This page provides basic information about being certified as a Medicare and/or Medicaid home health provider and includes links to applicable laws, regulations, and compliance information.

A Home Health Agency (HHA) is an agency or organization which:

  • Is primarily engaged in providing skilled nursing services and other therapeutic services; Has policies established by a group of professionals (associated with the agency or organization), including one or more physicians and one or more registered professional nurses, to govern the services which it provides;
  • Provides for supervision of above-mentioned services by a physician or registered professional nurse;
  • Maintains clinical records on all patients;
  • Is licensed pursuant to State or local law, or has approval as meeting the standards established for licensing by the State or locality;
  • Has in effect an overall plan and budget for institutional planning;
  • Meets the federal requirements in the interest of the health and safety of individuals who are furnished services by the HHA; and
  • Meets additional requirements as the Secretary finds necessary for the effective and efficient operation of the program.

For purposes of Part A home health services under Title XVIII of the Social Security Act, the term home health agency does not include any agency or organization which is primarily for the care and treatment of mental diseases.

A Home Health Agency may be a public, nonprofit or proprietary agency or a subdivision of such an agency or organization.

  1. Public agency is an agency operated by a State or local government. Examples include State-operated HHAs and county hospitals. For regulatory purposes, public means governmental.
  2. Nonprofit agency is a private (i.e. nongovernmental) agency exempt from Federal income taxation under 501 of the Internal Revenue Code of 1954. These HHAs are often supported, in part, by private contributions or other philanthropic sources, such as foundations. Examples include the nonprofit visiting nurse associations and Easter seal societies, as well as nonprofit hospitals.
  3. Proprietary agency is a private, profit-making agency or profit-making hospital.

More and more people, especially Medicare patients, are having trouble finding a doctor.

The doctor shortage is worse than most people think, says Steven Berk, M.D. dean of the School of Medicine at Texas Tech University. The population is getting older, so there’s a greater need for primary care physicians. At the same time, physicians are getting older, too, and they’re retiring earlier, Berk says. And graying doctors — nearly half the nation’s 830,000 physicians are over age 50 — are seeing fewer patients than they did four years ago, a 2012 Physicians Foundation survey reported.

Soon, this fraying primary care network will face another huge challenge: Under the Affordable Care Act. millions of formerly uninsured men and women will have access to health care.

We need to absorb these 30 million people, and that’s going to be a strain, says Russell Phillips, M.D. director of Harvard Medical School’s new Center for Primary Care.

A fundamental change

The approach most favored by experts at Harvard and elsewhere is to reshape traditional primary care: from a stream of patients waiting to see one harried doctor to a more efficient team practice in which patients with routine problems are seen by nurse-practitioners and physician assistants — trained specialists with master’s degrees. The team frees the doctor to spend more time with patients with more serious complaints.This change could be as fundamental as the one that took place when most family doctors stopped making Marcus Welby-like house calls.

The Affordable Care Act encourages such a sea change, with provisions that aim to shore up and expand the country’s ailing primary care system while still reducing costs.

The ACA authorizes money to increase the primary care workforce by training more doctors, nurses, nurse-practitioners and physician assistants. It includes more graduate medical education training positions, with priorities for primary care and general surgery, and more money for scholarships and loans for all health professionals. The law expands the number of patients seen at community health centers in areas with too few doctors and increases the number of staffers who work in the centers. It also expands nurse-managed clinics at nursing schools where nurses in training see patients who live in the area.

Another key provision: a 10 percent bonus, through 2015, to primary care doctors who offer services to Medicare patients.

But in these times of shrinking federal budgets, it’s unclear how much ACA primary care money will be available as Congress juggles competing priorities. Congress, for example, already has chopped about $6.25 billion from the ACA’s new $15 billion Prevention and Public Health Fund, which pays for programs to reduce obesity, stop smoking and otherwise promote good health. In addition, federal support for training all types of physicians, including primary care doctors, is targeted for cuts by President Obama and Congress, Republicans and Democrats, says Christiane Mitchell, director of federal affairs for the Association of American Medical Colleges, who calls the proposed cuts catastrophic.

A recent study by the Institute of Medicine and the National Research Council reports that, when compared with citizens of 16 other high-income democracies, including those of Western Europe, Japan and Canada, Americans not only die younger but have poorer overall health. The researchers traced U.S. health disadvantages to a number of causes, including the fact that Americans have more limited access to primary care.

