The Law Officers

The Attorney General fulfils the role of chief legal adviser to the government and superintends the principal prosecuting authorities within England and Wales. The Courts

Provide administration of the civil, family and criminal courts in England and Wales.

Advocates representing the CPS prosecute the majority of the criminal cases that are heard within the magistrates’ courts and the Crown Courts. Magistrates’ courts deal with the less serious criminal offences. Youth courts are special magistrates’ courts which deal with all but the most serious charges against people aged between 10 (the age of criminal responsibility) and under 18. The Police

There are 43 police forces across England and Wales responsible for the investigation of crime, collection of evidence and the arrest or detention of suspected offenders. Once a suspect is held, in minor cases the police decide whether to caution them, take no further action, issue a fixed penalty notice or refer to the CPS for a conditional caution, or in the more serious cases, send the papers to the CPS to decide upon prosecution. The National Offender Management Service (NOMS)

    PART 1. SOPHAS APPLICATION

    • You may apply to only one UMD SPH program per application cycle.

    • We require 3 letters of recommendation. Your references will receive an email invite from SOPHAS to complete the recommendation online.

    • Pay the SOPHAS application fee.

    PART 2: UNIVERSITY OF MARYLAND SUPPLEMENTAL APPLICATION

    • The supplemental application is completed online via an emailed invitation from the UMD graduate school.

    • The title of the email is ‘please complete the school of public health supplemental application.’
    • This application requires demographic and residency questions, transcript, and application fee.

    Colorado Bureau Of Investigation Admits Dozens Of Faulty DUI Blood Tests

    DENVER (CBS4) Responding to a CBS4 investigation, the Colorado Bureau of Investigation has acknowledged at least 56 of the DUI blood tests it conducted in the last six months were incorrect.

    “The initial results in each of those 56 cases showed lower alcohol levels for the drivers than when additional quality assurance retesting occurred, said Susan Medina, a spokesperson for the CBI. “There is no indication that any defendant was inappropriately charged with an offense based on test results showing an erroneously high level of alcohol in a driver’s bloodstream.”

    The CBI opened labs in July 2015 in Pueblo and Grand Junction and since then has done about 1,500 DUI blood tests for the Colorado State Patrol and other law enforcement agencies. Medina said the faulty tests amounted to about 4 percent of the DUI testing the labs have conducted since last July.

    The CBI said it learned of its erroneous lab results “in recent months“ when an independent lab checked two blood samples that had also been tested by the CBI and the independent lab ChemaTox discovered what the CBI calls “anomalies.

    ChemaTox told CBS4 it notified state authorities of the problems in December 2015. The CBI said it then checked some of its other DUI alcohol results and confirmed its lab testing problems.

    “While a thorough review remains in progress, said CBI, “it is believed the cause of the anomalies has been identified and corrected.

    Medina declined to say if the problem was human error, testing equipment, or some other factor.

    Sarah Urfer of ChemaTox labs told CBS4, “I contacted CBI and said, Look, we had an anomaly and it s 24 percent different.’

    Urfer said the anomalies are important “because those are people’s lives at stake.

    David Miller, a Denver-based defense attorney who defends DUI clients, told CBS4 the CBI needs to come clean.

    “It creates a problem with the integrity of the system. They’re not saying what the problem is so we don’t know what the problem is, so we’re going to have to get full disclosure to start with. I think it s up to prosecutors now to look at each case and see if the convictions are proper in the first place and notify the client or lawyer as to what s happening, said Miller.

    He said the CBS4 investigation revealing the faulty testing shows a “huge problem. It’s a big deal if you’re the person affected by it. It’s a big deal individually and if you look at the big picture, if you are the person affected by this it’s a very big deal.

    Miller said to re-establish credibility, the CBI needs to have all 1,500 blood samples it has examined since last July re-tested.

    In many cases, blood drawn from a suspect is a critical piece of evidence establishing either guilt or innocence in DUI cases. There are an estimated 30,000 DUI cases in Colorado each year, according to the CBI.

