When is A Vehicle Considered a Total Loss?

When and whether a vehicle involved in a collision is considered to be “totaled” for first-party insurance purposes is an issue of great angst and confusion for most consumers. We hear horror stories about older, functioning automobiles being “totaled” simply because the frame is bent or other seemingly minor and hidden damage occurs. Even insurance professionals can get turned around navigating the maze of rules and regulations regarding the act of “totaling” a vehicle under a policy. But it needn’t be all that complicated. This article will hopefully help take the guess-work out of when a car can be “totaled.”

Typically, cars are considered to be “totaled” when the cost to repair the vehicle is higher than the actual cash value (ACV) of the vehicle. Practically speaking, however, it is not always practical to repair a vehicle, even if the cost of repair is less than its ACV. A vehicle worth $4,000 requiring $3,000 in repairs might be considered “totaled” by an insurer even though the cost of repair is less than its value before the accident. Insurance companies will typically consider such a vehicle to be a total loss, even though the repairs are only 75 percent of ACV.

While the procedure varies slightly from state to state, the insurance company will typically take ownership of the totaled vehicle (known as “salvage”) and may obtain a “salvage title” for the vehicle. After it pays it’s insured the pre-loss ACV of the vehicle and forwards the certificate of ownership, the license plates and a required fee to the Department of Motor Vehicle (DMV), the DMV then issues a Salvage Certificate for the vehicle. In some cases, the vehicle is repaired, re-registered with the DMV, and then classified as a “revived salvage or salvaged vehicle. Of course, if the insured wants to keep the “totaled” vehicle, the insurance company will deduct the value of the salvage from the claim payment.

The criteria for deciding when a car is a total loss and when it can be repaired vary from insurance company to insurance company and might even be dictated and controlled by state statute or regulation. Further complicating the issue is the fact that insurance companies do not all use the same sources for determining the value of a vehicle. The threshold used by your insurance company to make this determination can be discovered by calling your insurance agent. Insurance professionals, on the other hand, have to be familiar with these rules, criteria, and thresholds in all 50 states.

In determining whether a vehicle is totaled. insurance companies will calculate the total loss ratio (cost of repairs/actual cash value) and then compare this ratio to limits set either internally within the company and/or regulated and established by state law. It is also sometimes referred to simply as the damage ratio. Some states dictate how high this damage ratio needs to be in order to be able to declare a vehicle a “total loss” and be eligible for a salvage title or certificate. This is referred to as the Total Loss Threshold (TLT). In order to total a vehicle, the total loss ratio must exceed the established percentage. If the TLT is not dictated by the state, an insurance company will usually default to something known as the Total Loss Formula (TLF) which is:

Cost of Repair + Salvage Value Actual Cash Value

If the sum of the first two quantities is greater than the ACV, the car can be declared a total loss. As an example, a damaged 2002 Toyota Echo with 185,000 miles in good condition has an ACV of approximately $2,800. Total repair costs are estimated at $2,000, for a damage ratio of 72 percent. This car would be considered a total loss in Arkansas, where the TLT is 70 percent, but not in Florida where the TLT is 80 percent. In Illinois, the TLF would be used and, if the salvage were worth $700, the car would not be totaled ($2,000 + $700 $2,800). Of course, states utilizing the TLF rely on and defer to the judgment and opinions of licensed appraisers. Individual state laws provide the following with regard to the TLT:

States frequently dictate this TLT as part of legislating salvage titles. As an example, in Wisconsin, § 342.065(1)(c) reads as follows:

(c) If the interest of an owner in a vehicle that is titled in this state is not transferred upon payment of an insurance claim that, including any deductible amounts, exceeds 70% of the fair market value of the vehicle, any insurer of the vehicle shall, within 30 days of payment of the insurance claim, notify the department in writing of the claim payment and that the vehicle meets the statutory definition of a salvage vehicle, in the manner and form prescribed by the department.

Many states have exceptions to these rules for older vehicles which tend to complicate the issue. Typical policy language regarding total losses is as follows:

We will pay the cost to physically repair the auto or any of its parts up to the actual cash value of the auto or any of its parts at the time of the collision. The most we will pay will be either the actual cash value of the auto or the cost to physically repair the auto, whichever is less. We will, at our option, repair the auto, repair or replace any of its parts, or declare the auto a total loss. If, the repair of a damaged part will impair the operational safety of the auto, we will replace the part.

Understanding the procedure behind declaring a vehicle a total loss isn’t always a prerequisite for successful subrogation. But there are occasions when the third-party tortfeasor and its liability carrier or attorney will question the amount of damages you are looking to subrogate. In such instances, a working knowledge of this area of insurance becomes indispensable.

Car Crash Phone Scam Circulating Colorado Springs

A telephone scam is circulating our area. It’s dramatic and personal. It is about family, and any of us could easily be a target.

11 News is talking to a man who almost fell victim.

Deon got an alarming phone call from a number he didn’t recognize. The caller said there was a bad accident involving a truck, an SUV and a car that happened in downtown Colorado Springs.

“As soon as he said downtown, my heart jumped and I was very upset,” Deon said.

Deon’s wife drives a 4-door car and was supposed to be headed downtown to a hair appointment. But then there was an interesting twist. The caller’s brother was also in the crash. The caller said his brother is a fugitive and was holding Deon’s wife hostage.

“He stated if I got some money to his brother, he could get out of town and he could get my wife.”

When Deon pressed the caller for answers, it just didn’t add up.

“He couldn’t tell me the color of the vehicles, he couldn’t tell me the name of my wife or anything like that.”

Deon hung up and called police. He’s hoping others will learn from this and not fall victim.

This scam has been circulating in the Pikes Peak region for the past few weeks. The El Paso County Sheriff’s Office issued a warning about this same scam earlier in February .

Colorado Springs police say they have briefed all their officers on this scam. The criminals might know a few simple facts about you, such as your marital status, or what part of town you live in. That’s stuff that is easy to find out, and it could draw you in to the story.

If you receive a call like this, call police. Officers can actually verify traffic crashes, even if they are in a different city.

D.C. No-Fault Car Insurance Laws

Every U.S. state has its own auto insurance laws and requirements. So does the District of Columbia, which has its own driving laws and its own Department of Motor Vehicles. In this article, we ll explore the insurance rules and regulations that apply to cars registered in D.C. and how they might affect drivers who are involved in a car accident.

Washington D.C. s No-Fault Car Insurance Laws

Washington, D.C. follows a no-fault car insurance system. This means, when an accident occurs, each driver involved in the crash files an injury claim with his or her own insurer first, regardless of who bore the legal fault for the accident. (Our article No-Fault Car Insurance and State Laws: The Basics covers no-fault insurance in more detail.) In exchange for this fairly comprehensive insurance coverage, motorists are prohibited from suing one another over car accident injuries unless the case involves one of the following:

  • the injury causes substantial permanent scarring or disfigurement
  • the injury causes a substantial and medically demonstrable impairment in performing daily activities
  • the injury causes a medically demonstrable impairment that prevents the injured person from doing his or her daily activities for at least 180 days, or
  • the medical costs from the injury exceed the PIP benefits available under the drivers no-fault policies.

