The 11/14 Hour Truck Driving Rule

Recently I received an e-mail asking me to explain the very confusing 11/14 hour truck driving rule. As you know, this is the rule which tells the driver how many hours he/she may work, when to break, how long to break, and how many hours of driving that he/she may drive during a 24 hour period.

Here is my reply to her that I would like to post for all new drivers:

This is a real simple rule that sometimes people can make harder than it really is .me included, when it first came out. In a nutshell it simply states that you cannot work more than 14 hours in a 24 hour period and cannot drive more than 11 hours in a 24 hour period, without taking a 10 hour break.

Work means the same as on duty As soon as you start your pre-trip, you are on duty .you have 14 hours to be on duty from that moment on, before you are required to shut down for your 10 hour break.

So, if you start your pre-trip at 6 AM, you have to be stopped, shut down, done! by 8 PM. Your on duty work includes, pre-tripping, post tripping, driving, unloading, loading, waiting time, stopping for a meal, bathroom break, stopping to make a phone call ANYTHING you are doing between the pre-trip and post trip .this is your 14 hours you have to complete your day s work.

Example. Let s say you start your pre-trip at 10 AM. and you drive over to the shipper to get loaded and you get there at 10:30 AM, and they tell you it will take about 5 hours to get loaded. You are finally loaded at 3:30 PM. You now only have until midnight to drive or whatever , before you must shut down for the 10 hour break. You will be completely legal because you shut down at midnight, which is 14 hours (10 AM to Midnight) and you only drove 9 hours (10 AM to 10:30 AM, and 3:30 PM to Midnight) even though you are 2 hours under the 11 hour driving rule, the 14 hour rule beat you to the punch because of the waiting time the shipper placed on you.

Just remember, whatever time you start the day on your log, you have to be completely shut down (break), within 14 hours. Now, if you start your pretrip at 10 AM, arrive at shipper at 10:30 AM, and are loaded by 11 AM, you can drive until 9:30 PM (11 hour rule 10-10:30, 11-9:30), .even though 14 hours is midnight (10 AM to midnite), the 11 hour rule beat you to the punch you can still be on duty through midnight, like waiting to get unloaded, calling dispatch, repairing a trailer tire etc. you JUST CAN T DRIVE anymore.

After 14 hours you should be doing only one thing. on a 10 hour break. Just because you hit 11 hours of driving, you can still be doing work-related duties, as long as you are not driving AND once you hit the 14 hour spot you must be shut down, totally, and be on your 10 hour break.

Remember two things :

1. Be shut down (on your break) within 14 hours of starting your log.

2. Within that 14 hours, make sure you have not driven more than 11 hours.

NOW! There is also the 34 hour rule! But this is easy if you are off duty for at least 34 hours, all your hours beforehand are erased and you can start clean with another 70 hours. There is talk about doing away with this rule, but for now, it is still on the books.


Since I am constantly receiving emails from those who only wish to criticize and attempt to prove something to themselves, I would like to address a recent email I received:

Here is the email I just received:

I read, The 11/14 Hour Truck Driving Rule quot;, it is incorrect. You state that after your 14th consecutive hour on duty you must be off duty or in the sleeper berth, not true. The law states a driver must not drive after his 14th hour on duty, nothing about working. Any work as unloading, post trip, fueling are fine to do after your 14th hour. Please make sure you know the law prior to acting like an authority. Thanks.

Now, if this guy had really read the post, then he would have seen the following paragraph within this post:

Yes, you are correct. You are referring to Reg. 395 (d) –

D-1. May a driver be on duty for more than 14 consecutive hours?

Yes. A driver may remain on duty for more than 14 hours; however, the driver of a property-carrying CMV cannot drive after the 14th hour after coming on duty. Also, the additional on-duty time will be counted toward the 60/70-hour on-duty limit. But, as you mentioned, MOST companies require you to be shut down by the 14th hour. Every company I’ve ever worked for, even now, require you to be completely done by the 14th hour. So that is why I explained it this way. With a former company I was driving for, I did go over the 14 hours, legally….but I was still called in by the log and safety dept. Even though I explained to them what I did was legal, I was still “slapped” on the hand for doing it! LOL … but again, you are right….it is just that most companies want you “shut down” by the 14th hour……thanks for your post…..I appreciate it!

CORE-AT Electronic Medical Record and
Injury Surveillance System

The CORE-AT electronic medical record (EMR) system is a web-based injury surveillance and EMR system for use by athletic trainers. The CORE-AT EMR was designed and developed by athletic trainers in partnership with Essentialtalk. an international technology communication company.