    Dr. Pat Sulik, a chemist with Rocky Mountain Instrumental Laboratories, checked 16 blood samples from the CBI in recent months. She said of those 16 samples, seven were problematic having at least a 5 percent variance from the readings she found. Of those seven, she said five had more than a 10 percent discrepancy.

    Sulik said she would normally expect to have her results and the CBI results be nearly identical 99 percent of the time.

    “To see this many discrepancies when the CBI just started this summer, this is, at a simple overview, way too many discrepancies, said Sulik. “When we saw our first large discrepancy we retested the sample and gave ourselves a heart attack.”

    Sulik said the CBI’s erroneous, lower testing numbers mean “they are not being taken off the road, the DUI law is not being enforced if the state lab is coming up with lower numbers.

    Sulik said in at least one case she checked, the suspect in a DUI case would have faced a more serious charge had the CBI lab testing been correct the first time around.

    Ironically, the CBI only began doing this kind of testing after similar testing by the Colorado Department of Public Health and Environment came under fire in 2013 and CDPHE testing of DUI blood samples was shut down. In that case, defense attorneys maintained that the Department of Health testing was biased in favor of prosecutors and that staff was inadequately trained in handling blood samples.

    In 2014 the state Legislature approved a bill providing nearly $2 million in annual funding and the hiring of five new full-time employees for the CBI to take over the DUI blood testing that was previously conducted by the Department of Health. Now the Department of Health is assisting in the investigation of the faulty CBI testing.

    According to Medina’s statement to CBS4, ”After the review the CBI will issue amended reports to the law enforcement agencies that submitted the blood samples, and work with stakeholders to ensure accurate scientific results and prosecutions statewide.

    Mike Rankin, the CBI Director, said, ”While the CBI works extremely hard to avoid any testing errors in our laboratories, the quality assurance procedures served their designed purpose of safeguarding the integrity of the program.

    The CBI declined to answer any other questions from CBS4 citing an ongoing review of what happened. Medina said the agency might be able to provide more information once the review is completed.

    Miller told CBS4 he intended to reopen any DUI cases he has handled in the last seven months that involved CBI blood testing. Urfer called the problem “very frustrating. I’ve been through this twice before. It seems like this should be a preventable problem. There are a number of labs that have not had these problems.

    Jeudi 29 juin a eu lieu la cinquième Soirée des partenaires de l’école, organisée par le service des Relations industrielles. L’événement a rassemblé environ quatre-vingt personnes, industriels, représentants du secteur économique régional, universitaires et étudiants.

    Une table-ronde, animée par Fabien SOULIÉ, enseignant-chercheur, a abordé le thème de « La fabrication additive dans les applications industrielles, citoyennes, de la recherche et de la formation ».

    Stéphane ABED, président de la société Poly shape, Yann LEFEBVRE, président du FabLab « LabSud », André CHRYSOCHOOS, directeur du centre PRO3D et Christian JORGENSEN, professeur au CHU de Montpellier et directeur de l’unité INSERM “Cellules souches, plasticité cellulaire, médecine régénératrice et immunothérapies”, sont intervenus pour partager leurs expériences et échanger sur les applications de ces technologies.

    Les diverses interventions des invités ont permis de montrer le spectre très large des champs d’applications de ces nouvelles techniques de mise en œuvre de la matière, allant de l’industrie de pointe à la recherche médicale avancée, sans oublier les applications standardsaccessibles à tous ” précise Fabien Soulié.

      In order to graduate with an MBA degree, students enrolled in the program must complete 33 hours of core MBA courses and 9 hours of approved MBA electives.       Deferring or suspending enrollment for one or more classes could delay the expected graduation date.     The course includes six compulsory modules, two optional modules and a dissertation. The taught elements of the course run over two academic years.     The timetable below is a typical example, but your own timetable may be different.