Minimum Car Insurance Requirements in D.C.

Any motor vehicle registered and driven in Washington, D.C. must be insured for at least the following minimum types and amounts of coverage:

  • $25,000 per person or $50,000 per accident in personal injury protection (PIP) benefits
  • $10,000 per accident for property damage
  • $25,000 per person or $50,000 per accident in uninsured/underinsured motorist coverage, and
  • $5,000 per accident for uninsured/underinsured motorist property damage (subject to a $200 deductible).

When an accident injures only one person, the per-person injury limit applies. When more than one person is injured, the per-accident limit applies to the benefits paid to every person who was injured in the accident. Property damage benefits cover damage your vehicle causes to another person s real estate or personal property. For instance, if you crash into a neighbor s fence during an accident, your property damage benefits would go to pay the costs of repairing or replacing the fence.

The minimum required insurance does not cover damage to your vehicle in a crash. However, you can always add “collision” coverage to your policy.

Uninsured/Underinsured Motorist Coverage in D.C.

The required coverage for uninsured/underinsured motorist accidents is $25,000 per person and $50,000 per accident in D.C. This coverage ensures that medical bills can still be paid even if one of the drivers involved in the accident did not have insurance or did not have enough insurance to cover everyone s injuries, property damage, or both.

Washington, D.C. requires uninsured/underinsured motorist coverage for both personal injuries and property damage, which is unusual; most states that require this coverage only mandate it for personal injury costs. Minimum car insurance requirements

Most states require you have car insurance and have laws that outline the minimum level of coverage you must buy.

The minimum limits your state requires, however, may not necessarily be adequate. A car accident can cost far more than the limits mandated by most states. The Insurance Information Institute recommends you carry at least $100,000 of bodily injury protection per person and $300,000 per accident (known as 100/300).

How to read auto insurance liability limits

  1. First number: Bodily injury liability maximum for one person injured in an accident.
  2. Second number: Bodily injury liability maximum for all injuries in one accident.
  3. Third number: Property damage liability maximum for one accident.

For example, if you live in New York, the minimum liability limits are $25,000 for injury liability for one person, $50,000 for all injuries and $10,000 for property damage in an accident (written as 25/50/10). Plus, New York requires you to have personal injury protection (PIP) and uninsured motorist bodily injury coverage (UM).

  • UM = Uninsured motorist coverage.
  • UIM = Underinsured motorist coverage.
  • UM BI: Uninsured motorist bodily injury coverage.
  • UMPD: Uninsured motorist property damage coverage.
  • PIP: Personal injury protection.
  • PPI: Property protection insurance (Michigan).
  • BI liability: Bodily injury liability.

Car insurance requirements by state

* New Hampshire doesn’t require car insurance, but you must be able to show proof of financial responsibility if you’re in an accident.

Uninsured and underinsured motorist coverage

A total of 21 states, plus the District of Columbia, require either uninsured motorist (UM) bodily injury coverage by itself or both UM coverage and underinsured motorist bodily injury (UIM) coverage.

Uninsured motorist bodily injury covers medical expenses if you or your passengers are injured by an uninsured driver. Underinsured motorist is triggered when the at-fault party is insured but his insurance limits are too low to pay all of your medical bills.

Uninsured motorist property damage (UMPD) covers damage your car received from an accident with an at-fault uninsured driver. UMPD is required in only eight states.

What is no-fault car insurance?

If your state has a “no-fault” auto insurance law, your auto insurance policy must pay medical bills for you and your passengers regardless of who caused the accident.

Your no-fault coverage — which is your personal injury protection (PIP) — may come with a copayment and/or deductible. No-fault coverage applies only to bodily injury claims. If you also have car damage, you would make a claim for the damage against the at-fault party s property damage liability coverage.

No-fault laws are intended to keep insurance fraud down.

Deciphering auto insurance liability across state lines

If you hold the minimum automobile insurance required in your state and are involved in an accident in another state that requires higher minimum coverages or other coverage (such as personal injury protection), typically your policy will automatically increase to meet that state’s minimum coverage requirements.

For example, if you’re a Connecticut driver (where minimum liability coverage is $20,000 of bodily injury protection per person, $40,000 of bodily injury protection per accident and $10,000 of property damage per accident, referred to as 20/40/10) and are involved in an accident in New York (which requires 25/50/10 of liability coverage), your auto insurance will automatically extend to meet New York’s requirements. This boost can be helpful, especially when you cause a large amount of property damage.

Some states restrict the ability of their citizens to sue one another for pain and suffering after a car accident. Puerto Rico (a U.S. territory) and 12 states have “no-fault” laws:

These laws mean that your car insurance must pay for bodily injury damages no matter who’s at fault in an accident. However, these same states allow their citizens to litigate against folks from other states after a car accident.

For example, you are limited in your ability to sue for damages if you live in Pennsylvania. When buying your auto coverage you have two choices of liability: “full tort” or “limited tort.” If you choose “limited tort,” you will pay less in premiums but you won’t be able to sue another Pennsylvanian for pain and suffering unless you’re seriously injured and your medical bills exceed a specified minimum amount. What constitutes a serious injury is outlined in your car insurance policy. If you choose full tort, your premiums will be more but you will be able to sue no matter the amount of your damages.

Throw out the rulebook if someone from another state crashes into you. Even if you have Pennsylvania “limited tort,” you’ll be able seek compensation for pain and suffering in the court system if someone from outside Pennsylvania crashes into you.

If your car was first registered before 1 April 2017 then you’ll continue to pay car tax (VED) under the current CO2-based system, but for new cars it’s all change from 1 April.

What are the new car tax (VED) rules from April 2017?
  • The first year rate will be based on official CO2 figures.
  • A flat standard rate of 140 will apply to all cars except those releasing 0 grams CO2/km for which the standard rate will be 0.
  • An extra charge of 310 a year will apply to cars with a list price over 40,000 in the first 5 standard rate years .

VED basics

All vehicles registered in the UK and used on public roads must be taxed.

If you re not using it, you must either let the DVLA know it s being kept off-road with a SORN (Statutory Off Road Notification) or continue to tax it.

  • The cost of car tax (Vehicle Excise Duty) depends on how old your vehicle is and its engine size or official CO2 emissions. From April 2017 it ll depend on the car s list price when new, too.
  • The CO2 figure for your car is on the V5c registration document, as it s measured in official tests before the car s available to buy.
  • The DVLA stopped issuing paper tax discs from 1 October 2014.
  • Check the tax status of any vehicle all you need is the vehicle s make and registration number.
  • Rules for cars first registered before 1 March 2001
  • Rules for cars first registered between 1 March 2001 and 31 March 2017
  • Rules for cars first registered on or after 1 April 2017

Registered before 1 March 2001

Car tax is based on engine size, as official CO2 data wasn t generally available. So, if the engine is:

  • 1549cc or smaller: 150 a year (2017/18 rate)
  • Bigger than 1549cc: 245 a year (2017/18 rate)

Registered between 1 March 2001 and 31 March 2017

There’s a series of car tax bands based on official CO2 emissions that your car will fall into.