Where have all the doctors gone?

Today, the United States is short about 16,000 primary care doctors — the very doctors (family practitioners, internists and pediatricians) who offer the treatments and preventive screenings that save lives and head off expensive emergency room visits and hospitalizations.

Why the shortage? It starts with huge medical school debts and ends with a doctor who is often overworked and underpaid. While students may enter medical school wanting to practice primary care medicine, they graduate saddled with heavy debt — $250,000 is not unusual — which prompts them to switch to a more lucrative specialty. The starting salary for a primary care physician is $150,000 to $170,000; a radiologist or gastroenterologist can make two to three times that.

Only one in five graduating internal medicine residents plans to go into primary care medicine, the Journal of the American Medical Association reports.

Looking for a Doctor?

The best place to start is your state medical association. Many provide doctor directories that often include new doctors just setting up practice.

If you’re a Medicare beneficiary, go to medicare.gov . Under Forms, Help and Resources on the home page, select Find doctors, hospitals and facilities. Type in your ZIP code and you’ll get a drop-down menu of medical specialties, including primary care. The tool provides contact information for doctors according to the criteria you enter — geographic location, specialty, etc. Call the office to check whether the doctor is still taking new patients.

Clay Buchanan, a former lawyer, is one of those graduating in May. At 48, the Little Rock, Ark. resident is older than most medical students. He shadowed a family doctor as part of his training — and was hooked. By noon the first day, I loved it, Buchanan says.

New York University and several other colleges are planning to experiment with a three-year program.

Health clinics offer primary care

Community health centers offer another form of primary care. Nationwide, the centers serve 20 million patients a year using a team approach, and are open to all on a sliding fee scale. Under the ACA, they are expected to double their capacity to 40 million patients by 2015. To entice doctors to work at these centers, the National Health Service Corps repays up to $120,000 in loans for each doctor in return for four years’ service.

Technology, including telemedicine — which could reduce patient trips to the doctor’s office — also should help expand health care.

Another way to increase health services is to give physician extenders — nurses and other medical professionals — more autonomy. Patricia Grady, director of the National Institute of Nursing Research at the National Institutes of Health, supports increasing the role of trained nurses, allowing them to set up independent practices where they could do physical exams and advise patients on exercise and diet.

But that position has met with some resistance. The American Academy of Family Physicians and the American Medical Association (AMA) favor training more physicians and nurses but want to keep nurses in teams led by doctors.

Nurses and foreign doctors

Permitting more foreign doctors to practice here also would increase the pool of primary care providers. Last fall, President Obama signed a three-year extension of a visa waiver program that allows states to place 30 foreign medical school graduates a year in medically underserved areas for three years. Most remain in the communities after they satisfy their commitment. Still, the shortage is so acute, even the AMA is lobbying Congress to increase to 50 the number of foreign-educated doctors each state is allowed.

In the meantime, more Americans are anxiously searching for a primary care doctor — or waiting months to see one. Marcia Andrews, whose Washington doctor refused to take Medicare, finally found a new doctor who does. The search took her 18 months.

An HO-2 only covers named risks; though the list tends to be quite long. It does not cover damage from accidental losses. Since typical accidental losses are likely to be relatively small compared to the total value of a home, it might be best to accept the risk and purchase an HO-2 policy. Note that not many companies offer this policy at the present, as HO-3s are far more popular.

By far the most common policy, it covers a vast array of risks, including fire, wind, theft and vandalism, freezing, and accidental damage. Most companies exclude the following from HO-3s: floods, sewer backups, earthquakes, termites, pets, mold, rot, and explosions. This policy also covers personal property, but only for named perils, and covers the personal property for replacement cost after adjustment for depreciation, not the full replacement cost.

It is the same as an HO-3 policy, except that it includes replacement cost coverage for personal property and insures personal property against all perils except specifically excluded perils.

An HO-8 policy typically pays only for damages up to the actual cash value of what is lost, versus allowing the owner to insure for full replacement cost. HO-8 policies are most appropriate for those with older homes, and are intended to consider that older homes often have ornate woodwork and other features that are very expensive to replace. Replacing such features may cost more than the home is actually worth, and HO-8 policies will repair or replace what is damaged.

Insurance for tenants who are renting.