    The first two years of the course run from October until May, with breaks at Christmas and Easter. During this time students are expected to complete three modules in Year 1 and three modules in Year 2 – a total of six modules. The final seven months are devoted to the preparation of a 12,000-word Dissertation presenting an independent piece of research conducted by the student.

    There is a three-day residential school every year and students are required to attend at least one during the course of their studies. It is estimated that around ten to twelve hours a week studying is required while studying a module.

One could say that anyone who is paying back the IRS for past due taxes is experiencing an economic hardship in that there are always more pleasurable things to do with one’s money.     In order to set up a Payment Plan for IRS back taxes and stop collection action. a taxpayer must demonstrate to the IRS that paying all that is due or making excessively large payments to the IRS would result in an undue economic hardship to the taxpayer. This is done by showing that payment of what the IRS is demanding would result in the taxpayer taking food off their family’s table or doing without some other necessity of life to give the money to the IRS instead. Fortunately for many people, this is not that difficult to demonstrate. Other times it is a bit harder, but there is almost always some type of resolution available. If you contact us. we will help you deal with the IRS and correctly complete the right forms to set up a Payment Plan that works for you.

    The main benefit of setting up installment payments with the IRS is that it will put you back in compliance and you will no longer have to worry about the IRS knocking on your door. The IRS will have disappeared from your life and there will be no threat of levy and seizure (garnishment) of your wages, bank accounts, or any other property. The harassment by the IRS will be completely over, as long as you continue to make the agreed upon payments.

    It is possible that by having us take a look at your financial situation, you may actually qualify for a hardship deferment of collection action and be put on uncollectable status. If this is the case, you would then be completely left alone by the IRS and make no payments. Do not count on this, but it does sometimes work out that way. Furthermore, you will not have to wait long for an answer. According to the IRS’s internal rules, they must answer your request for hardship within ten (10) working days of receipt of your request. As a taxpayer, you may think that not paying off your VISA debt or a loan from Aunt Mary and giving that money to the IRS instead is unreasonable, but the IRS doesn’t see it that way – and they never will.

    To view this in the proper perspective, you must look at it from the way the IRS Collections folks do. You see, they have all the power and hold most of the cards. What you have going for you are some reasonable outs provided by Congress and the IRS to keep the system efficient and within the bounds of reason. It is not efficient for the IRS to spend its time and money trying to collect a large sum of money from somebody who has no way of paying so large of an amount. The IRS and Congress have provided for this by instituting Payment Plans. The key is to make sure it is a Livable Payment Plan that you can afford and continue to pay without defaulting. This is what National Tax Relief makes sure of. You do not want to get coerced into a Payment Plan by a revenue officer in which the payments are so high that you will not be able to keep them up in the long run. If you get into a Payment Plan and later default, then you will be in bigger trouble than before.

    How to Qualify for a Payment Plan or Uncollectable Status

    You must show the IRS on the proper forms that your allowable expenses are equal to, or only slightly less than, your income. This is how you show the IRS that you can pay them only an “affordable and livable amount” without “undue economic hardship. Your allowable expenses are what the IRS considers the necessities of life. In general, they are: food, clothing, housing, utilities, transportation, medical, insurance and work-related expenditures.     Crime in the United States has declined substantially in recent years. Homicide, robbery, rape, and assault have all dropped sharply since highs in the early 1990s. Substance abuse has declined less sharply, however, and drug-related arrests have actually increased steadily, reaching record highs over the past few years. The number of people under some form of correctional supervision, meanwhile, has also continued to reach new highs. In 1996, over 5.5 million Americans (or about 2 percent) were in prison, jail, on probation or parole.

    While criminologists (and, indeed, most Americans) agree that more needs to be done to lower the national crime rate, there are sharp differences over how this should be accomplished. Some believe that tougher enforcement policies should be pursued, including increased spending on law enforcement and prison facilities, longer sentences for offenders, and stepped up use of the death penalty for the worst crimes. Others argue that more money needs to be spent on prevention, including social services and education, to provide hope and opportunity for potential offenders.

