Illinois taxpayers have funded about $2 million in retention bonuses for employees of a private firm managing the lottery despite the firm performing so poorly Illinois is working to replace it. A Tribune investigation has found the state approved paying bonuses as part of a complicated deal.

Warning that pharmacies are putting profits over people, a drugstore pharmacist urged Chicago aldermen on Tuesday to approve a city proposal designed to improve customer safety by easing pressure on pharmacists to speed through prescription orders and limiting their work hours. Jeremy Aguila.

As pork producers exploit weak laws to build and expand large hog confinements across rural Illinois, neighboring farmers have complained their rights are being trampled while waste spills poison local streams and sickening gases ruin families lives and property values. But after years of frustration.

Ending decades of denial and inaction, the federal government on Friday issued a tough new exposure standard for one of the most unusual and deadly occupational risks U.S. workers have ever faced: the toxic metal beryllium. Because of beryllium s remarkable properties — it is lighter than aluminum.

The director of the Illinois Lottery was dumbfounded. In June 2013, Michael Jones had just learned the firm hired to manage the lottery wanted to stop selling a scratch-off he considered the most popular new game in years. It had a catchy name — Birthday Surprise — and a creative grand prize: $150,000.

Gravel crunching beneath their wheels, cars and pickup trucks pulled up at twilight around the one-room schoolhouse in Bernadotte Township. A powerful pork company was planning a 20,000-hog confinement near the storied Spoon River in western Illinois, and a dozen neighbors were gathering to fight.

Two residents who went missing from now-shuttered group homes for adults with developmental disabilities have been found. Attorneys for the state, though, alleged in Cook County court Wednesday that an employee from the group home business, which lost its license last month, had actively concealed .

A man with developmental disabilities who had been missing since the state revoked the license of his group home provider weeks ago was found wandering Chicago s streets in the cold Wednesday night. Another man was discovered outside his old group home, attorneys for the state revealed Thursday.

Gov. Bruce Rauner has ordered state agencies to examine how to bolster accountability at drugstores and protect the public s health following a Tribune investigation that found pharmacists failed half of the time to warn about dangerous drug interactions. The Republican governor s move came as.

The Tribune reporter walked into an Evanston CVS pharmacy carrying two prescriptions: one for a common antibiotic, the other for a popular anti-cholesterol drug. Taken alone, these two drugs, clarithromycin and simvastatin, are relatively safe. But taken together they can cause a severe breakdown.

Citing a Tribune investigation into dangerous drug interactions, the head of the nation s top association of pharmacy regulators is urging states to enact tough laws to require pharmacists to counsel patients when they pick up medications. Counseling has to occur, said Carmen Catizone, executive.

In a stunning admission, the chief executive of a troubled network of group homes told a judge Friday that he didn t know the whereabouts of six of his residents with developmental disabilities. It also wasn t clear that any of the six had their medications with them when they left homes run by.

Citing the possibility of irreparable injury, a Cook County judge Tuesday gave a troubled group home business four hours to turn over 18 adults with developmental and intellectual disabilities so they could be moved to safer homes. The decision seemed to end a standoff between Disability Services.

A Cook County judge Monday refused to halt a state shutdown of a troubled network of group homes for adults with developmental and intellectual disabilities. In its Suffering in Secret series, the Chicago Tribune last month exposed grave problems, including deaths and injuries linked to neglect.

The Illinois Department of Human Services has revoked the license of a group home provider that was spotlighted in a Chicago Tribune investigation this month, citing the state-funded business for safety problems and willfully violating the rights of individuals with developmental and intellectual.

A decade after one of the most damaging scandals in Chicago police history broke, two of the officers accused of wrongdoing remain on desk duty at full pay, filing papers or answering phones as they await the outcome of the city s slow-moving and much-criticized disciplinary process. Illinois Civil Statutes of Limitations

    Updated April 13, 2016

A statute of limitations sets the period of time someone has to take some kind of legal action. Statutes of limitation, for example, set deadlines for suing. When a plaintiff misses the cutoff, the defendant can use the statute of limitations as a defense against the suit. If the defendant establishes that the statute of limitations applies and has indeed run, the court will normally dismiss the case.

(This article is about statutes of limitations in Illinois civil cases. For information about criminal cases, see our article on criminal statutes of limitations in Illinois .)

    Time Limits on Claims

For statute-of-limitations purposes, the clock normally starts to tick when the claim arises. Courts sometimes refer to this starting point as the accrual of the cause of action ; it s the moment at which the plaintiff has a basis to sue. (Certain events and circumstances can delay or toll statutes of limitations, essentially lengthening the time period for bringing a claim.)

Assume one person wants to sue another for assault and battery. Assume also that the statute of limitations for assault and battery is two years. In a typical case, the plaintiff would have two years from the date of being hit by the defendant to file suit.

Statutes of limitations can vary from state to state, and from state court to federal court. They also differ depending on the kind of action involved.

