The Attorney General fulfils the role of chief legal adviser to the government and superintends the principal prosecuting authorities within England and Wales. The Courts

Provide administration of the civil, family and criminal courts in England and Wales.

Advocates representing the CPS prosecute the majority of the criminal cases that are heard within the magistrates’ courts and the Crown Courts. Magistrates’ courts deal with the less serious criminal offences. Youth courts are special magistrates’ courts which deal with all but the most serious charges against people aged between 10 (the age of criminal responsibility) and under 18. The Police

There are 43 police forces across England and Wales responsible for the investigation of crime, collection of evidence and the arrest or detention of suspected offenders. Once a suspect is held, in minor cases the police decide whether to caution them, take no further action, issue a fixed penalty notice or refer to the CPS for a conditional caution, or in the more serious cases, send the papers to the CPS to decide upon prosecution. The National Offender Management Service (NOMS)

The National Offender Management Service provides administration of correctional services in England and Wales through Her Majesty’s Prison Service and the Probation Service. Certified Paralegal (CP)

In order to call yourself a paralegal in the State of Florida, you must meet the Florida Bar s™ definition: A paralegal is a person with education, training, or work experience who works under the direction and supervision of a member of The Florida Bar and who performs specifically delegated substantive legal work for which a member of The Florida Bar is responsible. Paralegals enter the field either through formal education training, work experience, or a combination of both. The vast majority of law firms now require a degree as a minimum requirement for prospective new hires. In addition, many firms also require the CP designation.

To become a CP (certified paralegal), you must take the CP exam offered through NALA. Once you have passed the CP exam, you are eligible to take the Florida Certified paralegal examination offered by the paralegal Association of Florida (PAF). Upon passing the exam, you are entitled to use the FCP designation. Advanced certifications for particular areas of law are available through NALA; however, you must have obtained the CP designation before you are eligible for any of these advanced certifications.

The National Association of Legal Assistants, Inc. ( NALA ), administers the CLA/CP Examination. Successful completion of this national, comprehensive, two-day written exam entitles paralegals to use the designation CLA or CP after their names. This signifies that these paralegals are capable of providing superior services to the law firms and companies who employ them and are eminently qualified to perform those services. As of January 31, 2009, there are 14,965 CLAs/CPs in the country and 3,866 of those are from the State of Florida.

CLA s are required to have 50 hours of continuing legal education credits over a five year period to maintain the CLA/CP certification. Visit nala.org for more information.

In 2006, NALA initiated a new web-based format for the advanced certification program. Current specialty certifications include Contracts Management/Contracts Administration, Discovery, Social Security Disability, Trial Practice, Alternative Dispute Resolution, and Business Organizations: Incorporated Entities. About the Program

The Paralegal Studies Associate Degree program is a 60-credit-hour program that prepares students to assist lawyers in carrying out their professional responsibilities. Working under the direct supervision of an attorney, the paralegal does research, prepares documents and interviews clients. Employment opportunities are also available in such diverse areas as insurance, real estate, mortgage companies, government agencies, courts and banks. Paralegals may not provide legal services directly to the public, except as permitted by law.

This program is approved by the American Bar Association.

Learning experiences for students in the Paralegal Studies program are provided in classrooms on the Airport and Beltline campuses as well as online.

Paralegal Program Legal Specialty Course Transfer Policy

Upon a student’s admission to Midlands Technical College (MTC) and enrollment in the Paralegal Program, we review transfer credits and may accept up to two-thirds of the requisite number of legal specialty credits from regionally accredited, ABA-approved schools. This translates to as many as five legal specialty courses in the certificate program and seven legal specialty courses in the associate degree program.

Each legal specialty course submitted for transfer consideration is evaluated by the program director. Transferability is based on course content, hours of instruction, and the grade earned in the course by the student. College transcripts are reviewed to determine whether acceptance of transfer credits is appropriate. In addition, each student must complete a minimum of ten credit hours of legal specialty courses through traditional classroom instruction.