    Sharp Vision: New Glasses Help the Legally Blind See

    Although eSight s glasses won t help people with total blindness, they could still be a huge deal for the millions of peoples whose vision is so impaired that it can t be corrected with ordinary lenses.

    But eSight still needs to clear a few minor hurdles.

    Among them: proving the glasses are safe and effective for the legally blind. While eSight s headsets don t require the approval of health regulators they fall into the same low-risk category as dental floss there s not yet firm evidence of their benefits. The company is funding clinical trials to provide that proof.

    The headsets also carry an eye-popping price tag. The latest version of the glasses, released just last week, sells for about $10,000. While that s $5,000 less than its predecessor, it s still a lot for people who often have trouble getting high-paying jobs because they can t see.

    Insurers won t cover the cost; they consider the glasses an assistive technology similar to hearing aids.

    ESight CEO Brian Mech said the latest improvements might help insurers overcome their short-sighted view of his product. Mech argues that it would be more cost-effective for insurers to pay for the headsets, even in part, than to cover more expensive surgical procedures that may restore some sight to the visually impaired.

    The latest version of ESight s technology, built with investments of $32 million over the past decade, is a gadget that vaguely resembles the visor worn by the blind Star Trek character Geordi La Forge. played by LeVar Burton.

    The third-generation model lets wearers magnify the video feed up to 24 times, compared to just 14 times in earlier models. There s a hand control for adjusting brightness and contrast. The new glasses also come with a more powerful high-definition camera.

    ESight believes that about 200 million people worldwide with visual acuity of 20/70 to 20/1200 could be potential candidates for its glasses. That number includes people with a variety of disabling eye conditions such as macular degeneration, diabetic retinopathy, ocular albinism, Stargardt s disease, or, like Regan, optic nerve hypoplasia.

    So far, though, the company has sold only about 1,000 headsets, despite the testimonials of wearers who ve become true believers.

    Take, for instance, Yvonne Felix, an artist who now works as an advocate for eSight after seeing the previously indistinguishable faces of her husband and two sons for the first time via its glasses. Others, ranging from kids to senior citizens, have worn the gadgets to golf, watch football or just perform daily tasks such as reading nutrition labels.

    Eyeing the Competition

    ESight isn t the only company focused on helping the legally blind. Other companies working on high-tech glasses and related tools include Aira. Orcam. ThirdEye. NuEyes and Microsoft .

    But most of them are doing something very different. While their approaches also involve cameras attached to glasses, they don t magnify live video. Instead, they take still images, analyze them with image recognition software and then generate an automated voice that describes what the wearer is looking at anything from a child to words written on a page.

    Samuel Markowitz, a University of Toronto professor of ophthalmology, says that eSight s glasses are the most versatile option for the legally blind currently available, as they can improve vision at near and far distances, plus everything in between.

    Markowitz is one of the researchers from five universities and the Center for Retina and Macular Disease that recently completed a clinical trial of eSight s second-generation glasses. Although the results won t be released until later this year, Markowitz said the trials found little risk to the glasses. The biggest hazard, he said, is the possibility of tripping and falling while walking with the glasses covering the eyes.

    The device is meant to be used while in a stationary situation, either sitting or standing, for looking around at the environment, Markowitz said.

    Calif. to offer low-cost insurance to new immigrant drivers

    State officials hope a new law that offers California driver’s licenses to immigrants in the country illegally will also spur them to buy insurance.

    To encourage the practice, the California Department of Insurance is aggressively marketing its Low Cost Auto Insurance program to the large pool of immigrants projected to seek licenses under the AB 60 law taking effect Jan. 1.

    “It would be a tragedy if after all this effort, the 1.4 million people who are getting driver’s licenses for the first time don’t have auto insurance,” said Insurance Commissioner Dave Jones.