    Statutes of Limitations in Illinois

Below you ll find statutes of limitations for several claims in Illinois. You can see the statutes to learn more and to look for changes to them. (Be aware that court rulings determine the way statutes are interpreted; they can even make statutes or parts of them unenforceable.)

Keep in mind that the following is a partial list with broad overviews; you should look at the actual law for nuances and exceptions. For example, whether because the statute says so or a court has decided as much, a limitations period can start to run from the point that the plaintiff knew or should have known of an injury rather than the date of the injury itself. A statute might even provide, for instance, that you have two years to bring an action from the date you knew or should have known that you suffered some kind of harm, but in no event do you have more than six years from the date of the event in question. Examining the law would provide you with that level of detail.

Also, even if one of the causes of action below seems to apply, you might have grounds for a different or an additional claim with its own statute of limitations. Not only that, but a more specific statute of limitations than what s below could control your case perhaps a statute of limitations for mortgage foreclosure rather than one for contracts.

Make sure to consult a lawyer for a better understanding of all time limits that apply to your situation and any possibilities for overcoming them. Rules might differ when the action is against the government. Or you might have to file a particular kind of claim before being able to sue. In short, the law in this area is complicated.

Total Loss Auto Claims with Your Insurance Company

    Updated September 2009

Note: This information was developed to provide consumers with general information and guidance about insurance coverages and laws. It is not intended to provide a formal, definitive description or interpretation of Department policy. For specific Department policy on any issue, regulated entities (insurance industry) and interested parties should contact the Department.

When you are involved in an automobile accident, one of the first things you may have to do is file a claim with your insurance company for damages to your vehicle. If your car is a total loss, this procedure can sometimes be confusing. The Department of Insurance has established regulations (50 Illinois Administrative Code, Part 919) to protect you when you file an insurance claim with your own insurance company. It is also important that you read your policy carefully so that you clearly understand your responsibilities.

Your automobile insurance policy requires both you and your insurance company to follow certain steps after a loss occurs. This fact sheet summarizes those requirements and outlines your rights. If the insurance company declares your car a total loss, they must provide you the following information within seven (7) days.

Your Duties Following An Auto Insurance Loss

    1. You must immediately report all losses directly to your insurance producer or company.
    2. If you suspect theft or vandalism, you must also report it immediately to the police. If you fail to do so, your company may deny your claim.
    3. You must protect your automobile from further damage. For example, if you fail to cover a broken windshield and the upholstery is damaged by rain, your company can refuse to repair the seat.
    4. Most insurance policies require that, within 91 days after the loss, you must submit a sworn proof of loss. A sworn proof of loss usually states the date of loss, how it happened, and for what purpose the automobile was being used. If you fail to submit a proof of loss, your company may deny your claim.
    5. You must cooperate with the insurance company, submit to examination under oath if so requested, and show them the damaged property. If you fail to cooperate your company may deny your claim.
    6. You should review the Conditions section of your policy for other possible requirements.

    Your Insurance Company’s Duties

When you file an automobile insurance claim, your insurance company has three options:

    1. Replace the damaged or stolen property;
    2. Repair the damaged property; or
    3. Pay for the loss in cash.

Insurance Department regulations require the company to follow certain standards for each option.

    Replacement

If the insurance company elects to replace your vehicle, the replacement must be a specific make and model comparable to your totaled vehicle, and it must be available in as good or better overall condition than your totaled vehicle. Replacement vehicles must be purchased through licensed dealers. Vehicles that are not more than three years old must be warranted.

If you reject a replacement vehicle, the insurance company must pay only the amount it would have otherwise paid for the replacement vehicle including applicable taxes, transfer and title fees. The company must offer you the replacement vehicle and you must reject the offer.

    Cash Settlement

If the insurance company elects to make a cash settlement for your totaled vehicle, they must first determine its retail value. Companies normally use guidebooks or computerized data marketed by various sources.

If your vehicle is not listed in one of these sources, the company can use written dealer quotes. Ordinarily, however, newspaper advertisements are not acceptable sources of market value.

    Payment of Sales Tax

If within 30 days of a cash settlement, you can prove that you have bought or leased another vehicle, the company must pay the applicable sales tax, transfer and title fees in an amount equivalent to the value of the total loss vehicle. If you purchase a vehicle with a market value less than the amount previously settled upon, the company must pay you only the amount of sales tax that you actually incurred and include transfer and title fees. Your insurance company must give you written notice of this procedure.

    Betterment Deductions

The insurance company is allowed to make deductions from the retail value if your automobile has old, unrepaired collision damages. There is no limit to the amount of the deduction. The insurance company can also make deductions for wear and tear, missing parts and rust, but the maximum deduction may not exceed $500.00. All deductions must be itemized and specified as to dollar amount.