There s a different rate for brand new cars for the first year this showroom tax was introduced in 2010. The cost then changes to the standard rate from the second year.

1 12-month non-direct debit rate and single 12-month payment direct debit rate. Alternative fuel car (tax class 59) discounts are: 2015/16 10 all cars, 2016/17 10 all cars 2017/18 10 all cars

Registered after 1 April 2017

From 1 April 2017, there will be big changes to how cars are taxed. The main points are:

  • The first year rate will be based on official CO2 figures.
  • A flat standard rate of 140 will apply to all cars except those releasing 0 grams CO2/km for which the standard rate will be 0.
  • An extra charge of 310 a year will apply to cars with a list price over 40,000 in the first 5 standard rate years .
  • Alternative fuel cars (tax class 59) pay 10 less than the First year and standard rates below.
  • Cars first registered before 1 April 2017 will continue to pay car tax under the old system.

Historic vehicle exemption

Cars built more than 40 years ago will be automatically exempt from paying car tax, from 1 January 2017.

Car tax or road tax?

Cars started being taxed in 1920 as local councils had to start registering all vehicles. It was called Vehicle Excise Duty (VED) and was based on horsepower. Tax discs were later introduced in 1921.

This new tax was initially used for building and maintaining roads. As it was paid directly into the road fund it was known as the Road Fund Licence or road tax.

In 1936, road works were being paid for by government grants. As the road fund wasn t needed any more, it was abolished in 1955. So while it might have been right to refer to it as road tax or the Road Fund Licence before 1936, this hasn t been the case since.

End of the road for the tax disc

One of the biggest changes in DVLA history was the abolition of the 93-year-old tax disc, on 1 October 2014.

Also, the DVLA now issues automatic refunds on car tax for any full months left to the registered keeper when a vehicle is sold, scrapped or a Statutory Off Road Notification (SORN) is made. In the past, you could transfer car tax from your old vehicle to the new one.

Accidents happen, and sometimes your regular health insurance isn’t enough to cover the cost of personal injury. That’s where additional car insurance kicks in.

How Does Car Insurance Work with Health Insurance?

Medical car insurance coverages will help you pay for your injuries, whether or not you already hold health insurance. You’ll be able to supplement your healthcare coverage with these coverages so that you aren’t left paying for what your healthcare won’t cover.

In theory, you car insurance coverage should pay first. This means that once your limits are exhausted, you can begin tapping into your health insurance for additional costs.

Medical providers will likely perform necessary care services and then work with your auto insurance company to facilitate payment. Remember that you will be responsible for deductibles on any policies that you use.

Which Car Insurance Coverages Pay for Injuries?

Some car insurance companies offer coverage that help pay for medical expenses, too.

  • Liability coverage.
  • Personal injury protection.
  • Medical payments coverage.
  • Uninsured and underinsured motorist coverage.

In most states, liability coverage is the minimum coverage a person is required to hold.

That said, liability protection for medical coverage only applies if the other driver is at fault meaning, the other driver’s liability coverage would pay for your injuries.

Your own liability coverage never pays for your own damages.

Generally, personal injury protection (PIP insurance), also known as “no-fault coverage,” is is only available in no-fault states. It is often required, but may be available as additional optional coverage.

PIP insurance pays for your injuries without regard to fault. So unlike liability coverage, which will only pay out damages to the other driver when you’re at fault, PIP will cover you even if you caused the accident.

PIP is a wise addition to your car insurance policy because it can take care of what your health insurance might not cover.

PIP, for example, can help you pay for:

  • Personal injury expenses related to the accident, such as:
    • Hospital and doctor’s bills.
    • Prescriptions.
    • In-home services and rehabilitation.
  • Lost wages, such as those due to a disability arising from the accident.
  • Funeral expenses.

Similar to PIP, medical payments coverage kicks in when you exceed your regular health insurance limits.

In addition to medical costs and funeral expenses, medical payments coverage can also include the costs to:

  • Your passengers.
  • You, if you’re a passenger in someone else’s car.
  • You, if you’re struck by a car while walking or cycling.

Uninsured and Underinsured Motorist Coverage

As mentioned above, depending on another driver to carry enough insurance (or, in some cases, any insurance) is risky.

Adding uninsured and underinsured motorist coverage to your car insurance policy financially protects you against motorists who don’t have enough or any coverage to pay for the personal injuries they’ve caused you.

Talk to your car insurance provider about whether these coverages would benefit you.

What Is Required?

Generally, only liability coverage is required, although some states require collision and comprehensive coverage if you’re leasing a vehicle or still have a loan on it.

As explained above, personal injury protection (PIP) is required in no-fault states, though some allow you to waive the coverage in writing.

Certain states may require other coverages, but for the most part all other types are considered optional. Take into account your health insurance coverage and how much protection you want or need before making a decision on additional car insurance coverages.

Deciding What You Need

You’ll need to consider how robust your current healthcare plan is. If you’ve got great healthcare coverage, you may choose to elect only a very low limit for your medical coverage. And vice versa.

Note that certain car insurance coverages will go beyond just medical bills. For examples, PIP insurance pays for lost wages due to accident-related injuries.

Here’s how it works: Car Talk sells listeners’ cars (with their permission, of course!), and the listeners’ local NPR Member Stations get the proceeds from the sale. Due to IOPD rules we would like to make clear that ALL riders (Championship or Non championship ) for all future events are required to display a Finn Type board with there correct class background colour and numbers which need to be displayed on both sides as stipulated on our rules page.
Flat number boards displayed on the back of the any quads will unfortunately not be able to participate in an event.
This is a requirement requested by IOPD.
All non championship riders will be required to ride with a transponder as this reduces confusion with our lap scoring.

Any problems. issues with any of this information please contact me before any of the events.

I.O.P.D. Have asked us to point out to all riders that ‘A head camera attachment could compromise a participants safety in the event of a collision.’ We therefore strongly advise they are not used.

We are running an open Youth Hybrid class this year. There will be one class for all engine sizes to a max of 250cc and it will run alongside the 250 group. Age restrictions will still apply.

Minimum age for youth riders is now 7 years old

You will be required to display your number on a rear fin type board of the correct colour for your class. You will not pass scrutineering without this.

As a non-standard insurer, its primary market is drivers who may not otherwise qualify for coverage from a standard policy due to a poor driving record.

It also offers the ability to get a policy immediately online for those who need to fill out an SR-22 (proof of insurance form) to get their drivers licenses reinstated. This is common for non-standard insurance companies, making the term “SR-22 insurance” popular for referring to this and other insurers in the niche.

The company is headquartered in San Diego and sells its products through dedicated agencies in each state where policies are issued. Altogether the company employs over 70 people, and handles all of its claims in-house rather than hiring adjusters or outside claims staff.

Anchor General markets its products primarily through its agencies (like Anchor General Insurance Agency ), with very little information on its website addressed toward potential customers. Much of the site is hidden behind a password for members only, and the main purpose of the site seems to be geared more toward collecting payments than establishing new business.

Anchor General sells auto insurance, but the does not offer any information about their policies. This seems to be customary with low cost, high risk insurers where their target market is more concerned about getting insurance coverage than what bells and whistles come with the policy. In general, high-risk insurance companies tend to provide bare-bones policies designed to meet the state s minimum legal requirements to drivers whom by other standards are simply uninsurable.

