The Real Issues of End-of-Life Care

The health-care-reform bill the U.S. House of Representatives will debate when it returns from recess next month contains a provision that would have Medicare reimburse doctors for counseling patients on end-of-life care every five years. Opponents of health-care reform have latched onto the provision, claiming it would lead to forced euthanasia or “death panels” to decide whether lifesaving care for the elderly is cost-effective despite the fact that the bill says nothing about either of these frightening issues. In fact, geriatricians doctors trained specifically to care for the elderly support the provision, arguing that it will encourage patients to express their own preferences rather than leave doctors and family members to guess what they want once they’re no longer able to say so themselves. There are only about 7,500 geriatricians in the U.S. and one of them is Dr. Laurie Jacobs, vice chairman of the Department of Medicine at Albert Einstein College of Medicine and Montefiore Medical Center in New York City. Jacobs, who has been a practicing geriatrician since 1988, talked to TIME about why end-of-life counseling is important, when it should start and how to talk to patients and families about planning for death. Does this House provision for funding end-of-life counseling concern you?
This provision says that people should talk about what their goals of care are and what they want at the end of life. That could be anything. This is an opportunity for patients and physicians to share information with each other and come up with a plan. It is one of the special things about being a physician. You get to know your patient and what matters to them, and their inner thoughts, and their lives, and that’s a very special role that most physicians value and that patients appreciate.

How important is Medicare reimbursement for doctors counseling patients about end-of-life care?
For some people one conversation is enough, and you get the whole picture and they tell you exactly what they want. For other people, 10 conversations in 10 weeks won’t suffice. Coverage for this is expensive, but I think offering it is a wonderful first step in highlighting the importance of it by paying for it.

What kind of end-of-life-care counseling do you provide to your patients? How does it work?
Many patients have chronic illness and some disability or medical issue, and part of providing care is to speak with them about what to expect with their illness, what alternatives exist, and to have a conversation about what their preferences are. This shouldn’t just happen at the end of life. You should get to know people and have these conversations throughout providing care. I like to talk individually with the patient if they are comfortable with that. If they are more comfortable with having family members there at the time, then I do it with the group. What I need to know from the patients is how they view their illness in the context of their life. Did they know somebody else with the same condition and therefore they have some preconceived idea about this? What are their values? How to they want to live their life? I also talk to them about whether there is someone who could make decisions for them if they are unable in the future.

How often do you provide end-of-life counseling?
It comes up very frequently in our practice, either with new patients who present very ill, or patients we have known for a very long time that have encountered a new serious condition that may be life-threatening. Death is not an option. Everyone is going to die at some point.

How important is for you to talk with people about options like hospice or do-not-resuscitate orders? This must be really stressful for patients and their families.
That’s why it’s so important to talk about values and preferences long before you are at the moment of having to do an intervention. If I have a patient who has early dementia, they still may be able to participate in a conversation about what matters to them, how they want to live their life, who they want to make decisions, and it may be 10 years before the point at which an illness happens and an intervention may be required. So, it enables me to get a sense of who they are and what’s important to them. When you talk to family members when a patient cannot participate in the conversation, it’s even more difficult. If it was for themselves, they might say, “Gee, I don’t want to go through that,” but they are afraid to limit options for family members, and I can understand that. If a proxy knows that the patient always said, “This is how I want to live my life, this is how I want my life to end,” they feel very much more comfortable in making those decisions. So I think the fact that there is some national conversation about this is good in that it starts people talking to their friends and family about what is important to them.

How often does money come up with families or patients when you are talking about end-of-life care?
This is a question that medical students often ask. Health-care finance and social issues regarding health-care expenditures nationally are policy issues, and they are never to be decided at the bedside.

Trespassing Basics

Trespassing is a legal term that can refer to a wide variety of offenses against a person or against property. Trespassing as it relates to real estate law means entering onto land without consent of the landowner. There are both criminal and civil trespass laws. Criminal trespass law is enforced by police, sheriffs, or park rangers. Civil trespass requires that the landowner initiate a private enforcement action in court to collect any damages for which the trespasser may be responsible (regardless of whether a crime has been committed).

Intent and Knowledge Requirements

Traditionally, for either type of trespass — criminal or civil — some level of intent is required. Thus, the trespasser must not simply unwittingly traverse another’s land but must knowingly go onto the property without permission. Knowledge may be inferred when the owner tells the trespasser not to go on the land, when the land is fenced, or when a no trespassing sign is posted. A trespasser would probably not be prosecuted if the land was open, the trespasser’s conduct did not substantially interfere with the owner’s use of the property, and the trespasser left immediately on request.