    Jones and others recognized that the cost of getting licensed — $33 — is a lot cheaper than buying insurance for hundreds of dollars a year. So, Jones, working with Senator Ricardo Lara, D-Bell Gardens, got the state Legislature to open up the low-cost insurance program to the new category of immigrant drivers.

    “The price will be less than $450 a year, which is less than $38 a month,” Jones said. He said that’s about a third of what it costs to get private auto insurance in many markets across California.

    Jones said more than 90 percent of AB 60 applicants are expected to be Spanish speakers. So the state’s been pushing its low-cost insurance through Spanish-language media and ads like this:

    Los Angeles-based insurance broker Susan Rocha said the state program likely offers the lowest prices for low-income immigrant drivers, especially since they have no official driving record.

    “Any place else it’s going to be much more, because they are considered a new driver,” Rocha said.

    But Rocha cautioned that the state’s low-cost program is very basic, and those who can afford more might want to join a private plan with beefier coverage. If they can jump on a relative’s plan, they may be able to enjoy loyalty discounts, Rocha said.

    For years, California law has allowed immigrants in the country illegally to buy insurance even without a license. But day laborer Alfredo Vidal said he just didn’t see the point.

    “Why?” said Vidal, who borrows his friend’s pick-up truck for construction gigs around L.A. “I don’t have a driver’s license.”

    But going without insurance can lead to hundreds of dollars in fines, not to mention losing one’s driver’s license, and car registration. In a crash, a driver might not be able to afford thousands of dollars in repairs. Some drivers might be apt to leave the scene. And this could raise insurance costs for everybody.

    Vidal was willing to accept the risks.

    “I have to take people with materials to the houses,” Vidal said. “I have to be driving all the time.”

    Immigrant advocates have largely avoided handing out insurance advice. Ana Garcia gives workshops on the new law for the Central American Resource Center, and said her priority is helping immigrants get their license.

    “We only went over insurance when they take the driving test,” Garcia said. “I let them know that whatever car they need to use for the driving test needs to be insured.”

    For his driver’s test, Vidal said he’ll borrow his friend’s car, which is already insured. If he passes and gets his license, Vidal says he’ll take all the proper next steps.

    “We’re going to get insurance – everybody,” Vidal said. “We know it’s the law.”

    Career Options

    Students who get their bachelor’s in public health can work in many different sectors, such as non-profit organizations and with the government. Specific job titles include health educators and social workers. Below are descriptions and overviews of two possible career options for public health majors.

    Health Educator

    Health educators provide information to individuals and communities about healthy living, disease prevention, safety, parenting, family planning and many other areas. They may work for colleges or secondary schools, state and local public health departments, nonprofits or private businesses. The programs they run range from sex education classes in high school settings to outside counseling services to hospital patients.

    Health educators must have excellent communication skills to work well with individuals and groups from diverse cultural and socioeconomic backgrounds. Because they are often in charge of designing and implementing new programs, health educators must be adaptable, creative and in touch with the communities they serve.

    Due to the rising cost of healthcare, employers, insurance companies and governmental organizations are looking for ways to curb costs through preventative health measures. The U.S. Bureau of Labor Statistics (BLS) predicted that employment opportunities for health educators would grow by 12% from 2014-2024. The BLS reports that the mean annual salary for health educators is $56,690 as of May 2015.

    Social Worker

    Social workers assist clients in overcoming emotional, situational, socioeconomic and other types of hardships. They may work with children, families, mental health patients, substance abusers or prisoners. Social workers perform a wide range of duties, which may include counseling clients, planning and implementing programming, fundraising, advocacy and administrative work.

    Individuals interested in a social work career must typically pursue a graduate degree in social work to become licensed. However, a bachelor’s degree in public health often qualifies individuals for entry-level social work positions, which do not require licensing, such as those with non-profit or community-based organizations.

    Social workers need to be comfortable working with individuals who face severe hardships and must be able to communicate well with a diverse array of people. They should be able to work independently at on-site locations, such as clients’ homes, homeless shelters, mental health organizations, schools or jails. Additionally, social works require critical thinking skills to assess the needs of clients and apply problem-solving techniques.