Anchor General Rates

Anchor General s website claims that it offers competitive rates, however, the user is unable to obtain a quote on the website. There is no listing for agencies, and there is not a clearly marked customer service line to call for this information. In the case of Anchor General, though, many reviews tend to hint towards a greater issue specific to them. The company’s small size appears to have crippled its customer service. Useful review, as I am finding out who I am dealing with. In my case, trying to get a fair settlement, while they attempt to compare my vehicle with lesser valued vehicles. The 2005 case brought by the State Commissioner seemed to have a weak conclusion, with a lot of We ll talk to our people about that responses to violations. Monitary compensation to claimants seemed to be small change so they really got a small slap on the wrist which would just be encouragement to keep behaving poorly..

What to Do After a Car Accident

Each year, thousands of people are involved in traffic accidents during the Memorial Day Weekend. If you are one of these unfortunate people, will you know what to do in the aftermath of a collision? How you react can prevent further injuries, reduce costs and accelerate the clean-up and repair process.

The Consumer Protection Association of America is increasing public awareness on this subject by designating the week before Memorial Day “National Driver Education Week.” The Association has developed a list of suggestions to help drivers anticipate what they need to know about dealing with an accident.

“These tips can make a big difference in everything from protecting yourself and your passengers to ensuring that you won’t be without a car while yours is in the shop,” said Dr. Ray Bruce, president of the association.

Over 6.3 million police-reported motor vehicle crashes occurred in the United States in 1998. Almost one-third of these accidents resulted in injury. In 2001, nearly 42,000 people died on America’s roadways. Clearly, accidents are a part of life in America.

So, if you are involved in a traffic collision, try to remain calm, and follow these steps:

Action Plan to Deal with Accidents:

1. Keep an Emergency Kit in Your Glove Compartment. Drivers should carry a cell phone, as well as pen and paper for taking notes, a disposable camera to take photos of the vehicles at the scene, and a card with information about medical allergies or conditions that may require special attention if there are serious injuries. Also, keep a list of contact numbers for law enforcement agencies handy. Drivers can keep this free fill-in-the-blanks accident information form in their glove compartment. The DocuDent Auto Accident Kit ($19.95), supported by AAA and insurance companies, offers a comprehensive kit that includes a flashlight, reusable camera and accident documentation instructions. A set of cones, warning triangles or emergency flares should be kept in the trunk.

2. Keep Safety First. Drivers involved in minor accidents with no serious injuries should move cars to the side of the road and out of the way of oncoming traffic. Leaving cars parked in the middle of the road or busy intersection can result in additional accidents and injuries. If a car cannot be moved, drivers and passengers should remain in the cars with seatbelts fastened for everyone’s safety until help arrives. Make sure to turn on hazard lights and set out cones, flares or warning triangles if possible.

3. Exchange Information. After the accident, exchange the following information: name, address, phone number, insurance company, policy number, driver license number and license plate number for the driver and the owner of each vehicle. If the driver’s name is different from the name of the insured, establish what the relationship is and take down the name and address for each individual. Also make a written description of each car, including year, make, model and color and the exact location of the collision and how it happened. Finally, be polite but don’t tell the other drivers or the police that the accident was your fault, even if you think it was.

4. Photograph and Document the Accident. Use your camera to document the damage to all the vehicles. Keep in mind that you want your photos to show the overall context of the accident so that you can make your case to a claims adjuster. If there were witnesses, try to get their contact information; they may be able to help you if the other drivers dispute your version of what happened.

5. File An Accident Report. Although law enforcement officers in many locations may not respond to accidents unless there are injuries, drivers should file a state vehicle accident report, which is available at police stations and often on the Department of Motor Vehicles Web site as a downloadable file. A police report often helps insurance companies speed up the claims process.

6. Know What Your Insurance Covers. The whole insurance process will be easier following your accident if you know the details of your coverage. For example, don’t wait until after an accident to find out that your policy doesn’t automatically cover costs for towing or a replacement rental car. Generally, for only a dollar or two extra each month, you can add coverage for rental car reimbursement, which provides a rental car for little or no money while your car is in the repair shop or if it is stolen. Check your policy for specifics.

The final question in dealing with an accident is usually who will pay for the damages? If the accident was minor, you and the other drivers may decide to handle the damages yourselves without the involvement of an insurance company. But this isn’t always the best idea, for several reasons.

While the other driver may agree to pay for the damage to your car on the day of the accident, he may see the repair bills and decide it’s too high. At this point, time has passed and your insurance company will have more difficulty piecing together the evidence if you file a claim.

Also, keep in mind that you have no way of knowing whether another driver will change his mind and report the accident to his insurance company. He may even claim injuries that weren’t apparent at the scene of the accident. This means that your insurance company may end up paying him a hefty settlement, or worse yet, you could be dragged into a lawsuit. So make sure that your company has your version of what happened and check your policy if the damages paid out by your insurance company are below a certain amount, the accident may not be considered chargeable. And you will avoid the penalty of a premium hike.

Auto accidents take a tremendous toll on everyone involved, both financially and emotionally. If you’re one of the lucky ones who have thus far avoided a serious accident, hopefully the tips on prevention will help keep it that way. The chances are high, though, that at some point you will be involved in a minor accident. Just keep your head and make safety your primary concern. You’ll have plenty of time to deal with the consequences later.

The 7 Cheapest New Cars in the United States

The seven cheapest new cars on sale in the United States all come in under $15,000. Although the phrase “you get what you pay for” seems to be a universal constant, there are a few options listed here that will help you get the most for your money. All prices quoted include destination charges.

To keep outlay as low as possible, knowing how to drive a stick shift is an advantage, since automatic transmissions are usually options instead of standard equipment. A manual transmission will affect resale value, however, so a decision has to be made whether to take that financial hit up front or down the road.

2014 Nissan Versa 1.6 S ($12,800; 27 miles per gallon in the city/36 mpg highway/30 mpg combined)

This is officially the cheapest new car on sale in the United States, a title it’s held for a couple of years. Unexpectedly roomy for a subcompact sedan — and although no one benchmarks a Versa for driving dynamics, it doesn’t feel like a penance to drive. Air conditioning is standard, along with a CD player. A 1.6-liter engine making a tepid 109 horsepower and 107 lb-ft of torque is linked to a 5-speed manual transmission driving the front wheels. and that’s pretty much it.

If you require an automatic transmission (a continuously variable automatic transmission, or CVT. is available), or Bluetooth, iPod integration, alloy wheels, a rearview camera, navigation or even one of those little mirrors in the front passenger’s sun visor, then you’ll have to look to one of the higher (and therefore more expensive) trim levels. The thing is, that lifts the budget into an area where you could buy something more peppy and fun, such as the 2014 Ford Fiesta S.

The 2014 Nissan Versa Note is the hatchback version, bringing 5-door practicality to that relatively large interior space. It costs $2,000 more, though.