Legal specialty courses cannot be accepted from a college that does not have regional accreditation. We may accept credits from non-ABA approved schools if adequate evidence is provided to document that the course meets an appropriate level of academic rigor and compliance with ABA guidelines for paralegal education.

Special Requirements

Basic typing skills are required for successful completion of the program.

Students must earn a grade of “C” or better in all of the courses offered within the Business and Public Services Department for the grade to be counted toward graduation. Specifically, these include courses with the following prefixes: ACC, BAF, BUS, LEG, MGT, and MKT.

This is a (college transfer) course in which the following topics are presented: a study of composition in conjunction with appropriate literary selections, with frequent theme assignments to reinforce effective writing. A review of standard usage and the basic techniques of research are also presented.

English Comp II

This is a (college transfer) course in which the following topics are presented: development of writing skills through logical organization, effective style, literary analysis and research. An introduction to literary genre is also included.

Contemporary Mathematics

This course includes techniques and applications of the following topics: elementary number theory; algebra; geometry; measurement; graph sketching and interpretations; and descriptive statistics.

General Psychology

This course includes the following topics and concepts in the science of behavior: scientific method, biological bases for behavior, perception, motivation, learning memory, development, personality, abnormal behavior, therapeutic techniques, and social psychology.

Public Speaking

This course is an introduction to principles of public speaking with application of speaking skills. Students entering this course must be able to communicate clearly with American speakers of English.

Torts

This course is a study of the various classifications and functions of tort law, including intentional and negligent torts, causation, proximate cause, and defenses.

Business Law I

This course is a study of the basics of commercial law, with emphasis on the formation and enforcement of contracts and the rules particular to the Uniform Commercial Code (UCC) and sales of goods.

Business Law II

This course is an in-depth study of the Uniform Commercial Code with special emphasis on the essentials of Article 3, Commercial Paper, and Article 9, Secured Transactions. Business partnerships and corporations and their formation are studied.

Legal Bibliography

This course is a study of the methods of legal research, proper citation of authority, use of legal treatises, texts, reporters, and digests. This course introduces students to the techniques and procedures of legal writing and analysis.

Introduction to Law and Ethics

This course provides a general introduction to law, including courts, legal terminology, procedures, systems, and laws of society. Emphasis is on ethics and the role of the paralegal in the legal system.

Civil Litigation I

This course is a study of the principles of litigation and the rules of procedure for each court in the south carolina system, including pleading, practice, and discovery procedures.

Family Law

This course includes an examination of the laws of marriage, divorce, annulment, separation, adoption, custody, and the juvenile.

Property Law

This course includes an overview of South Carolina property law, including the mechanics of various commercial and private property transactions and mortgage foreclosures. Students are introduced to techniques and procedures examining titles to real property.

Law Office Management

This course is a study of the basic principles of office management, including administrative procedures, client relations, and office operating procedures.

Wills, Trusts, and Probate

This course includes a detailed study of testacy and intestacy, preparation of wills and codicils, and fundamentals of trust and probate administration. Students probate a simple estate.

Law Practice Workshop

This course includes the application of substantive knowledge in a practical situation as a paralegal.

Introduction to Computers

This course covers basic computer history, theory and applications, including word processing, spreadsheets, data bases, and the operating system.

Am I a Paralegal?

What is a paralegal?

A paralegal is someone who does legal work even though they have not qualified as a solicitor or barrister.

By “legal work” we mean advising and assisting with the law in the same way that a solicitor advises and assists clients.

Doing clerical or administrative work in a legal environment does not count as legal work. Nor does most of the day-to-day work done by a police officer enforcing the law (although if the officer was doing work such as helping undertake prosecutions or advising on the application of law then that type of work would probably count).

Many paralegals have different job titles: caseworker, contracts manager, legal assistant, compliance officer, housing assistant, company secretary, volunteer adviser, counsellor, trade mark clerk etc. Many senior legal secretaries also do paralegal work despite still being called legal secretaries.

You are potentially a paralegal if you do paid or unpaid legal work for your employer or for clients or someone else. Your job title is irrelevant. What counts is that you do legal work sufficiently often to legitimately be considered as a (non-lawyer) legal practitioner.