    The BLS reports that the field of healthcare social work should see rapid job growth of 19% between 2014 and 2024, largely due to an aging baby boomer generation, who, along with their families, will seek help from social workers to locate appropriate care. As of May 2015, healthcare social workers earned a mean income of $54,020 per year, according to the BLS.

    Health educators and healthcare social workers provide services related to personal and public healthcare to individuals and groups in the community. While a health educator may seek to inform individuals about how to prevent the spread of disease, a healthcare social worker may work with individuals who have a disease and are facing life changes due to illness.     An IRS Payment Plan is for taxpayers who can’t afford to pay off their entire back tax debt at once or for those who can’t make large payments to the IRS without experiencing an economic hardship. The key word here is hardship. One could say that anyone who is paying back the IRS for past due taxes is experiencing an economic hardship in that there are always more pleasurable things to do with one’s money. Unfortunately, the IRS doesn’t see it that way.

    In order to set up a Payment Plan for IRS back taxes and stop collection action. a taxpayer must demonstrate to the IRS that paying all that is due or making excessively large payments to the IRS would result in an undue economic hardship to the taxpayer. This is done by showing that payment of what the IRS is demanding would result in the taxpayer taking food off their family’s table or doing without some other necessity of life to give the money to the IRS instead. Fortunately for many people, this is not that difficult to demonstrate. Other times it is a bit harder, but there is almost always some type of resolution available.     The main benefit of setting up installment payments with the IRS is that it will put you back in compliance and you will no longer have to worry about the IRS knocking on your door. The IRS will have disappeared from your life and there will be no threat of levy and seizure (garnishment) of your wages, bank accounts, or any other property. The harassment by the IRS will be completely over, as long as you continue to make the agreed upon payments.

    It is possible that by having us take a look at your financial situation, you may actually qualify for a hardship deferment of collection action and be put on uncollectable status.     To view this in the proper perspective, you must look at it from the way the IRS Collections folks do. You see, they have all the power and hold most of the cards. What you have going for you are some reasonable outs provided by Congress and the IRS to keep the system efficient and within the bounds of reason. It is not efficient for the IRS to spend its time and money trying to collect a large sum of money from somebody who has no way of paying so large of an amount. The IRS and Congress have provided for this by instituting Payment Plans. The key is to make sure it is a Livable Payment Plan that you can afford and continue to pay without defaulting. This is what National Tax Relief makes sure of. You do not want to get coerced into a Payment Plan by a revenue officer in which the payments are so high that you will not be able to keep them up in the long run. If you get into a Payment Plan and later default, then you will be in bigger trouble than before.

    You must show the IRS on the proper forms that your allowable expenses are equal to, or only slightly less than, your income. This is how you show the IRS that you can pay them only an “affordable and livable amount” without “undue economic hardship. Your allowable expenses are what the IRS considers the necessities of life. In general, they are: food, clothing, housing, utilities, transportation, medical, insurance and work-related expenditures.     As of 2011, the fee for applying for CHFP certification — includes the price of one exam plus the application fee — is $395.

    If you don’t pass the test on your first try, you can retake it for an additional $200. In the event of a retake, the HFMA recommends that you wait at least 90 days before taking the test again to allow for additional preparation.

    While you’re allowed to bring a personal calculator to the exam, some restrictions apply if you have a calculator with more than four functions. These restrictions include the following:

    • Any calculator with a QWERTY keypad arrangement isn’t permitted
    • Any calculator with the following functions isn’t permitted: execute, memo, formula, program, forward, reverse, go to, run, learn, LRN
    • Non-communicating, non-programmable, battery-operated, silent, and non-printing calculators are allowed.

    Preparing for the Certified Healthcare Financial Professional Exam

    Although the HFMA emphasizes that experience as a healthcare financial manager is the foremost way to be prepared for the exam, it also offers an online study guide which, as of 2011, is available for $195.