2014 Chevrolet Spark LS ($12,995; 31 mpg city/39 mpg hwy/34 mpg combined)

Giving the name Spark to something with only 84 hp and 83 lb-ft of torque from a 1.4-liter, 4-cylinder engine seems a tad optimistic. But where this subcompact 4-door (or five, including the hatchback) wins friends is with pleasing designs inside and out.

As well as air conditioning, the Spark LS comes with power windows, alloy wheels, hill-hold assist and an impressive complement of 10 airbags. It’s another 5-speed manual transmission; CVT is an option. Now’s as good a time as any to mention continuously variable transmissions — without getting too technical, they’re basically one gear. They can be slow to respond and noisy. But that does make them cheaper than auto transmissions containing several ratios.

Back to the Spark: It’s a car with decent interior space that stretches out as far as its headroom. Folding down the rear seats means removing the headrests, which is inconvenient, but that’s a minor gripe for what is generally a good buy.

2014 Mitsubishi Mirage DE ($13,790; 34 mpg city/42 mpg hwy/37 mpg combined)

This is an all-new model for 2014, in the United States at least. It seems the main reason why this 5-door subcompact hatch is so cheap is because the company didn’t spend any money making it decent to drive. Or including much sound insulation.

It’s also one of the lightest cars on sale in North America: 1,973 pounds. The engine is certainly lighter by a cylinder. Yep, this one has three, straining out a wheezy 74 hp and 74 lb-ft of torque from 1.2 liters of displacement.

Scrimping on cylinders and weight does have a great effect on fuel economy, though, returning the most impressive figures of this group. With the optional CVT, those numbers improve to 37 miles per gallon in the city, 44 mpg on the highway and 40 mpg combined. Yet somehow Mitsubishi still manages to include power windows, mirrors and locks, a 4-speaker stereo system and even an airbag for the driver’s knees. That said, it’s hard to get excited about.

2014 smart fortwo pure ($14,020; 34 mpg city/38 mpg hwy/36 mpg combined)

A successor is expected soon, because this sub-subcompact 2-seater is getting on in years. Space for the couple of passengers is fairly generous, and the trunk area can take just enough luggage for a pair’s weekend away.

This was a good idea for European cities where streets are narrow and parking spaces are few. Things don’t quite work that way in the U.S. Instead, the American smart driver will have to contend with crosswinds gusting off the prairie and a shunt-with-every-shift mechanized semi-manual transmission, neither of which makes the car an attractive proposition. The short wheelbase also makes speed humps irksome.

Most cars have crumple zones, areas of the body that absorb energy in a collision. The diminutive smart doesn’t have room for such things, but it still performs well in crash tests thanks to a safety cell that surrounds its occupants. And eight airbags in a 2-seater is good.

Tipping the scales at a feathery 1,808 pounds means the tiny 1.0-liter, 3-cylinder engine doesn’t feel inadequate when it buzzes out just 70 hp and 68 lb-ft of torque. Air conditioning comes as standard for 2014, joining power locks.

2014 Kia Rio LX ($14,700; 28 mpg city/36 mpg hwy/31 mpg combined)

As prices rise, the cars become more desirable. The Rio subcompact sedan doesn’t compromise with weak engines or limited seating. It actually packs something of a punch: 138 hp and 123 lb-ft of torque from a 1.6-liter, 4-cylinder unit. This goes to the front wheels through a 6-speed manual transmission.

The Rio looks vaguely sophisticated and comes with air conditioning, heated power door mirrors, a CD player and an iPod socket. Power windows, however, are part of an option package. Landing a hatchback version only means parting with another $100.

Downsides include a noisy cabin, a disappointing driving experience and Kia’s seats don’t always provide the desired amount of support. So if you’re on a test drive, pay attention to your posterior.

2014 Ford Fiesta S ($14,925; 27 mpg city/38 mpg hwy/31 mpg combined)

At last, something for the enthusiast. This subcompact sedan feels confident through the curves as well as comfortable on the stretches. A 1.6-liter, 4-cylinder engine delivers 120 hp and 112 lb-ft of torque to the front wheels through a 5-speed manual transmission.

The cabin is an agreeable place to be, with decent materials and build quality. Standard equipment includes power locks, air conditioning, hill-start assistance, an airbag for the driver’s knees and clever side mirrors that include a convex section to eliminate blind spots. The Fiesta is also rare in its class by offering tilt-telescopic steering wheel adjustment and a 6-speaker audio system.

2014 Chevrolet Sonic LS ($14,995; 26 mpg city/35 mpg hwy/30 mpg combined)

Just squeaking onto a list of cheapest new cars by costing five bucks short of $15k, the Sonic comes with blind-spot-mitigating mirrors, a tilt-telescopic steering wheel, hill-start assistance, Bluetooth, air conditioning and keyless entry. Both front occupants get knee airbags as part of the 10 found within the Sonic’s relatively commodious cabin.

Less-than-stellar fuel figures have a silver lining: an energetic 138 hp and 125 lb-ft of torque from a 1.8-liter, 4-cylinder engine. Like the Fiesta, the standard transmission is a 5-speed manual. Though the Fiesta is the driver’s choice, the Sonic still feels composed.

For those wanting to buy domestic, the Sonic is the only one of the bunch to be made in the States.

Is your car insured? It used to be the case that if an unused car was off the road (on your driveway or in a garage, for example), you needn’t insure it. This all changed in 2012 with the introduction of the Continuous Insurance Enforcement law.

What does that mean?

If you own a vehicle and it is registered in your name, you must arrange insurance for it, unless it has officially been declared “off-the-road”. The penalty for not doing so is a hefty fine of up to £1,000, prosecution and the risk of the car being impounded and even destroyed.

How to check that your car is insured

How can you tell if your car is insured? There’s a very easy way to check. Every insured car will be registered on the Motor Insurance Database (MID ). Simply enter the registration number of your vehicle and if it is registered, the MID website will confirm it; it even tells you the make and model of your car.

Who will know if my car is not insured?

The Motor Insurance Database is used by the DVLA to enforce motor insurance law. The DVLA have a record of the registered keeper of every vehicle in the UK. A letter is sent to registered keepers if their vehicle is not on the Motor Insurance Database. If the car owner does not subsequently arrange insurance, a fixed penalty or prosecution will follow.

The police also use the MID. If a driver catches their attention for whatever reason, checking the insurance status of the vehicle with the MID is a routine procedure.

Declaring your car “officially” off the road

If your car really is off the road, ie not being used at all and you want to make that official so you don’t need to have motor insurance or road tax, you must contact the DVLA with a formal Statutory Off Road Notification (SORN). You can do this online if you want.

Checking other vehicles are insured

If you’ve been in an accident and it wasn’t your fault, you might be worried that the other driver doesn’t have insurance. The Motor Insurance Database can help you here, too. She continued, “If somebody got hurt, he was the first one to go help plant and help people. He was really involved in the town. He was a good guy, a very good guy.”

In fact, she said the service was mostly filled with old stories and laughter from the people of the community.

“There was a lot of laughing. He would have hated all this notoriety, it just wasn’t him,” she told us. “The more he could do in the background, the better he liked it.”

She also told us Mosher had a “great family,” who is just trying to figure out how to move forward from their tragic loss.