    Retaining Your Totaled Vehicle

In an effort to minimize automobile chop shop crime, the Illinois Vehicle Code does not permit you the right to retain the salvage once the insurance company has deemed your automobile a total loss. There are only two instances that you may be able to retain your vehicle: 1) if the vehicle has incurred only hail damage that does not affect the operational safety of the vehicle, or 2) if the vehicle is nine (9) model years of age or older.

    Right of Recourse

If you cannot locate a replacement vehicle within 30 days of receiving a cash settlement, you may have some additional rights under your insurance contract.

If you cannot purchase a substantially similar vehicle for the market value determined by the company, but you have located a substantially similar vehicle that costs more, the following procedure(s) shall apply:

    1. The company shall either pay you the difference between the original settlement and the amount of the substantially similar vehicle which you have located or attempt to purchase this vehicle for you; or
    2. The company shall locate a comparable vehicle for you at the market value determined by the company at the time of settlement; or
    3. The company shall conclude the loss settlement as provided under the appraisal section of the insurance policy.

Your insurance company must give you written notice of this procedure once your vehicle has been determined a total loss. This chart should assist you in determining the retail value of an average automobile. The value of your automobile may differ if certain options are not listed in a guidebook or if your automobile has excessive wear and tear or old unrepaired damage.

    How to Start a Business

    Opening a Hospice Services Business

What are the steps required to open a hospice services business? We cover everything you need to think about before starting a hospice services business.

Thinking about opening a hospice services business? We tell you what you need to know to get started.

Hospice and palliative care providers ease the end of life process for patients and families. Once an underserved segment of the healthcare industry, more and more hospice service businesses are arising to keep pace with the aging U.S. population.

Motivation is an important factor in the success of a hospice services business startup. Hospice providers are true professionals whose dedication to patient care far outweighs their motivation for profit. Hospice services can be profitable, but your primary concern must always be the quality of care that is being provided to your patients.

Hospice service can be provided in either a residential or visiting hospice setting. For most startups, in-house hospice care is preferable to a residential care environment because it eliminates the capital and licensing requirements associated with a first-rate facility.

Hospice workers are tasked with providing a broad range of services to their clients. Counseling and advisory services are typical job functions, but hospice providers may also be tasked with coordinating the services of medical professionals and religious leaders for pain management, medical care, and spiritual guidance.

The most successful hospice care providers are brilliant networkers who have existing relationships within the medical and religious communities Although your network will expand as your hospice service grows, it’s beneficial to be familiar with the major players in your community before you launch your business.

Startup owners should also realize that hospice care is strictly regulated. Staff licensing and certifications are mandatory, so you will need to research applicable state and federal regulations. For more information about the requirements for nursery and caregivers, contact the National Board for Certification of Hospice & Palliative Care Nurses.

How to Draft a Hospice Services Company Business Plan

We know – writing a business plan can be a daunting task for a new entrepreneur.

But here’s the good news: With a few tips, any entrepreneur can create a successful plan for their business. In its simplest form, a business plan is a document that describes your company’s goals and your strategy for achieving them.

Once your business plan is in place, you can use it for a variety of funding and planning functions.

If you still aren’t sure where to begin, consider taking a look at several sample business plans to get the creative juices flowing.

    Look Over the Competition

Before you open a hospice services business in your town, it’s a smart move to find out how you will fit in the competitive landscape. We’ve provided the link below to help you generate a list of competitors in your area. Just enter your city, state and zip code to get a list of hospice services businesses in your community.

How tough is the competition in the market you are considering? If the competition is too tough, you may need to think about starting the business in a different area or even start a completely different business instead.

    Studying the Market

If you want to open a hospice services business the next step is to learn as much as you can from somebody who is already in the business. It’s very unlikely that the local competition will talk to you. What’s in it for them?

On the other hand, an individual who has a hospice services business outside of your community can be a great learning resource for you, provided that you won’t be directly competing with them. In that case, the business owner may be more than happy to discuss the industry with you. Our estimate is that you may have to contact many business owners to find one who is willing to share his wisdom with you.

What’s the best way to find an entrepreneur who is running a hospice services business in another community?

It’s easy. Here’s a link you can use to find a mentor outside of your area.

How to Buy a Hospice Services Business

Many experts advise against starting a hospice services business if you can buy an established operation. But as a hospice services business buyer, you’ll quickly discover that a business purchase isn’t completely hassle-free.

Buying a business can be just as complex as starting one. For most prospective business buyers, the first step is to contact a business broker .

Business brokers specialize in helping buyers locate profitable hospice services business opportunities. They are also adept at guiding you through the purchase process so you can avoid the mistakes that are commonly made by first-time hospice services business owners.

    Don’t Rule Out Franchising

The probabilities on your making a success of your new business are higher if you opt for franchising rather than going it alone.

Prior to starting a hospice services business, it’s worthwhile to check out whether franchise opportunities in your space might make sense for you.

The link below gives you access to our franchise directory so you can see if there’s a franchise opportunity for you. You might even find something that points you in a completely different direction.
