywall repair begins after all the necessary backing has been installed. Backing supports the drywall pieces that were removed to access the potable water pipes and accommodate the repiping of a new Pex repipe or copper potable water system.

    12) The fiberglass mesh tape must be used 100% of the time.

    13) The patches must be pre-filled with quick set patching compound. The compound comes in 18lb bags, and because it is a powder, it must be mixed with water. This locks the perimeter of each patch and will make the area of the patch stronger than it was before the work process began. The reason this is important is that when you close the doors in the house, the walls flex just a little bit, and if you do not perform this method of repair, the patch will fracture over time from the flex/vibration caused by shutting the doors.

    14) Do not coat the drywall patches with regular all-purpose joint compound on the repipe patches.This is a common practice and the patches will crack later 100% of the time, even if it’s years later.

    15) Coat all the repipe drywall patches with quick set patching compound only. USG will do and you can find it at any home and hardware store, or you will have fractures in the walls at the patch locations.

    16) Float all the walls with quick set patching compound and use a 12″ drywall knife and stagger each coat until the walls become smooth and flat. The next step is wet sanding the patches and this must be done if you want the patches to blend in perfectly after the texture is applied. The reason you’ve seen bad patches in the past is that repairmen do not know how to “kill the edges.” This is an old drywall term that means you must do the detail wet sanding work and there is no short cut.

    17) Texture to match the existing texture, and this is not as easy as you might think. This is a real art form for the few that know what they are doing. Also, if the texture is spray texture, you must sponge off the overspray for the texture to match. Nothing gives away the location of a patch more than overspray that is painted over and not “killing the edges.”

    18) Paint to match the existing paint. All repipe companies color match the same way. They run down to their local hardware store and have the computer color matching done by the man behind the counter. This is beginner color matching. The proper way to color match is hand color matching. First, match the paint sheen. Second, computer match for the base color. Third, tint for color adjustment. Fourth, match the color and sheen after the paint sample has dried. Repeat if necessary. Did you know that the paint color on the wall after it dries will be different than the paint color while it is wet and in the can?

    19) If you follow the basic repiping rules, after a very short time you will not be able to point out all the drywall patches from the repair. You will simply forget where the holes were due to the patches receiving the proper floating, texture and painting techniques. Your friends, neighbors, relatives, and even plumbing contractors will not be able to find the patches.

    20) This is a basic guideline for a home repipe. and if done, properly you will have a repipe that was done as well as a repipe can be done.

    5. Furnish your bar to suit the taste of the target market. According to the New York Times travel section, the hookah bars in Astoria cater primarily to Egyptians, while those in the East Village serve a more diverse clientele. Therefore, if you have chosen Astoria for your establishment, a more traditional style with rugs and classic furniture will work better.     The New York State Board of Law Examiners

    Operating under the auspices of the New York State Court of Appeals, the New York State Board of Law Examiners is responsible for administering the bar examination to candidates seeking admission to practice law in the State of New York.

    The Board has been in existence for over a hundred years, having been created by the New York State Legislature in 1894.
    Its five members are attorneys appointed by the Court of Appeals. The Board maintains a business office in Albany, New York with a full-time staff that oversees the bar examination.

    The bar examination is administered twice per year, on the last Tuesday and Wednesday of February and July. In 2015, the Board processed 16,273 applications for the bar examination and examined 14,668 applicants.

    (1) July 2017 BAR EXAM

    The application filing period to sit for the July 2017 bar examination is now closed.

    There is no provision for the late filing of an application.

    The period to register your laptop for the laptop program is now closed.

    There is no provision for late registration for the laptop program. If you did not completely register your laptop by the May 22 deadline, you will be required to handwrite the essay portion of the exam.


    (2) NEW YORK LAW EXAM

    Please note that the New York Course Materials (NYCM) were updated in April 2017. Applicants for the New York Law Exam (NYLE) should use this latest version in preparing for the NYLE.

    The next administration of the NYLE is on June 15, 2017. The deadline to complete the New York Law Course and register for the June 15, 2017 NYLE is May 16, 2017. Applicants who timely register with the Board to take the NYLE must also timely purchase, download and register the software with Examsoft. Examsoft will email applicants a few weeks before the date of the NYLE with all pertinent details and deadlines. The NYLE will also be held on September 14, 2017 and December 14, 2017.


    (3) APPLICATION UPON EXAMINATION BY TRANSFERRED UBE SCORE OPENS OCTOBER 1, 2016

    Effective October 1, 2016, an applicant who sat for the UBE in another jurisdiction may apply for admission based on the transfer to New York of a score earned on the UBE taken in another jurisdiction in lieu of taking the UBE in New York, subject to the application filing deadline of Court of Appeals Rule 520.12(d). A minimum UBE score of 266 is required. For more detailed information on the requirements click on the UBE/NYLC/NYLE FAQ s. Prospective applicants must create a BOLE Account and then click on UBE Score Transfer in the Applicant Portal to submit their application.