“You know, they’re so sad right now,” she said. “But you give them a couple months, they’re going to want the courts to do their job.”

On Sunday, E! News learned a wake was also held at the same funeral home.

“It was a typical wake. Everyone was talking to the family and dropping off cards,” a second insider told us. “It was sad. He was relatively young.”

We can confirm Soules did not attend the wake either.


Meanwhile, today marks one week since the fatal car accident that lead to Mosher’s death.

Last Monday night, E! News learned the former Bachelor star rear-ended a tractor driving near his hometown in Iowa. After calling 911. Soules spoke to the first responders and then left the scene of the accident.

Soules was arrested around 1 a.m. at his Arlington home and appeared in court early Tuesday morning where he was charged with leaving the scene of a fatal car accident.

He was released after his mother, Linda. posted $10,000 bail on his behalf, and according to authorities, the cause of the accident including whether alcohol was a factor is still under investigation.

In fact, on Friday, E! News confirmed Iowa’s Buchanan County authorities requested a search warrant regarding the investigation. However, we’ve obtained the documents which state that the cause for the warrant as well as the response will remain sealed.

Following the accident, Soules hired a high-powered legal team out of Des Moines to represent him in the trial. The team has filed to have all information regarding the investigation remain sealed due to the high publicity surrounding Soules and the accident.

The attorneys said in a statement they “are confident that once all the evidence is made public, it will show Soules acted reasonably and did everything in his power to provide aid to Mr. Mosher.”

Early (Drum Brake) cars up to about SN4203, have ball bearing front hubs with a distance piece between the two races. The outer race of the inside bearing is held in place by a screwed ring and a castellated nut drilled and cotter pinned in place. Failure to use such a nut may cause loss of the wheel. Later disk brake cars have roller bearings. For instructions on how to install them, click HERE .

Bearing and Rotor Removal

On disk brake cars, the caliper will have to be removed. The caliper is attached with two bolts (18mm), usually safety wired together. Do not remove the brake hose from the caliper. Hang the caliper on a coat hanger in some out of the way place.

1. Remove the cotter key on the castle nut. On wire wheel hubs, rotate the hub until the two holes are aligned such that the pin can be worked out.

2. On Drum brakes, back off the adjustment cams.

3. A 1″ socket is required to loosen the castle nut. However, the castle nut is held in place by a cotter pin. This pin must be removed. On wire wheel cars, you will see opposite holes in the hub placed to allow access to the pin from the side if you turn the assembly to have them align with the pin. Now you must fiddle to get the cotter pin out. Don’t worry about breaking it. Simply replace it with new on assembly. The removal will be a hassle, but installation is easier.

4. Slip the hub off. Ball bearing hubs will require a puller and others may need a rubber hammer. Screw the castle nut part way back on when breaking loose with the puller. This will prevent the spreading of the spindle end from puller pressure.

1. Clean the wheel bearings thoroughly and inspect them for any signs of pitting on either balls/rollers or races. Ball bearings can be spun (dry) while holding by the inner race at about 45 degrees from the horizontal. You can usually feel wear (pitting) as a “grabbing” feeling. In any event, new bearings are the wisest option.

2. Fresh bearings will not come out of the box pregreased. So pack each thoroughly. Here is a video. Put a generous dab of grease in the palm of your (clean) hand and push the grease between the rollers and the cage. Do this all around the circumference of both bearings.

3. While your hands are slathered, cup some more grease and glob it into the disc (or drum) hub. Don’t pack it full — about 30-40 percent grease is plenty.

4. Insert the large inner bearing into the back side of the hub. Tap the new grease seal into the back of the hub. This grease seal is a Morgan only part.

5. Reinstall the brake disc (or drum) on the spindle, insert the small outer bearing, and place the washer and thread on the nut. Run the nut home, then tighten it a little more with a socket while spinning the brake disk with the other hand. This seats the bearing further and sets its preload. Keep spinning while tightening. You’ll feel the bearing start to bind slightly as you tighten more. Stop there.

Note: The earlier cars are far more sensitive to how tight the castelnut should be torqued. Overtightening will burn their bearings very quickly. The later disk brake car are easier.

6. Now back off the nut with the wrench until you feel that resistance dissipate, and one of the castellations on the nut lines up with the cotter pin hole.

7. Use a new cotter pin. With the earlier Don’t overtighten the spindle nut. With the Better to keep it on the looser side than make it too tight if the cotter pin holes don’t line up just right. To finish the job, fill the dust cap halfway with grease and tap it back on. Reinstall the brake caliper, then scrub the brake disc with brake cleaner to remove any grease or even handprints from the friction surface.

Another trick is to use vacuum cleaner hose, the type that is corrugated and compressible, this can be split and wrapped over the lower rebound and Main springs thereby keeping some of the muck off the “moving parts” and therefore (hopefully) reducing the production of “grinding paste”.

I agree with suggestions from other DG members that Factory one shot oiler system is a ‘least worse’ system to cope with drivers who can’t be bothered to grease the kingpins at all. I stopped using my one shot oiler within a thousand miles of driving my Morgan and I went over to greasing at least every 1000 miles (preferably 500). At first I had nipples (zirks) added to the top of the pins, but as these were difficult to reach (particularly with my ‘telescopic’ grease gun taken on touring holidays).

I have just fitted the Phaeton kit. This made by a small outfit based in Emsworth, Hampshire,

Basically each side has a ‘brake pipe’ type tube. Fitting in place of the oiler, through the inner wing valence to give an easy to reach grease nipple/zirk. Just open the bonnet, a few strokes of the grease gun every few hundred miles, and it should give better life than the standard system. It is a good idea to jack the car for greasing bottom points, and lever bottom bushes up to ensure grease gets below them.

The kit comes with a couple of ball bearings with which to blank off the other end of the oiler pipes, but I had already sorted these by removing one, taking the other (cut short) in a loop to the other side. If I press the button the oil ain’t going nowhere! As I said, until recently I used a cranked nipple/zirk on the top of each king pin – but it was a real ******* to reach (and not possible with the ‘telescopic’ grease gun I use when on holiday.

It consists of 2 lengths of copper pipe, and on the end of each pipe a grease nipple (what our ‘merikan friends call a ‘Zerk’. Goodness only knows why!).

To install, jack up the front, remove the front wheels. Drill a hole in the inner wing somewhere handy, the instructions say a 3/8th drill. The grease nipple bolts here, and the copper pipe leads to the top of the Kingpin. Undo the existing oil-shot oiler pipe to the kingpin, replace with the copper pipe to the
grease nipple. Inside the engine bay, undo the other end of the oil pipes where they come from the one-shot pump. do the fittings back up without the oil pipe, with a ball bearing in their place (supplied in the kit), fill the new fittings with a (surprisingly large) amount of grease. You can use chain saw oil for greasing via the Phaeton kit, it gets in easier.

The different injuries resulting from a car accident can be as varied as the individual circumstances of each collision, but there are some types of injuries that are more common than others.

Some car accident injuries may resolve within a matter of days without any medical treatment at all. More serious injuries might become permanent and result in some level of physical disability.