The CORE-AT EMR is compliant with the data acquisition, storage, and transmission standards set forth by the Health Insurance Portability and Accountability Act (HIPAA).

Health information obtained using the CORE-AT system are not stored locally on computers. Instead, data is uploaded in real-time and transmitted to secure, redundant servers.

System Capabilities

The CORE-AT EMR system consists of documentation capabilities including individual patient/athlete registration (e.g. sex, age, grade), injury demographics (e.g. sport, season, position), comprehensive patient evaluation (e.g. diagnosis, injured body part, side, mechanism of injury), and daily treatment, progress, and discharge (e.g. athletic training interventions, rehabilitation protocols, date of return-to-play) notes.

A necessary feature of the patient record is the ability to assign ICD-9 CM and CPT codes to patient diagnoses and treatments, respectively, to enable the characterization of secondary school athletic training practice and for creating cost-estimates for secondary school athletic training services.

Also included in the system are single and multi-item patient-oriented outcome measures, both generic and region specific. Outcome instruments are automatically generated and included as part of the patient evaluation process based on diagnosis and injury region. An automated system not only assures collection of appropriate patient information but also promotes the use of outcome instruments as part of standard athletic training practice.

Injury Surveillance

In addition to the capabilities of the CORE-AT system to collect patient outcomes, CORE-AT is also constructed to capture and integrate injury surveillance information specific to athlete injury and exposure (e.g. incidence, athlete-exposure, time loss/non time loss, sports participation).

With the surveillance component integrated directly into the medical record, information such as time loss/non-time loss, diagnosis, mechanism of injury, sport, and position are all collected and recorded during the initial evaluation, without the need for double entry. Data regarding athlete exposures are also captured and made available to the clinician.

The Ups and Downs of Electronic Medical Records – The Digital Doctor

The case for electronic medical records is compelling: They can make health care more efficient and less expensive, and improve the quality of care by making patients’ medical history easily accessible to all who treat them.

Small wonder that the idea has been promoted by the Obama administration, with strong bipartisan and industry support. The government has given $6.5 billion in incentives, and hospitals and doctors have spent billions more.

But as health care providers adopt electronic records, the challenges have proved daunting, with a potential for mix-ups and confusion that can be frustrating, costly and even dangerous.

Some doctors complain that the electronic systems are clunky and time-consuming, designed more for bureaucrats than physicians. Last month, for example, the public health system in Contra Costa County in California slowed to a crawl under a new information-technology system.

Doctors told county supervisors they were able to see only half as many patients as usual as they struggled with the unfamiliar screens and clicks. Nurses had similar concerns. At the county jail, they said, a mistaken order for a high dose of a dangerous heart medicine was caught just in time.

The first national coordinator for health information technology, Dr. David J. Brailer, was appointed in 2004, by President George W. Bush. Dr. Brailer encouraged the beginnings of the switch from paper charts to computers. But in an interview last month, he said: “The current information tools are still difficult to set up. They are hard to use. They fit only parts of what doctors do, and not the rest.”

Long before computers, many hospitals and doctors charged for services in ways that maximized insurance payments. Now critics say electronic records make fraudulent billing all too easy. and suspected abuses are under investigation by the Office of the Inspector General at the Department of Health and Human Services.

Like all computerized systems, electronic records are vulnerable to crashes. Parts of the system at the University of Pittsburgh Medical Center were down recently for six hours over two days; the hospital had an alternate database that kept patients’ histories available until the problem was fixed.

Even the internationally respected Mayo Clinic, which treats more than a million patients a year, has serious unresolved problems after working for years to get its three major electronic records systems to talk to one another. Dr. Dawn S. Milliner, the chief medical informatics officer at Mayo, said her people were “working actively on a number of fronts” to make the systems “interoperable” but acknowledged, “We have not solved that yet.”

Still, Dr. Milliner added that even though there a lot of challenges, the benefits of information technology are “enormous” — improved safety and quality of care, convenience for patients and better outcomes in general.

Patients at Mayo’s headquarters in Rochester, Minn. and its Arizona and Florida sites can see their records online, even via an iPhone app; those in Mayo’s network of doctors’ offices and hospitals in the upper Midwest will eventually have similar access.

In the rare event that a large-scale system goes down at Mayo, backup measures are ready, teams are called in to make rapid repairs, and if necessary “everyone is ready to go on paper,” Dr. Milliner said.

Reliable data about problems in the electronic systems is hard to come by, hidden by a virtual code of silence enforced by fears of lawsuits and bad publicity. A recent study commissioned by the government sketches the magnitude of the problem, calling for tools to report problems and to prevent them.

Based on error rates in other industries, the report estimates that if and when electronic health records are fully adopted, they could be linked to at least 60,000 adverse events a year.