    Because access to the online study guide is only available for one year, the HFMA recommends that the exam be taken within a year of purchasing preparation materials to allow for further study should you need to retake the test.

    537.080. Action for wrongful death–who may sue–limitation

    1. Whenever the death of a person results from any act, conduct, occurrence, transaction, or circumstance which, if death had not ensued, would have entitled such person to recover damages in respect thereof, the person or party who, or the corporation which, would have been liable if death had not ensued shall be liable in an action for damages, notwithstanding the death of the person injured, which damages may be sued for:

    (1) By the spouse or children or the surviving lineal descendants of any deceased children, natural or adopted, legitimate or illegitimate, or by the father or mother of the deceased, natural or adoptive;

    (2) If there be no persons in class (1) entitled to bring the action, then by the brother or sister of the deceased, or their descendants, who can establish his or her right to those damages set out in section 537.090 because of the death;

    (3) If there be no persons in class (1) or (2) entitled to bring the action, then by a plaintiff ad litem. Such plaintiff ad litem shall be appointed by the court having jurisdiction over the action for damages provided in this section upon application of some person entitled to share in the proceeds of such action. Such plaintiff ad litem shall be some suitable person competent to prosecute such action and whose appointment is requested on behalf of those persons entitled to share in the proceeds of such action. Such court may, in its discretion, require that such plaintiff ad litem give bond for the faithful performance of his duties.

    2. Only one action may be brought under this section against any one defendant for the death of any one person.

    537.090. Damages to be determined by jury–factors to be considered

    In every action brought under section 537.080, the trier of the facts may give to the party or parties entitled thereto such damages as the trier of the facts may deem fair and just for the death and loss thus occasioned, having regard to the pecuniary losses suffered by reason of the death, funeral expenses, and the reasonable value of the services, consortium, companionship, comfort, instruction, guidance, counsel, training, and support of which those on whose behalf suit may be brought have been deprived by reason of such death and without limiting such damages to those which would be sustained prior to attaining the age of majority by the deceased or by the person suffering any such loss.

    In addition, the trier of the facts may award such damages as the deceased may have suffered between the time of injury and the time of death and for the recovery of which the deceased might have maintained an action had death not ensued. The mitigating or aggravating circumstances attending the death may be considered by the trier of the facts, but damages for grief and bereavement by reason of the death shall not be recoverable.

    537.010. Action for damages to property to survive regardless of death of either party

    Actions for wrongs done to property or interests therein may be brought against the wrongdoer by the person whose property or interest therein is injured. If the person whose property or interest therein is injured is dead, the action survives and may be brought against the wrongdoer by the person appointed as fiduciary for the estate of the deceased person. If the wrongdoer is dead, the action also survives and may be brought and maintained in the manner set forth in section 537.021. Such actions shall be brought and maintained in the same manner and with like effect in all respects as actions founded upon contracts.

    537.020. Action for personal injury or death to survive regardless of death of either party

    1. Causes of action for personal injuries, other than those resulting in death, whether such injuries be to the health or to the person of the injured party, shall not abate by reason of his death, nor by reason of the death of the person against whom such cause of action shall have accrued; but in case of the death of either or both such parties, such cause of action shall survive to the personal representative of such injured party, and against the person, receiver or corporation liable for such injuries and his legal representatives, and the liability and the measure of damages shall be the same as if such death or deaths had not occurred. Causes of action for death shall not abate by reason of the death of any party to any such cause of action, but shall survive to the personal representative of such party bringing such cause of action and against the person, receiver or corporation liable for such death and his or its legal representatives.

    2. The right of action for death or the right of action for personal injury that does not result in the death shall be sufficient to authorize and to require the appointment of a personal representative by the probate division of the circuit court upon the written application therefor by one or more of the beneficiaries of the deceased. The existence of the right of action for death or personal injury that does not result in death shall be sufficient to authorize and to require the appointment of a personal representative for the person liable for such death or injury by the court having probate jurisdiction upon his death upon the written application of any person interested in such right of action for death or injury.