The type and severity of injuries suffered by drivers and passengers involved in a car accident depend on factors that include:

  • Was the person wearing a seat belt?
  • Did the person s car get hit from the rear, side or front?
  • Was the occupant facing straight ahead in the seat? Or was the person s head or body turned in a certain direction?
  • Was it a low-speed collision or a high-speed crash?
  • Did the car have airbags?

There are two broad categories of injuries caused by car accidents: (1) impact injuries, and (2) penetrating injuries. Impact injuries are typically caused when part of the person s body hits some part of the interior of the car. Often this can be a knee hitting a dashboard or the head hitting the seat rest or the side window. Penetrating injuries are typically cuts and scrapes. Impact with a side window or steering wheel can cause scrapes and bruising to the head, or even deeper lacerations. More severe collision impacts can cause a closed head injury. In that situation, the fluid and tissue inside the skull are damaged because of the sudden movement or impact of the head. Less severe closed head injuries often result in concussions, while the most severe impacts can cause brain damage.

Chest Injuries

Chest injuries are also a common result of a car accident. These injuries typically take the form of contusions or bruises, but can be more severe, such as broken ribs or internal injuries. Drivers often experience chest injuries because of their position behind the steering wheel, which allows very little freedom of movement before the chest collides with the steering wheel. If a person s body is thrown forward in a collision, even though it might not impact the steering wheel or dashboard, the chest area will still experience a high level of force against the shoulder harness or seat belt, which can cause severe bruising.

Arm and Leg Injuries

The same forces that unexpectedly throw a person s head about in car collisions act similarly on arms and legs. If your car suffers a side impact, your arms and legs might be thrown hard against the door. While positioned as a passenger in a car, your legs typically have very little room for movement. Car accidents often cause an occupant s knees to hit the dashboard or seats in front of them. Depending on the nature of the collision, injuries to your arms and legs might be mere bruises or scrapes, but sprains and even breaks can occur.

#10. Ferrari 360 Modena

The driver of this 2004 Ferrari 360 Modena was trying to show off to his girlfriend when he lost control at 130 MPH on a country road in France. The car ran into power lines, bringing down live cables and snapping the car in two. Both driver and passenger were lucky to survive the crash.

Locals reported having seen and heard an Enzo being driven very hard the day before. Most likely it was the same car. Accident happened on October 30th, 2005.

The driver of this 1998 Dodge Viper was pushing 170 MPH when he lost control on a stretch of Arizona highway. After flipping a few times, the car slammed sideways into a pole.

This is the world’s highest known crash speed on open roads. There are only a handful of cars even capable of reaching these speeds. The driver was drunk and pushing the limits of this $1.3 million car on the Pacific Coast Highway when he lost control and crashed into a utility pole. Miracolously, he walked away from the accident.

Man survives car accident, gets hit by another car 10 minutes later


An Emirati national has been killed in a road accident, just 10 minutes after surviving another.

The Khaleej Times reported that the man had survived a car crash Wednesday, but was “ironically” killed just 10 minutes later in a separate accident.

Brig. Saif Muhair Al Mazroui, director of the General Department of Traffic, said the UAE national had suffered minor injuries when a car he was traveling in collided with a truck around 4 p.m. local time. A passer-by helped the injured man to the roadside to wait for an ambulance, but he was struck by another car shortly thereafter, killing him instantly.

Dubai’s busy freeways and high speed limit cause many accidents in the desert kingdom. The Gulf News reported that 26 people were injured in a multi-car crash on Emirates Road on the day after Christmas.

Two days later, police in both Dubai and Sharjah urged caution after 119 accidents were reported when a thick layer of fog enveloped the emirates.

In Sharjah, police reported an average of three deaths per week throughout 2016 — forcing police to lower the speed limit after more than 3,000 motorists were caught speeding beyond the original 75-mph limit on one weekend.

In Dubai, the number of people killed in “run over” accidents totaled 44, with another 303 injured. The road toll in the most liberal of the emirates stood at 174 deaths last year (up from 52).

But the most staggering statistic was the number of people fined for jaywalking, with police handing out 64,458 notices between January and November. March was the biggest month, with nearly 8,000 fined.

Should I buy a Cat D car, Cat C car or an insurance write-off?

When looking for a used car bargain, it’s not uncommon to find such expressions as ‘Cat C’, ‘Cat D’ and ‘insurance write-off’. These are most often, but not exclusively, encountered in classified adverts for cars at the cheaper end of the market, which are usually priced a lot lower than similar cars of the same age. But can they really save you money, or should Cat C and D cars be avoided?

The phrases ‘Cat C’ and ‘Cat D’ are both insurance-related and refer to a car being ‘written off’ as beyond economic repair. This happens when the cost of returning a car to the condition it was in before the insurance claim is seen as too great compared to its value. Generally, if repairing a damaged car costs over 50% of its value, an insurer will write it off, paying its owner an amount commensurate with its value before the damage occurred.

The car will then be given a category (Cat) marker from Cat A to Cat D. Categories A and B are reserved for those cars so badly damaged that they can’t be made safe to return to the road and must be crushed. Cat B cars can be used as a source of spare parts, however.

Category C and D cars are the ones you’re likely to find for sale in used car listings, and these can be repaired and used on the road, although they will always have a Cat C or Cat D marker attached to them. But what does this mean to you if you buy one?

What is a Cat D car or Cat C car?

Category D is reserved for the written-off cars with the least physical damage. Relatively common examples of these are cars that have been stolen and then recovered, requiring expensive parts such as locking mechanisms, ignition switches and keys. Vandalism is another possible cause of a Cat D write-off.

According to the Association of British Insurers (ABI), Category D write-offs are “repairable total-loss vehicles where repair costs including VAT do not exceed the vehicle’s pre-accident value”.

A Cat C car is more likely to have suffered impact damage, but not severe enough to be irreversible. The ABI states that Cat C cars are those where the “repair costs including VAT exceed the vehicle’s pre-accident value”.

A Cat D or C marker can sometimes be given to cars with relatively minor damage. A low-value car might be written off after a light scrape in a car park, simply because the cost of processing the insurance claim exceeds the car’s value.

The sale of Cat C and D cars has become big business, because motor traders can repair them cheaply and sell them at a profit.

Cat C and Cat D repaired cars – the process

First, the insurer will calculate what the claim will cost to process (including their administration time and the cost of providing a courtesy car) as well as what the car will cost to repair.

The insurer may consider it cheaper to write off the car if these costs exceed its value. The owner will be paid off or even given the chance to buy the car from the insurer so they can repair it themselves.

If the owner decides to take the money, the insurer will, assuming it’s a Cat C or D write-off, offer the car for sale at auction in order to get back its money.

Buying a Cat C car or Cat D car

It’s legal to sell a Cat C or D car as long as its status is declared. Even so, they’re much cheaper – possibly as much as 50% cheaper – because there’s a stigma attached to them and they’ll need repairing.

This stigma will remain with the car even after it’s repaired, because Cat C or D status stays with the vehicle and must always be declared when it’s offered for sale. This will mean it always fetches a lower price.