Reflects a company s national complaint ratio, as determined by the National Association of Insurance Commissioners (NAIC). A high (green) rating means fewer complaints made against a company. Each year, the NAIC tallies up all the complaints that have been made by customers against a company to their respective state insurance departments. The ratio is then calculated by dividing the number of complaints by the amount of gross premiums written (in millions of dollars) by the company that year.

Don’t automatically select one of the most popular or well-known companies. As the comparison shows, the companies with the largest NAIC Market Shares are not necessarily the top-rated options. Bigger does not always mean better.

Premiums
Although sample premiums are used to make general comparisons across home insurance companies, don’t base your personal decision exclusively on the sample premiums. Premiums vary tremendously by location, age of the house, construction type, etc. Contact different companies to receive personalized quotes before making your final decision.

Complaint Ratios
Avoid companies with high complaint ratios, as this may indicate poor customer service. Each state’s Department of Insurance provides consumers with complaint ratio data for all of the home insurance companies in their state. Before deciding on an insurance company, make sure that it has a low complaint ratio.

    Providers across the spectrum are tapping into the home health market to expand their services across multiple facets of care, as evidenced by LexisNexis 2015 rankings of the leading home health agencies in the United States.

    Released Wednesday, the LexisNexis 2015 Top 100 Home Health and Hospice Agencies Rankings is a report that ranks Medicare-certified home health providers by national market share and aims to map the market landscape for potential merger and acquisition activity. The top providers were compiled using patient volume data and medical claims by LexisNexis Risk Solutions, a subsidiary of LexisNexis that helps customers in various industries predict, assess and manage risk.

    LexisNexis gathered and analyzed more than 1.2 billion claims from practice management and billing systems, claims clearing houses and payers including government agencies, according to a news release.

    “The purpose of it is to understand where you stand in regard to your competition, how large you are. It’s a good measuring stick from that perspective, Chris Golden, home health and hospice strategist for LexisNexis Risk Solutions, tells Home Health Care News.

    Beyond that, Golden says the rankings provide some perspective on trends in the home health space, particularly in how top-10 providers such as Kindred Healthcare (NYSE: KND) and Brookdale Senior Living (NYSE: BKD) are more frequently spanning several care settings.

    “There are three companies that were largely known for providing care in other settings that are now three of the largest home care providers in the country,” Golden says. “That wasn’t the case if you look back two years ago; it was basically all companies that were focused on specific settings. It sheds some light on how the market is shaping up.

    The list comes as M A activity within the home health space has been on the upswing. with signs pointing toward the largest companies positioning themselves to drive even more affiliations. More streamlined care from fewer providers could be the result, Golden says.

    “Consolidation is a trend that we’ve been seeing and would expect to continue,” Golden says. “If you can start to be able to offer that full range of service, you can provide a pretty convincing case to be the provider of choice for a given health system, which is only going to help grow your market share and increase your number of patients.

    And the numbers suggest that there’s plenty of room for the industry to consolidate, given that the top two providers—Kindred and Amedisys, Inc. (NASDAQ: AMED)—together account for less than 10.5% of the total market.

    Leadership

    Terri Hobbs was named the executive director of Housecall Providers in July 2011. Her leadership and fiscal management abilities have propelled the organization to its current status: A $9 million (revenue) nonprofit employing nearly 90 and serving almost 2,000 homebound patients a year through primary and palliative care and hospice services. Terri has deftly managed the rapid growth of the organization while positioning it to play a much larger role in the medical community, both in Oregon and nationally.

    Housecall Providers is one of the 15 sites currently participating in the Independence at Home national demonstration project. First-year data released last summer showed that Housecall Providers achieved the highest cost savings of all the sites at $1,133 per patient per month or 32%. In 2014, Housecall Providers was given the Small Business Innovation Award by the Portland Business Journal and this year the Journal has placed Terri on its Executives to Watch list for 2016.

    Dr. Pamela Miner became our second medical director on November 1, 2014, following the retirement of Housecall Providers founder, Dr. Benneth Husted. Pamela received her medical degree from Northwestern University Medical School and completed her residency in internal medicine at Beth Israel Deaconess Medical Center in Boston, MA.     Rebecca Ashling graduated from Walla Walla College School of Nursing in 1997 with a Bachelor of Science in Nursing and from the University of Phoenix in 2006 with a Master of Science in Nursing. Prior to nursing school, she worked as a nursing and medical assistant for 13 years. After nursing school, Rebecca entered maternal/child nursing and then discovered her passion for hospice, feeling that a “snapshot” of a patient did not allow her to provide comprehensive care.     Mary Sayre joined the Housecall Providers leadership team in 2013 as Primary Care Program Director. The Portland native brings a wealth of medical knowledge to the position with her 20 years’ experience as a nurse.     This page provides basic information about being certified as a Medicare and/or Medicaid home health provider and includes links to applicable laws, regulations, and compliance information.