The landowner may indicate — verbally or in writing — permission to enter onto the land.

The existence of consent may be implied from the landowner’s conduct, from custom, or from the circumstances. Consent may be implied if the landowner was unavailable to give consent, and immediate action is necessary to save a life or prevent a serious injury.

Homeowner Liability: What if a Trespasser Gets Hurt?

As bizarre as this may sound, there are some limited protections for trespassers if they get injured while in the act, so to speak. Homeowners can typically be liable to trespassers if they willfully injured the person or knew or should have known about the presence of frequent trespassers and kept an unsafe condition.

What does all this mean? Well, let’s say you, as a homeowner, set up a booby trap for a trespasser that sets off a shotgun if someone triggers a wire. Now let’s say that happens and it causes severe injuries to the trespasser. While this might seem unjust to some, you may be a liable for the injuries the trespasser sustains. More examples include booby traps, trip wires, bear traps, bamboo tiger pits, and other devices.

What are some things you can legally do? For one, if you are concerned about trespassers coming onto your land, start with a Private Property or No Trespassing sign in a visible place. Not only does it put the trespassers on notice, it conveys your intent to keep your land to yourself and not as a make-shift easement for others. Next, you should consider installing video cameras in the traveled area. The presence of the camera itself can be a deterrent to some. Be sure you are up-to-date on your state’s laws regarding videotaping or filming before installing a camera. You can do this by speaking with a local attorney.

Look, over there. Floating above that hospital bed. Isn’t that Mrs. Johnson’s mother? Wait, she’s not gone yet. Maybe she just went on a trial run to the great beyond, since she’s not going to be with us for too much longer. If we hang around for a day or two, we might really get to see dead people. There’s just something calming about someone (not us, of course) getting ready to hop aboard with The Boatman. getting ready to cross the old River Styx.

Really, you might think of this old woman’s transition, the one from life to death, as the ultimate escape. maybe the best vacation of her life. For her family, not so much. Mrs. Johnson is pretty broken up, but she’s happy the hospice nurses have kept her mother comfortable and pain free. This palliative care, as they call it, includes some pretty powerful pain medication. Tania, the hospice social worker, has been a big help, too. She’s outside in the sitting room, trying to give the family some privacy. However, they know she’s nearby if they get into emotional overload. and when Mrs. Johnson’s mom decides to make her final exit stage left.

Before we delve any further into a hospice social worker career, let’s clarify that this job is completely different than a hospice worker/health care aide position. A hospice social worker position involves years of social work education and professional experience; whereas a hospice worker/health care aide is generally an entry-level, medically based position.

So… hospice social workers. We have seen that this caring, compassionate professional provides emotional support to families of terminally ill patients. The hospice social worker also focuses on patients’ emotional needs, helping to guide the patient through the end-of-life challenges he or she faces. These family and patient discussions can take place at any time – day or night.

In order for the hospice social worker to provide the best possible service to the patient and family, the social worker must first determine their respective needs. She performs a preliminary assessment that helps her identify the patient’s and family’s strengths and coping abilities. She notes any unusual or especially difficult challenges they face, and recommends resources to help them deal with the turmoil. She may provide counseling if she feels it’s appropriate. Finally, she may mediate conflicts between the family and caregivers, or even between family members themselves.

However, our hospice social worker also performs several more mundane functions. She may work with the family to coordinate financial resources so the patient can continue to receive hospice care. She may help the family navigate the endless paperwork that seems to accompany health care services. In her spare time(!), the hospice social worker may serve as an advocate for hospice care for everyone, regardless of their (or their family’s) ability to pay.

Note that the hospice social worker does not function as Superwoman. She considers herself one part of an interdisciplinary care team, consisting of the patient’s physician, nurse(s), chaplain, rabbi, or priest and, of course, family members. In some cases, volunteers may also be part of the care team. A volunteer might stay with the patient much of the time, informing trained medical personnel if something of concern arises.

Now that we know what a hospice social worker does, the next logical question is: who does she work for? Although hospice organizational structures vary, you’ll probably find that some hospice facilities are registered non-profits. A non-profit structure will definitely open the door to community fundraising events. A hospital may also operate its own hospice facility. Unless you operate the hospice facility as your own business, you’ll likely function as an employee with the benefits that accrue to other company staffers.