The report. to the Agency for Healthcare Research and Quality, analyzed ways of forestalling hundreds of information technology “hazards” at seven hospitals and health systems. A typical example would be drug orders transmitted by an electronic app to a pharmacy using a different app.

“It’s hard to keep them speaking the same language, to automatically link a medication in one app to exactly the same medication and dose in the other app,” said Dr. James M. Walker, chief health information officer of the Geisinger Health System, who led the study.

The Obama administration will issue a report on patient safety issues in early November, the current national coordinator, Dr. Farzad Mostashari. said in an interview. That report was requested last year by a panel on health I.T. safety at the Institute of Medicine. a unit of the National Academies of Science.

The institute recommended that the government create an independent agency like the National Safety Transportation Board to deal with patient safety issues, and it called for an end to “hold harmless” clauses that protect software manufacturers from lawsuits but can limit the freedom of doctors and hospitals to publicly raise questions about errors or defects.

Elisabeth Belmont, a lawyer for the MaineHealth system, based in Portland, advises hospitals to reject contract language that could leave them responsible for settling claims for patient injuries caused by software problems. “One software vendor was surprised when my client opted to walk away and purchase the software from another vendor who had a more reasonable approach on these issues,” she said.

The institute also recommended that software manufacturers be required to report deaths, serious injuries or unsafe conditions related to information technology. So far, however, neither a new safety agency nor such a reporting system has been adopted.

Some of the largest software companies have opposed any mandatory reporting requirement. But Gail L. Warden, chairman of the institute’s patient safety panel, said in an interview that the industry was divided on the issue; some companies were accustomed to regulations for their widely used medical devices for imaging, for example.

Critics are deeply skeptical that electronic records are ready for prime time. “The technology is being pushed, with no good scientific basis,” said Dr. Scot M. Silverstein, a health I.T. expert at Drexel University who reports on medical records problems on the blog Health Care Renewal. He says testing these systems on patients without their consent “raises ethical questions.”

Another critic, Dr. Scott A. Monteith, a psychiatrist and health I.T. consultant in Michigan, notes that Medicare and insurance companies generally do not pay for experimental treatments that have not proved their effectiveness.

A Medicare administrative contractor, National Government Services, said recently that it would deny payment for treatments using “cloned documentation” copied from electronic records rather than individualized patient notes composed by doctors and nurses to show medical necessity. Dr. Monteith said the electronic systems were “disrupting traditional medical records and, beyond that, how we think” — the process of arriving at a diagnosis. For example, the diagnosing process can include “looking at six pieces of paper,” he said. “We cannot do that on a monitor. It really affects how we think.”

Deborah Burger, a registered nurse for more than 30 years who works with pain medicines and anti-anxiety drugs for colonoscopy patients, said electronic systems offered “drop-down menus of so-called best practices.”

“The problem is each patient is an individual,” said Ms. Burger, who is president of the California Nurses Association. “We need the ability to change that care plan, based on age and sex and other factors.”

She acknowledged that the system had one advantage: overcoming the ancient problem of bad handwriting. “It makes it easier for me to read progress notes that physicians have written, and vice versa,” she said.

Some experts said they were hopeful that the initial problems with electronic records would be settled over time. Dr. Brailer, who now heads Health Evolution Partners, a venture capital firm in San Francisco, said that “most of the clunky first-generation tools” would be replaced in 10 years. “As the industry continues to grind forward, costs will go down,” he said. “Tools are being simplified.”

Mark V. Pauly, professor of health care management at the Wharton School, said the health I.T. industry was moving in the right direction but that it had a long way to go before it would save real money.

“Like so many other things in health care,” Dr. Pauly said, “the amount of accomplishment is well short of the amount of cheerleading.”

Why small medical practices lag in EMR adoption

Although a growing percentage of physician practices are adopting electronic medical records, a large gap persists in adoption rates between the smallest and largest practices.

Small practices are not averse to adopting technology, analysts said. But the cost of systems, confusion about federal incentives for using them and the practice disruption they might cause are holding back their EMR adoption rates.

SK A, a marketing research firm in Irvine, Calif. released a survey on Oct. 24 that found 40.4% of physician offices used EMRs as of July, up from 38.7% in October 2010. SK A surveyed 237,862 medical sites.

The larger the practice, the more likely it was to use an EMR. According to SK A, 75.5% of practices with 26 or more physicians used EMRs. For solo practices, that number was 30.8%. Only 41.6% of practices with two physicians used EMRs, and 51% of those with three to five physicians did.

Jack Schember, spokesman for SK A, said about 72% of all practices are solo (55%) or two-physician practices (16.6%), which is why the overall EMR adoption was not higher.