    A Home Health Agency (HHA) is an agency or organization which:

    • Is primarily engaged in providing skilled nursing services and other therapeutic services; Has policies established by a group of professionals (associated with the agency or organization), including one or more physicians and one or more registered professional nurses, to govern the services which it provides;
    • Provides for supervision of above-mentioned services by a physician or registered professional nurse;
    • Maintains clinical records on all patients;
    • Is licensed pursuant to State or local law, or has approval as meeting the standards established for licensing by the State or locality;
    • Has in effect an overall plan and budget for institutional planning;
    • Meets the federal requirements in the interest of the health and safety of individuals who are furnished services by the HHA; and
    • Meets additional requirements as the Secretary finds necessary for the effective and efficient operation of the program.

    For purposes of Part A home health services under Title XVIII of the Social Security Act, the term home health agency does not include any agency or organization which is primarily for the care and treatment of mental diseases.

    A Home Health Agency may be a public, nonprofit or proprietary agency or a subdivision of such an agency or organization.

    1. Public agency is an agency operated by a State or local government. Examples include State-operated HHAs and county hospitals. For regulatory purposes, public means governmental.

    Meet the Housecall Providers Team

    Leadership

    Terri Hobbs was named the executive director of Housecall Providers in July 2011. Her leadership and fiscal management abilities have propelled the organization to its current status: A $9 million (revenue) nonprofit employing nearly 90 and serving almost 2,000 homebound patients a year through primary and palliative care and hospice services. Terri has deftly managed the rapid growth of the organization while positioning it to play a much larger role in the medical community, both in Oregon and nationally.

    Housecall Providers is one of the 15 sites currently participating in the Independence at Home national demonstration project. First-year data released last summer showed that Housecall Providers achieved the highest cost savings of all the sites at $1,133 per patient per month or 32%. In 2014, Housecall Providers was given the Small Business Innovation Award by the Portland Business Journal and this year the Journal has placed Terri on its Executives to Watch list for 2016.

    Dr. Pamela Miner became our second medical director on November 1, 2014, following the retirement of Housecall Providers founder, Dr. Benneth Husted. Pamela received her medical degree from Northwestern University Medical School and completed her residency in internal medicine at Beth Israel Deaconess Medical Center in Boston, MA. In 2007, she accepted a Hospice and Palliative Care Fellowship at Harvard University and a year later joined Providence Health and Services in Portland as a palliative and hospice care physician. Since 2012, she has dedicated her time and talent exclusively to palliative care. As an expert in the field, Pamela will guide the expansion of our palliative care services to provide holistic support to patients as they manage the impact of their chronic conditions while further integrating our primary care and hospice programs.

    Rebecca Ashling graduated from Walla Walla College School of Nursing in 1997 with a Bachelor of Science in Nursing and from the University of Phoenix in 2006 with a Master of Science in Nursing. Prior to nursing school, she worked as a nursing and medical assistant for 13 years. After nursing school, Rebecca entered maternal/child nursing and then discovered her passion for hospice, feeling that a “snapshot” of a patient did not allow her to provide comprehensive care. Rebecca is passionate about all-embracing end-of-life care and making sure that all of the “pieces” fit together for every patient and family.

    Dr. Nancy Cloak joined Housecall Providers as a volunteer physician in 2014. A practicing psychiatrist for over a decade, she was drawn to hospice work since serving as a caregiver for a family member. Nancy finds that providing end-of-life care blends her abiding interest in general medicine with the best parts of being a psychiatrist, listening and working with a multidisciplinary team. She assumes the role of Hospice Medical Director after serving since 2014 as a physician with the Housecall Providers hospice team.

    Nancy received her medical degree from the University of South Florida and completed her residency at the prestigious Menninger Clinic in Houston, Texas. Following residency, she worked as a psychiatrist with medically complex patients in a variety of settings, including geriatric, palliative care, and eating disorder treatment centers.