    (4) NEW YORK LAW COURSE, COURSE MATERIALS AND FACULTY LIST WITH BIOS, AND NYLE SAMPLE QUESTIONS ARE NOW AVAILABLE.

    As previously announced, in conjunction with the adoption of the Uniform Bar Examination (UBE), the State Board of Law Examiners was directed by the Court of Appeals to create an online course, known as the New York Law Course (NYLC), and an online, open book exam on New York specific law, known as the New York Law Exam (NYLE).

    The first administration of the NYLE was held on May 26, 2016.

    Applicants must complete the NYLC before they may register for the NYLE. The Board has prepared comprehensive Course Materials for the NYLC and NYLE. Please note that the New York Course Materials (NYCM) were updated in April 2017. Applicants for the New York Law Exam (NYLE) should use this latest version in preparing for the NYLE.

    (5) UNIFORM BAR EXAMINATION (UBE)
    UPDATED MAY 5, 2015

    The New York Court of Appeals has adopted the recommendation of the Advisory Committee on the Uniform Bar Examination (UBE) that New York adopt the UBE effective July 2016. The Advisory Committee also recommended, and the Court of Appeals adopted, a requirement that applicants for admission in New York be required to complete an online course on New York law and take and pass an online examination on New York law, as a requirement for admission. The report of the Advisory Committee is available on its website at http://www.nycourts.gov/ip/bar-exam/ .

    The Court of Appeals amended sections 520.2, 520.7, 520.8 520.9 and 520.12 of its Rules to reflect the adoption of the UBE. The Court of Appeals also made a minor change to the Rules not related to the UBE. New language was added to section 520.16, pertaining to the 50-hour pro bono requirement for admission, to clarify the date after which eligible pro bono work must be performed.     (6) NEW SKILLS COMPETENCY REQUIREMENT
    POSTED December 30, 2015

    The Court of Appeals has added a new section 520.18 to the Rules for the Admission of Attorneys and Counselors at Law (22 NYCRR 520.18). This new provision requires applicants seeking admission in New York to establish that they have acquired skills and professional values necessary to competently practice law. Applicants may satisfy this requirement by completing one of five separate pathways described in section 520.18. For applicants who qualify for the bar examination based upon having attended an ABA-approved law school and having satisfied the requirements of section 520.3 or based upon their foreign legal education alone under section 520.6, this requirement will first apply to those who commence their legal studies after August 1, 2016. As to foreign-educated applicants who are required to complete an LL.M. program at an ABA-approved law school in order to sit for the bar examination under section 520.6, the new requirements will apply to those who commence their LL.M. program after August 1, 2018.     • February Exam –To meet the six month deadline for review of your documents, you must submit your Foreign Evaluation Form and supporting documentation no later than May 1st of the year preceding the exam you plan to sit.

    LLM applicants who fail to meet these deadlines run the risk that they may not receive a decision from the Board on their eligibility in time to take the exam, causing the application to be denied and the application fee to be forfeited.

    The Canadian Hospice Palliative Care Association (CHPCA) is calling on the federal government to take action on the recommendations made by The Honourable Sharon Carstairs, P.C. in her report, Raising the Bar: A Roadmap for the Future of Palliative Care in Canada, tabled today in the Senate of Canada

    “Despite some remarkable gains we have observed over the years, there is still much more to be done to ensure that every Canadian has access to quality hospice palliative and end-of-life care regardless of where they live,” stated Sharon Baxter, Executive Director, CHPCA. She continues, “Currently in Canada, at best there is still at least 70% of Canadians who do not have access to palliative care, and with an aging population, the health care system must be prepared to meet the increasing demand.”

    Canada’s population is aging and combined with increasing numbers of chronic diseases, the demands for hospice palliative care will continue to grow. Seniors make up the fastest-growing age group. In 2003, an estimated 4.6 million Canadians were 65 years of age or older, a number that is expected to double in the next 25 years. By 2041, about one in four Canadians is expected to be 65 or over.

    “The CHPCA strongly supports the vision and recommendations laid out in this report,” stated Wendy Wainwright, President, CHPCA. “All too often patients are not being referred to palliative care early enough to truly benefit from the available services. Hospice palliative care includes physical, psychological, social, spiritual and practical support to people with life-threatening illnesses, and to their families. It focuses on what people need and want at any given time, both prior to death and during bereavement.”