You’ve probably realized that a hospice social worker has wide-ranging responsibilities. You might also wonder if your personality traits make you a good fit for this career. First, you’ve got to have compassion and patience. You will be working with patients and families who may be in fragile emotional states. Otherwise rational adults may refuse to acknowledge a simple point due to emotional duress. You must be patient, tolerant, and willing to put your irritation aside to help them work through it.

You must also have a really good sense of organization. You will probably be working with multiple patients and families; this means you can’t afford to get your paperwork and appointments mixed up. You must also be comfortable working with different types of professionals on the interdisciplinary care team.

Finally, you must be able to handle unexpected circumstances without batting an eye. Patients don’t always take a turn for the worse between 9 a.m. and 5 p.m. Doctors may call you when they finish their surgeries and patient rounds, whether it’s 6 a.m. or 4 p.m. They might not call you at all, which might mean you have to chase them down on the golf course (by telephone, of course).

You will, of course, have numerous ups and downs in this career. Although some people might find working with terminally ill patients and their families depressing, you might consider it a privilege to help them through this life-changing event. You may receive emotional and spiritual benefits you never even considered. However, the downside is that most of your patients will die at some point, and you must be prepared to handle that. In addition, you may find yourself working with some younger hospice patients, including children. This may prove especially unsettling, but could also provide you with examples of the true meaning of courage and optimism.

Finally, let’s say you enjoy working with patients or clients, although you don’t think you’re suited for a hospice social worker career. You might consider a licensed clinical social worker career, which also requires a Master’s Degree in Social Work, but may provide more wide-ranging professional opportunities. A licensed psychologist, child psychologist, or rehabilitation counselor career may interest you as well.

The Real Cost of a DUI in California

Most of us are well aware of the dangers of drinking and driving. The exponentially increased risk of hurting yourself and others in an accident should be more than enough to deter everyone from driving under the influence (DUI). Still, just to make the case against drinking and driving even stronger we can take a look at the outrageous cost you will meet if you are convicted of a DUI. From having your car impounded when you get caught to license reinstatement fees after your driver’s license gets suspended, several factors go into the true cost of a DUI.

Car Insurance Increase

It’s not exactly a secret that car insurance premiums increase after a DUI, but many people might not realize that this increase is the highest DUI-related cost. This may be because people think of the increase in the short term, since insurance coverage is usually only bought months at a time. However, there is more to the short term when it comes to a DUI-related car insurance increase. To reinstate your driver’s license after it has been suspended due to a DUI in California, you must file a proof of financial responsibility with the court known as a SR-22. After a DUI you will be required to file your SR-22 for at least 3 years. Your insurance company will take care of this for you, but it will come with a hefty increase in your premium. After you are no longer required to file a SR-22, your car insurance premium may lower a bit, but will likely remain well above standard car insurance rates. These several years of increased rates will quickly add up and when all is said and done you may end up paying up to approximately $40,000 in insurance rate increases over the years.

Towing and Storage

When a police officer catches you drinking and driving, you will be arrested, and your car will be impounded. The costs of towing and storage can reach about $685 and can even get higher the longer you keep your car in storage.

DUI Classes

After a DUI conviction, you will be required to enroll in and complete a DUI course. The length of time you will have to attend a course will depend on the severity of your DUI violation, but you can expect to pay at least $650 for the course.

Fines and Attorney Fees

If you are caught drinking and driving you will have to go to court.

A Note about Lawyers

It is rarely a good idea to go to court without legal representation. This is especially true for such a serious case as driving under the influence. Even if you know for certain that you are guilty, you should have an attorney who can help protect you from excessive penalties. There are several DUI attorneys who can help you with your case. If the court does find you guilty of a DUI you can expect to pay hefty fines. With these fines and the addition of attorney fees you are looking to pay around $4,000 after your court conviction.

Driver’s License Reinstatement

When you are caught driving over the legal limit your driver’s license will be suspended. Once the duration of your suspension has ended, and you have fulfilled any other requirements to be eligible to get your license back, you will have to pay a license reinstatement fee. The True Cost of a DUI

Added together all of these DUI-related costs mean you should be ready to pay an estimated $45,435 for a DUI. Keep in mind that this is an estimated minimum for a first-time offense. There is a very good chance you could end up paying more and the number will just keep increasing after each violation. So it is easy to see that getting behind the wheel after drinking is just not worth it. A cab ride is going to cost nowhere near $45,000. Save some money and some lives, don’t drink and drive.