    537.030. Section 537.010 not to extend to what action

    Sections 537.010 and 537.020 shall not extend to actions for slander, libel, assault and battery or false imprisonment.

    Health Economics is an applied field of study that allows for the systematic and rigorous examination of the problems faced in promoting health for all. By applying economic theories of consumer, producer and social choice, health economics aims to understand the behavior of individuals, health care providers, public and private organizations, and governments in decision-making.

    Health economics is used to promote health through the study of health care providers, hospitals and clinics, managed care and public health promotion activities. Health economists apply the theories of production, efficiency, disparities, competition, and regulation to better inform the public and private sector on the most efficient, or cost-effective, and equitable course of action. Such research can include the economic evaluation of new technologies, as well as the study of appropriate prices, anti-trust policy, optimal public and private investment, and strategic behavior.

    What is a Public Cloud?

    The most recognisable model of cloud computing to many consumers is the public cloud model, under which cloud services are provided in a virtualised environment, constructed using pooled shared physical resources, and accessible over a public network such as the internet. To some extent they can be defined in contrast to private clouds which ring-fence the pool of underlying computing resources, creating a distinct cloud platform to which only a single organisation has access. Public clouds, however, provide services to multiple clients using the same shared infrastructure.

    The most salient examples of cloud computing tend to fall into the public cloud model because they are, by definition, publicly available. Software as a Service (SaaS) offerings such as cloud storage and online office applications are perhaps the most familiar, but widely available Infrastructure as a Service (IaaS) and Platform as a Service (PaaS) offerings, including cloud based web hosting and development environments, can follow the model as well (although all can also exist within private clouds). Public clouds are used extensively in offerings for private individuals who are less likely to need the level of infrastructure and security offered by private clouds. However, enterprise can still utilise public clouds to make their operations significantly more efficient, for example, with the storage of non-sensitive content, online document collaboration and webmail.

    The public model offers the following features and benefits:

    • Ultimate scalability ; cloud resources are available on demand from the public clouds’ vast pools of resource so that the applications that run on them can respond seamlessly to fluctuations in activity
    • Cost effective ; public clouds bring together greater levels of resource and so can benefit from the largest economies of scale. The centralised operation and management of the underlying resources is shared across all of the subsequent cloud services whilst components, such as servers, require less bespoke configuration. Some mass market propositions can even be free to the client, relying on advertising for their revenue.
    • Utility style costing ; public cloud services often employ a pay-as-you-go charging model whereby the consumer will be able to access the resource they need, when they need it, and then only pay for what they use; therefore avoiding wasted capacity
    • Reliability ; the sheer number of servers and networks involved in creating a public cloud and the redundancy configurations mean that should one physical component fail, the cloud service would still run unaffected on the remaining components. In some cases, where clouds draw resource from multiple data centres, an entire data centre could go offline and individual cloud services would suffer no ill effect. There is, in other words, no single point of failure which would make a public cloud service vulnerable
    • Flexibility ; there are a myriad of IaaS, PaaS and SaaS services available on the market which follow the public cloud model and that are ready to be accessed as a service from any internet enabled device. These services can fulfil most computing requirements and can deliver their benefits to private and enterprise clients alike. Businesses can even integrate their public cloud services with private clouds, where they need to perform sensitive business functions, to create hybrid clouds
    • Location independence ; the availability of public cloud services through an internet connection ensures that the services are available wherever the client is located. This provides invaluable opportunities to enterprise such as remote access to IT infrastructure (in case of emergencies etc) or online document collaboration from multiple locations.

Our curriculum offers more than 30 areas of specialization, including IT/e-government, homeland security, financial market regulation, non-profit management, local government management, public finance, and health policy. The diversity of our offerings reflects the diversity of our faculty: 24 experts drawn from seven fields, plus a set of master practitioners who bring their wealth of experience to the classroom.