    According to a recent study of deaths in Western Canada, approximately 90% of deaths could benefit from palliative care. “These figures are eye opening and shine a light on the critical need to focus on the lack of access to palliative care in Canada and the importance of improving it,” continued Ms. Wainwright.

    The report offers a vision for palliative care in the future. One that is “intensely human and caring. It is not synonymous with death – it is about life, about the proper care of someone who is alive, someone who still has days, months, or years remaining to their life.” Realistic and attainable goals are described while the recommendations provide a roadmap to achieving these goals.

    To realize a society where all Canadians have access to quality palliative care services the reports states that Canada needs to:

    • develop a culture of care that overcomes the limitations imposed by a death-denying society;
    • undertake a serious capacity-building exercise, comprising the full spectrum, from significantly increased research activities and knowledge translation, to improved and consistent education and training, to modernizing our health human resources plans to meet emerging needs;
    • adapt systems and programs to facilitate support for caregivers;
    • integrate services so that patients and caregivers can transition from one care setting to another; and
    • improve leadership at the federal government level, provincial and territorial government level and community level.

    The report makes 17 recommendations addressed to the federal government, the provincial and territorial governments and to the community.     “Quality palliative care is the right of every Canadian, yet not every Canadian can access these services at a time when they and their families need it most,” explained Ms. Baxter. The CHPCA continues to be committed to working with the various stakeholders and striving to offer leadership in the pursuit of excellence in care for persons approaching death so that the burdens of suffering, loneliness and grief are lessened.

    A Vision for Palliative Care in Canada – It s Time to Raise the Bar

    The Canadian Hospice Palliative Care Association (CHPCA) is calling on the federal government to take action on the recommendations made by The Honourable Sharon Carstairs, P.C. in her report, Raising the Bar: A Roadmap for the Future of Palliative Care in Canada, tabled today in the Senate of Canada

    “Despite some remarkable gains we have observed over the years, there is still much more to be done to ensure that every Canadian has access to quality hospice palliative and end-of-life care regardless of where they live,” stated Sharon Baxter, Executive Director, CHPCA. She continues, “Currently in Canada, at best there is still at least 70% of Canadians who do not have access to palliative care, and with an aging population, the health care system must be prepared to meet the increasing demand.”

    Canada’s population is aging and combined with increasing numbers of chronic diseases, the demands for hospice palliative care will continue to grow. Seniors make up the fastest-growing age group. In 2003, an estimated 4.6 million Canadians were 65 years of age or older, a number that is expected to double in the next 25 years. By 2041, about one in four Canadians is expected to be 65 or over.

    “The CHPCA strongly supports the vision and recommendations laid out in this report,” stated Wendy Wainwright, President, CHPCA. “All too often patients are not being referred to palliative care early enough to truly benefit from the available services. Hospice palliative care includes physical, psychological, social, spiritual and practical support to people with life-threatening illnesses, and to their families. It focuses on what people need and want at any given time, both prior to death and during bereavement.”

    According to a recent study of deaths in Western Canada, approximately 90% of deaths could benefit from palliative care. “These figures are eye opening and shine a light on the critical need to focus on the lack of access to palliative care in Canada and the importance of improving it,” continued Ms. Wainwright.

    The report offers a vision for palliative care in the future. One that is “intensely human and caring. It is not synonymous with death – it is about life, about the proper care of someone who is alive, someone who still has days, months, or years remaining to their life.” Realistic and attainable goals are described while the recommendations provide a roadmap to achieving these goals.

    To realize a society where all Canadians have access to quality palliative care services the reports states that Canada needs to:

    • develop a culture of care that overcomes the limitations imposed by a death-denying society;
    • undertake a serious capacity-building exercise, comprising the full spectrum, from significantly increased research activities and knowledge translation, to improved and consistent education and training, to modernizing our health human resources plans to meet emerging needs;
    • adapt systems and programs to facilitate support for caregivers;
    • integrate services so that patients and caregivers can transition from one care setting to another; and
    • improve leadership at the federal government level, provincial and territorial government level and community level.

    The report makes 17 recommendations addressed to the federal government, the provincial and territorial governments and to the community.     “Quality palliative care is the right of every Canadian, yet not every Canadian can access these services at a time when they and their families need it most,” explained Ms. Baxter. The CHPCA looks forward to hearing the government’s response to this report, and anticipates that action will be taken on many of the recommendations. The CHPCA continues to be committed to working with the various stakeholders and striving to offer leadership in the pursuit of excellence in care for persons approaching death so that the burdens of suffering, loneliness and grief are lessened.

    The CHPCA congratulates Senator Carstairs on her 15 years of dedication to the palliative and end-of-life care in Canada. She has been a true leader and champion in the area of end-of-life care.

    The CHPCA is the national voice for hospice palliative care in Canada.