Not everyone is convinced about the merits of buying a Cat C or D car. Neil Hodson, managing director of car history check firm HPI. cautions that “the real risk with buying a write-off is paying good money for a vehicle that’s been badly repaired and is a danger to drive, or worse still, should never have been put back on the road in the first place. If a write-off hasn’t been properly repaired, any price is too high.” On the other hand, Hodson concedes “there are write-off categories that, if repaired professionally, offer good value for buyers”.

Others are more doubtful still. Trading Standards officer Gerry Taylor says that buyers should avoid Cat C and D cars since the risk they haven’t been repaired properly is too high and an imperfect repair could affect crash performance.

Write-off engineer reports

Despite all this, you may still want to buy a Cat C or D car. In that case, have it inspected by a trained motor engineer employed by organisations such as the AA and RAC.

The engineer will inspect the car and tell you all you need to know about its condition, crashworthiness and any problems lurking within it that aren’t obvious to the untrained eye.

It won’t be cheap, but if the worst happens a report could be offered as evidence in court. In any case, insurers generally insist on an engineer’s report before they’ll consider insuring a Cat C or D vehicle.

Selling a Cat C car or Cat D car

You must declare the car’s Cat C or Cat D status when selling it or part-exchanging it. If you don’t, the new owner could sue you for damages.

Insuring a Cat C car or Cat D car

Don’t expect insuring your Cat C or D car will be straightforward. Some insurers won’t consider covering such a car and those that do may charge a higher premium. An engineer’s inspection report will certainly smooth the way.

What the law says

Thanks to the Consumer Rights Act 2015, car buyers are better protected, since the law states that any goods purchased should be ‘of satisfactory quality’, ‘fit for purpose’ and ‘as described’.

If you were unwittingly sold a car the seller knew to be a Cat C or D, the seller is in breach of the last requirement. Even if the seller was unaware of the car’s status, it’s still not of satisfactory quality or fit for purpose. It also falls foul of the ‘innocent misrepresentation’ clause of the Misdescriptions Act.

Either way, you would have grounds to take legal action against the seller.
Of course, they may immediately offer you a refund, but you’d be wise to tell Trading Standards to protect future customers.

Cat C and D cars used to have to undergo a Vehicle Identity Check, or VIC, before being allowed back on the road. This was intended to stop criminals selling disguised write-offs to ignorant buyers, but it identified so few cars that it has been abandoned.

Classifications of write-offs

Category A: Cat A cars have been so badly damaged that the entire car must be crushed.

Category B: Cat B cars can’t be returned to the road and their bodyshell must be crushed, although usable parts may be sold and reused on other cars.

Category C: Cat C cars can be put back on the road after being repaired, but these repairs (and any auxiliary costs) have been assessed to exceed the car’s pre-damage value. You must declare a Cat C car’s status when you sell or insure it.

Category D: Cat D cars are deemed to have suffered damage that would cost less than the car’s pre-incident value to repair. After appropriate repairs have been made, Cat D cars can be returned to the road – although as with Cat C cars, you’re legally obliged to declare this to insurers and buyers.

Specifically, we looked at hours spent in traffic per year for the average driver, the annual cost of traffic for the average driver, the rate of motor vehicle theft, the number of repair shops and parking garages per driver, the commuter stress index and the non-driving options a resident has for getting around. (See our methodology section for more information on how we created our final ranking.)

Cities on the coasts. The nine cities that make the list are all on or close to the coasts. This makes sense, as many of the largest cities in the country are located on the coasts. Plus, on the East Coast in particular, these cities tend to be older, which means they weren’t built to handle car traffic.

Grin and bear it. Traffic can get pretty bad. However, in some cities getting around by car is just about the only option you have if you want to leave your house. As a result, some cities with terrible traffic, such as Los Angeles, didn’t make the list.

9. Seattle, Washington

Seattle has pretty bad traffic. Commuters here probably aren’t surprised to hear the average driver spends 63 hours per year in traffic. And coupled with the traffic is the high number of motor vehicle thefts. Seattle has the fourth-highest rate of motor vehicle thefts per 1,000 residents in the country.

8. New York, New York

New York is the rare American city where public transportation is usually your best bet for getting from point A to point B. All that accessibility makes car ownership unnecessary here. For New Yorkers who do drive, the traffic is not pleasant. New York drivers spend $1,700 per year, on average, waiting in traffic. That’s the third-highest cost in our study.

7. Anaheim, California

Anaheim commuters are well-acquainted with traffic. Anaheim (and the rest of the Los Angeles metro area) ranks third in average hours per year spent in traffic, first for commuter stress index and fifth for annual cost of idling in traffic. Anaheim only ranks seventh because Walkability.com gives the city a 46 out of 100 for non-driving options. That’s the lowest score in our top 10, meaning, while owning a car here is a pain, not owning one makes getting around a real struggle.

6. Portland, Oregon

Of all the cities in our top 10, Portland is the least onerous for the driving commuter. Commuters driving around the Portland metro area can be thankful that, on average, they spent only 52 hours per year in traffic. That traffic still costs each driver about $1,200. However, drivers in Portland looking for a parking garage may be out of luck. Portland has the second-lowest number of parking garages per driver in our study, and if you are looking to get your car fixed, Portland ranks in the bottom 13 for repair shops per capita.

5. Arlington, Virginia

As previously mentioned, the Washington, D.C. metro area has the worst traffic in the country. Unfortunately for the residents of Arlington, they are a part of that metro area. They face the same brutal 82 hours per year spent in traffic, on average. It costs Arlington residents $1,834 per year, on average, waiting in that traffic. For residents of Arlington, a car is more of a necessity than it is for people living in D.C. which is why it ranks lower in our study.

4. Oakland, California

One argument against car ownership in Oakland is the crime. In 2014, there were almost 6,400 motor vehicle thefts in the city of Oakland, or 15 auto thefts per 1,000 residents. That’s the highest rate in the country. The average Oakland driver can also expect to spend 78 hours per year in traffic. On the plus side, if something goes wrong with your wheels in Oakland, it shouldn’t be too difficult to get it fixed. There are more than six repair shops per 10,000 drivers in Oakland – the highest rate in the top 10.

3. Washington, D.C.

The District and the surrounding metro area sees some of the worst traffic in the country. The average D.C. commuter spends 82 hours per year in traffic. Depending on how you slice it, that’s either two working weeks or almost three-and-a-half days of doing nothing but shaking your fist at your fellow drivers. That traffic is equal to an annual cost of $1,834 per commuter.

2. San Francisco, California

The “City by the Bay” grabs the second spot for worst places to own a car. Being stuck in traffic costs the average commuter in San Francisco $1,600 per year. That cost includes both the value of the time spent in traffic and the cost of gas. San Francisco is also one of the 10 worst cities for motor vehicle thefts per resident, another reason to forgo car ownership.

1. Newark, New Jersey

“Brick City” tops our ranking of the worst U.S. cities to own a car. What’s tough about being a car owner in Newark is the traffic. It’s part of the New York City metro area, which has 19 million people, 5 million of whom drive to work. Newark is stuck right in the middle of this bumper-to-bumper traffic. Plus, if you’re a car owner in Newark, the risk of having your car stolen is much higher than it is in other cities. Newark ranks eighth in the country for motor vehicle thefts per 1,000 residents.