Is the Tiny House Market Worth Investing In?

As a real estate investor and coach, I’m always on the lookout for the latest investment opportunities. A lot of the times my students ask me, “Marko Rubel, how do you spot a real estate investment opportunity? What’s the latest out there on the market?” A lot of it is all about research and, lately, there’s been one popular housing trend I believe has investment potential that hasn’t yet been captured.

It has been called the “Tiny House Movement,” and boy is it ever a movement. The latest real estate trend sweeping the nation is a very small thing: tiny houses (also known as micro houses, compact houses, mini houses, and little houses). Ranging between a compact 100 square feet to the more “spacious” 500 square feet, the tiny home is a movement centered around downsizing and the notion that you should be able to afford the home you live in.

The tiny housing market has quickly evolved from a quirky project to a serious undertaking. As more and more tiny homeowners share details on their comfortable lives in their tiny homes, many people — particularly Millennials — are following suit. Already, there have been documentaries and a docuseries about the tiny house movement, and new blogs and websites dedicated to tiny housing and their homeowners are appearing every day. There are even workshops teaching people how to build their own tiny house.

As 2015 has proven thus far to be a seller’s market, and with properties only increasing in price, the tiny house market will only continue to grow this year. Like other trends, one this influential must be worth considering. Lately, I’ve heard several people ask, “Marko Rubel, what what is the investment potential for tiny houses? Should I consider investing in this new market?”

The answer is yes, you should certainly consider whether it’s a good move for you. First, let’s look at the appeal of building and owning a tiny house. A tiny house costs anywhere between $10,000 and $40,000 to build, with the average being just $23,000. At such low prices, it’s no wonder that 68 percent of tiny house owners don’t have a mortgage.     REITs, an investment vehicle for real estate that is comparable to a mutual fund. allowing both small and large investors to acquire ownership in real estate ventures, own and in some cases operate commercial properties such as apartment complexes, hospitals, office buildings, timber land, warehouses, hotels and shopping malls.

    All REITs must have at least 100 shareholders, no five of whom can hold more than 50% of shares between them. At least 75% of a REIT’s assets must be invested in real estate, cash or U.S. Treasurys; 75% of gross income must be derived from real estate.

    REITs are required by law to maintain dividend payout ratios of at least 90%, making them a favorite for income-seeking investors. REITs can deduct these dividends and avoid most or all tax liabilities, though investors still pay income tax on the payouts they receive. Many REITs have dividend reinvestment plans (DRIPs​). allowing returns to compound over time.

    REIT History

    REITs have existed for more than 50 years in the U.S. Congress granted legal authority to form REITs in 1960 as an amendment to the Cigar Excise Tax Extension of 1960. That year The National Association of Real Estate Investment Funds, a professional group for the promotion of REITs is founded. The following year it changed its name to the National Association of Real Estate Investment Trusts (NAREIT) .

    In 1965 the first REIT, Continental Mortgage Investors, is listed on the New York Stock Exchange (NYSE). Mortgage based REITs account for much of the growth of REITs in the early 1970s, and they fuel a housing boom. The boom busts after the oil shocks of 1973 and the recession that follows.

    In 1969 the first European REIT legislation (the Fiscal Investment Institution Regime [fiscale beleggingsinstelling. FBI]) is passed in The Netherlands.

    International REITs

    ​Since their development in Europe, REITs have become available in many countries outside the United States on every continent on Earth.

    The first listed property trusts launch in Australia in 1971.

    Canadian REITs debut in 1993, but they don’t become popular investment vehicles until the beginning of the 21st century.

    REITs began to spread across Asia with the launch of Japanese REITs in 2001.

    REITs in Europe were buoyed by legislation in France (2003), Germany (2007) and the U.K. (2007). In total, about 40 countries now have REIT legislation.

    3 Main Kinds of REITs in the U.S.

    1. Equity REITs invest in and own properties, that is, they are responsible for the equity or value of their real estate assets. Their revenues come principally from leasing space—such as in an office building—to tenants. They then distribute the rents they’ve received as dividends to shareholders. Equity REITs may sell property holdings, in which case this capital appreciation is reflected in dividends. Timber REITs will include capital appreciation from timber sales in their dividends. Equity REITs account for the vast majority of REITs.