    Mary Sayre joined the Housecall Providers leadership team in 2013 as Primary Care Program Director. The Portland native brings a wealth of medical knowledge to the position with her 20 years’ experience as a nurse. Mary created the transition team to support our patients involved in the national demonstration project, Independence at Home (IAH). Her skill at navigating the healthcare maze and her patient-centered approach were key reasons why Housecall Providers has been so successful. Mary designed another innovative program in the fall of 2015 when she launched the in-home palliative care team to support our frailest patients and complete our continuum of care. With the frequent changes in healthcare, Mary is working to prepare the primary care team to embrace this challenging time with focus and determination.

    Susan Ehrman joined Housecall Providers in September 2014 following five years as the Program Director for Women’s Impact fund in Charlotte, NC. Susan brings over 30 years of nonprofit management experience, including fundraising for Tufts University, Emerson College, Harvard Law School, and 15 years as the Director of Development for Hospice Palliative Care Charlotte Region. She has served on a number of nonprofit boards, including Planned Parenthood Health Systems and Playing for Others in Charlotte. Susan is pleased to be back in her native Portland.

    Staci Larson joined Housecall Providers in September 2015 as the Director of Finance. A Portland native, she earned an Accounting degree from Linfield College in 1986 and has practiced in the public accounting sector for over 15 years. Staci’s emphasis is in the areas of taxation and accounting for small to mid-sized businesses and served most recently as the controller for a Willamette Valley medical practice. Prior to that position, she spent 10 years as the finance officer for the Energy Loan Program at the Oregon Department of Energy where she managed the complex accounting and finance issues of a multi-million dollar bond and loan portfolio. Staci’s expertise on financial matters will help to guide Housecall Providers through the increasingly complex healthcare environment.

    Hospice of the Valley trains community volunteers to support our patients and their caregivers. Volunteers may run errands, giving busy caregivers one less thing to do. And they spend time with patients – talking, listening and offering emotional support – giving family caregivers time to attend to their own needs.

    Which brings to mind a family love story…

    With a romantic swoosh, Andrew Hanley came into my mother Lucy’s life.

    The Australian admired this American woman from afar as both traveled with some 50 people on an organized tour of Great Britain. Though they barely had spoken with each other along the way, when Andrew returned home to Australia he penned a note to my mother in Arizona, asking the tour company to forward the letter to her.

    Lucy and Andrew struck up an overseas correspondence, long letters about their full lives—marriages, divorces, kids, careers, and his military service in World War II.

    Next thing we knew, Andrew came to Arizona for a visit, his adult nephew in tow for the sake of propriety. One afternoon Andrew and Lucy shed the chaperone and snuck off to hatch a plan. Not long after, he moved here. For two years they had the time of their lives, traveling in the United States and Australia. Ultimately they were married at their home in north Phoenix.

    Providers across the spectrum are tapping into the home health market to expand their services across multiple facets of care, as evidenced by LexisNexis 2015 rankings of the leading home health agencies in the United States.

    Released Wednesday, the LexisNexis 2015 Top 100 Home Health and Hospice Agencies Rankings is a report that ranks Medicare-certified home health providers by national market share and aims to map the market landscape for potential merger and acquisition activity. The top providers were compiled using patient volume data and medical claims by LexisNexis Risk Solutions, a subsidiary of LexisNexis that helps customers in various industries predict, assess and manage risk.

    LexisNexis gathered and analyzed more than 1.2 billion claims from practice management and billing systems, claims clearing houses and payers including government agencies, according to a news release.

    “The purpose of it is to understand where you stand in regard to your competition, how large you are. It’s a good measuring stick from that perspective, Chris Golden, home health and hospice strategist for LexisNexis Risk Solutions, tells Home Health Care News.

    Beyond that, Golden says the rankings provide some perspective on trends in the home health space, particularly in how top-10 providers such as Kindred Healthcare (NYSE: KND) and Brookdale Senior Living (NYSE: BKD) are more frequently spanning several care settings.

    “There are three companies that were largely known for providing care in other settings that are now three of the largest home care providers in the country,” Golden says. “That wasn’t the case if you look back two years ago; it was basically all companies that were focused on specific settings. It sheds some light on how the market is shaping up.

    The list comes as M A activity within the home health space has been on the upswing. with signs pointing toward the largest companies positioning themselves to drive even more affiliations. More streamlined care from fewer providers could be the result, Golden says.