Only one in three paralegals works for a solicitors’ firm. The rest work for the government, the not-for-profit sector, companies, charities, industry etc.

Legal Support staff

‘Legal Support Staff’ is the term used to describe people who work in a legal environment (e.g. law firms, legal departments, courts, the police and many government departments etc.) who do not do legal work themselves, but support those who do.

The type of support varies widely, it may be secretarial, accountancy or post room support, or it may be business support: marketing, HR, finance, learning development and the like. The common thread is that individuals work in a legal environment and so need to be aware of the legal, ethical, regulatory and risk management implications inherent in working in that legal environment.

How to become a Paralegal

Unlike for solicitors and barristers, there are no formal qualifications or accreditations that you need to obtain. Most paralegals begin their careers by learning on the job. However, as the profession of paralegal continues to grow in recognition then it is likely in due course that the government will seek to regulate it. Part of the Institute´s remit is to establish a recognised educational and skills framework for the paralegal profession.

Experienced and knowledgeable, Jason K. Jensen is a college-trained and licensed private investigator in good standing. In addition to his criminal justice degree, he started as a certified paralegal with 13 years litigation experience from different private law firms. Prior to working in the private sector he interned for an assistant district attorney at the Salt Lake District Attorney s Office.

Unlike other private investigators from a law enforcement background, Mr. Jensen has unsurpassed understanding of law. In a study conducted in 2004 (Caitlin Maupin, 2004), researchers found that second year police state troopers who were socialized by experience were better prepared to respond to ethical issues than first year police state troopers. Those findings suggest the recognized existence of error among police officers employed by agencies that employ its law enforcement officers with only a high school education.

In addition to a master s degree, Mr. Jensen s experience included countless hours of legal research, the preparation of thousands of court documents, the preparation of hundreds of trial exhibits, and countless interviews of witnesses and parties. The firms he worked for practiced in the areas of family law, criminal defense, civil rights, contracts, employment law, and personal injury.

Mr. Jensen is a member of the Utah Association of Criminal Defense Lawyers, dedicated to promote the fair administration of justice. See UACDL. And, Mr. Jensen is a member of the Wyoming Trial Lawyers Association .

Mr. Jensen is a military veteran who served in the armed forces in the 1991 Gulf War. While serving onboard the U.S.S. Juneau (LPD 10), Mr. Jensen distinguished himself receiving three Navy Achievement Medals and by becoming the most junior petty officer ever to receive the coveted surface warfare specialist. In a single enlistment he advanced from an E 1 to a second class petty officer by passing the E 5 with a 100% test score. Being a leader is what Mr. Jensen is used to being; he still behaves that way today.

Why become a Nurse Paralegal?

Corporations, law firms, insurance companies, HMOs, risk management groups, government agencies, and hospitals are seeking qualified personnel trained in medicine and the law. This program offers paralegal education and training to nurses who are RNs and wish to be involved in the legal profession as legal nurse consultants or nurse paralegals.

Are there any requirements I must satisfy before I start taking courses in my major?

This program is open to registered nurses with an associate degree who have at least two years of nursing experience. Diploma school nurses must also have two years of nursing experience and may be admitted to this certificate of completion program upon review of transcripts.

How long will it take for me to complete this program?

You may complete the certificate of completion in one year by taking two to three courses in each of the fall, spring, and summer semesters/sessions.

Upon completion of this program, graduates will be able to:

Explain the history, evolution, and current role of a nurse paralegal in the legal environment;

Demonstrate knowledge of the American legal system, substantive legal principles, and the litigation process;

Demonstrate knowledge of the principles of medical/legal ethics and of the Model Code of Ethics and Professional Responsibility and Guidelines for Enforcement of the National Federation of Paralegal Associations, Inc.;

Proficiently access, locate, and research the law by both traditional and electronic methods;

Demonstrate problem-solving and critical, analytical thinking skills within the context of evaluating legal issues; and

Communicate effectively with accurate legal terminology in written and/or oral form, with a demonstrated proficiency in the use of technology.