He said meaningful use incentives have even solo practices at least considering EMRs. The Health Information Technology for Economic and Clinical Health Act, a provision of the 2009 economic stimulus package, allows practices to earn up to $44,000 per physician over five years from Medicare or nearly $64,000 over six years from Medicaid if they show meaningful use of EMRs. Payments began in 2011. “It’s got them thinking,” he said. “It’s got the wheels turning.”

However, “at the same time, those smaller practices are still thinking about when,” Schember said. “Those first initial payments are, apparently, not enough to light a fire under them to make an immediate decision.” According to SK A, 72.6% of practices that haven’t adopted EMRs don’t have a time frame in mind.

Experts said small practices still face much uncertainty about buying EMRs. Depending on the system, the incentive payments being offered under meaningful use might not be enough to cover its cost. (In the SK A survey, 16.7% of those who didn’t buy systems said cost was the major factor.) Schember said physicians also are weighing the impact an implementation can have on a practice. “Is there a payoff in efficiency? Is there a payoff in terms of better patient services? What’s the analysis of this cost versus the benefit?” he said.

The purchase price is not the only issue. Many physicians don’t know the rules regarding EMRs and payment incentives.

The SK A survey found that many aren’t even aware the meaningful use incentives exist. Of those surveyed, 21% were not familiar with the government incentive program. A division of the Dept. of Health and Human Services said it is trying to reach those practices, particularly through the use of regional extension centers, created in the HITECH Act.

“Reaching small practices with limited resources is difficult, and [the Office of the National Coordinator for Health Information Technology] has recommended that RECs start by focusing on the most at-risk communities,” the ONC said in an emailed statement to American Medical News. “According to SK A data, the RECs have enrolled over 70% of the small-practice providers that are in rural communities.”

The ONC, which is a client of SK A and gets its adoption data directly from the research firm, also said the percentage of practices unaware of the incentive program fell from 24.7% in 2010.

Under the HITECH Act, $677 million was allocated for creating 62 regional extension centers to help spread the word about the incentive program to small practices and help them achieve meaningful use. They had a goal of reaching 100,000 physicians.

Many of the RECs received their funding a few months ago and are just now getting started. During the past two months, Schember said he has seen evidence of the RECs stepping up their marketing.

But even those that had early success with signing up practices for their services say it’s too soon to see the benefits, or to see adoption rates rise.

Of the more than 1,100 physicians signed up with his REC, more than 800 had an EMR already, said Randy Bordelon, program manager for Mississippi Regional Extension Center, which serves the state of Mississippi. In the past year and a half, 30 practices affiliated with Mississippi REC have implemented an EMR for the first time. Mississippi REC has had only eight practices attest for meaningful use so far.

He said many practices contracted with Mississippi REC are participating in the Medicaid incentive program. Practices don’t have to have their EMR systems implemented to qualify for the first installment of the Medicaid incentive. The Medicaid incentives are being facilitated at the state level, and many states are still launching their programs, which would mean a delay for the practices hoping to qualify for those incentives.

Though the incentive program was meant to stimulate adoption rates, the Centers for Medicare Medicaid Services did not want to penalize those who were already using the technology. So few people were surprised to see the early recipients of the incentive pay were those who were already using EMRs.

The Center for Public Integrity’s online publication iWatch News reported in October that the first batch of payments through the Medicare program totaled $75 million and went to about 320 hospitals and doctors. About half of those who responded to a survey had implemented the technology years before the incentive program was launched.

Brenda Gleason, president and founder of M2 Health Care Consulting, a Washington-based strategic policy and research firm, said it’s too early for the incentive plan to have an impact on adoption rates for practices implementing for the first time, especially small practices.

Even those practices that signed up for services offered by the RECs are still struggling with the fact that EMR adoption “wreaks havoc with the practice flow — there’s no question about that. So you have to decide in your own practice when is the best time to do that,” Gleason said.

She said many physicians are confused about the Patient Protection and Affordable Care Act and its relationship to the meaningful use incentive program. Many physicians don’t know where the money for the incentive program comes from and whether it will be there if health reform is deemed unconstitutional, she said. Various court cases have challenged the legality of the health reform law.

She tells physicians over and over, “They are not related; they are not even part of the same piece of legislation.” But, especially in states where there has been a big push-back on the health reform law, “it is affecting some of the meaningful use take-up.”


Technical divide by practice size

In a nationwide survey of practices released Oct. 24, SK A, a market research firm, found that the electronic medical records gap between large and small practice persists. Overall, 40.4% of physician offices reported using EMRs in July, up from 38.7% in October 2010.