    “Consolidation is a trend that we’ve been seeing and would expect to continue,” Golden says. “If you can start to be able to offer that full range of service, you can provide a pretty convincing case to be the provider of choice for a given health system, which is only going to help grow your market share and increase your number of patients.

    And the numbers suggest that there’s plenty of room for the industry to consolidate, given that the top two providers—Kindred and Amedisys, Inc. (NASDAQ: AMED)—together account for less than 10.5% of the total market.

    A primary care provider (PCP) is a person you may see first for checkups and health problems. If you have a health care plan, find out what type of practitioner can serve as your PCP.

    • The term “generalist” often refers to medical doctors (MDs) and doctors of osteopathic medicine (DOs) who specialize in internal medicine, family practice, or pediatrics.
    • OB/GYNs are doctors who specialize in obstetrics and gynecology, including women’s health care, wellness, and prenatal care. Many women use an OB/GYN as their primary care provider.
    • Nurse practitioners (NPs) are nurses with graduate training. They can serve as a primary care provider in family medicine (FNP), pediatrics (PNP), adult care (ANP), or geriatrics (GNP). Others are trained to address women’s health care (common concerns and routine screenings) and family planning. NPs can prescribe medications.
    • A physician assistant (PA) can provide a wide range of services in collaboration with a Doctor of Medicine (MD) or a Doctor of Osteopathic Medicine (DO).
    • Registered nurses (RNs) have graduated from a nursing program, have passed a state board examination, and are licensed by the state.
    • Licensed practical nurses (LPNs) are state-licensed caregivers who have been trained to care for the sick.
    • Advanced practice nurses have education and experience beyond the basic training and licensing required of all RNs.

    Advanced practice nurses include nurse practitioners (NPs) and the following:

    • Clinical nurse specialists (CNSs) have training in a field such as cardiac, psychiatric, or community health.
    • Certified nurse midwives (CNMs) have training in women’s health care needs, including prenatal care, labor and delivery, and the care of a woman who has given birth.
    • Certified registered nurse anesthetists (CRNAs) have training in the field of anesthesia. Anesthesia is the process of putting a patient into a painless sleep, and keeping the patient’s body working so surgeries or special tests can be done.

    Licensed pharmacists have graduate training from a college of pharmacy.

    Your pharmacist prepares and processes drug prescriptions that were written by your primary or specialty care provider. Pharmacists provide information to patients about medications. They also consult with health care providers about dosages, interactions, and side effects of medicines.

    Your pharmacist may also follow your progress to check that you are using your medicine safely and effectively.

    Pharmacists also can evaluate your health and prescribe medications.

    Your primary care provider may refer you to professionals in various specialties when necessary, such as:

    • Allergy and asthma
    • Anesthesiology — general anesthesia or spinal block for surgeries and some forms of pain control

    This page provides basic information about being certified as a Medicare and/or Medicaid home health provider and includes links to applicable laws, regulations, and compliance information.

    A Home Health Agency (HHA) is an agency or organization which:

    • Is primarily engaged in providing skilled nursing services and other therapeutic services; Has policies established by a group of professionals (associated with the agency or organization), including one or more physicians and one or more registered professional nurses, to govern the services which it provides;
    • Provides for supervision of above-mentioned services by a physician or registered professional nurse;
    • Maintains clinical records on all patients;
    • Is licensed pursuant to State or local law, or has approval as meeting the standards established for licensing by the State or locality;
    • Has in effect an overall plan and budget for institutional planning;
    • Meets the federal requirements in the interest of the health and safety of individuals who are furnished services by the HHA; and
    • Meets additional requirements as the Secretary finds necessary for the effective and efficient operation of the program.

    For purposes of Part A home health services under Title XVIII of the Social Security Act, the term home health agency does not include any agency or organization which is primarily for the care and treatment of mental diseases.

    A Home Health Agency may be a public, nonprofit or proprietary agency or a subdivision of such an agency or organization.

    1. Public agency is an agency operated by a State or local government. Examples include State-operated HHAs and county hospitals. For regulatory purposes, public means governmental.
    2. Nonprofit agency is a private (i.e. nongovernmental) agency exempt from Federal income taxation under 501 of the Internal Revenue Code of 1954. These HHAs are often supported, in part, by private contributions or other philanthropic sources, such as foundations. Examples include the nonprofit visiting nurse associations and Easter seal societies, as well as nonprofit hospitals.
    3. Proprietary agency is a private, profit-making agency or profit-making hospital.