    2. Mortgage REITs invest in and own property mortgages. These REITs loan money for mortgages to real estate owners, or purchase existing mortgages or mortgage-backed securities. Their earnings are generated primarily by the net interest margin. the spread between the interest they earn on mortgage loans and the cost of funding these loans. This model makes them potentially sensitive to interest rate increases. In general, mortgage REITs are less highly leveraged than other commercial mortgage lenders, using a relatively higher ratio of equity to debt to fund themselves.

    3. Hybrid REITs invest in both properties and mortgages.

    Individuals can invest in REITs either by purchasing their shares directly on an open exchange or by investing in a mutual fund that specializes in public real estate. Some REITs are SEC -registered and public, but not listed on an exchange; others are private.

    Some REITs will invest specifically in one area of real estate—shopping malls, for example—or in one specific region, state or country. Others are more diversified. There are several REIT ETFs available, most of which have fairly low expense ratios. The ETF format can help investors avoid over-dependence on one company, geographical area or industry.

    REITs provide a liquid and non-capital intensive way to invest in real estate. Many have dividend yields in excess of 10%. REITs are also largely uncorrelated with stocks and bonds, meaning they provide a measure of diversification .

    Editorial: At Mary Potter Hospice, Wellington’s density debate gets real

    OPINION: Mary Potter Hospice, a much-admired Wellington institution, proposes to build a five-storey apartment block on its Newtown property.

    With this investment, the hospice hopes to secure itself financially in readiness for the oncoming tide of older people in need of its free care. It currently raises $5 million per year with a mixture of street appeals, thrift shops and the like, but will soon need far more.

    Neighbouring residents, however, are angry about the idea. “Ugly as hell,” says one. “Something out of the Soviet Union planning book,” says local MP Annette King. Along with its aesthetic shortcomings, they say the building will block their sun and put too much pressure on parking in the area.

    This is an interesting case on all sorts of levels. It is, for instance, one more indication of the stress that is coming to bear on the health sector as the silver tsunami crests.

    The Government ought to have been planning for this need seriously, from grappling with a ballooning superannuation liability, to funding palliative care providers properly. Instead, apart from the odd morsel, it has mostly ignored the problem, which may prove costly in coming decades: not every hospice has desirable land it can develop.

    The case is also a vivid example of what is often an abstract debate about denser housing. Wellington City Council, after all, singled out the Mary Potter land as a “special housing area” ripe for fast development up to six storeys high.

    Whether cherry-picking such sites is quite the right approach is debatable – it means neighbours of the hospice face a large development next door, while those down the street have no such possibility. (Slimmer allowances across broader parts of the city might have been fairer).

    Yet the council’s appetite for more density is generally right, and Newtown is a good candidate for it. It has ample public transport links, a plausible walk to the city, and the hospital and airport nearby. The need is pressing: housing in Wellington has been too expensive for too long. Many people who would once have been able to live in Newtown cannot afford to do so now, unless they live in council housing.

    But what of the residents’ concerns? Aesthetic gripes should not weigh heavily. Opinions will vary of the building’s design merits, and it is not for neighbours to cripple a project because of their taste. Parking concerns, too, ought to be met by acknowledging that on-street parking is not a right, especially for people yet to buy property. City apartment dwellers, for instance, do not expect a permanent carpark on the street.

    Concerns about sun deserve more sympathy; everyone can understand how important that is to quality of life. The proposal is for a large building, and the effects could be significant; the hospice might consider trimming its design somewhat in response. (It might also have considered earlier and better talk with its neighbours).

    In the end, however, Wellington must find a way to accommodate new housing, even over the concerns of existing owners. A city that always says “no” is one that will only become more expensive, exclusive and, ultimately, lifeless.

    Terminally Ill Woman Brittany Maynard Has Ended Her Own Life

    Brittany Maynard. who became the public face of the controversial right-to-die movement over the last few weeks, ended her own life Saturday at her home in Portland, Oregon. She was 29.

    “Goodbye to all my dear friends and family that I love. Today is the day I have chosen to pass away with dignity in the face of my terminal illness, this terrible brain cancer that has taken so much from me … but would have taken so much more,” she wrote on Facebook. “The world is a beautiful place, travel has been my greatest teacher, my close friends and folks are the greatest givers. I even have a ring of support around my bed as I type … Goodbye world. Spread good energy. Pay it forward!”

    Doctors told Maynard she had six months to live last spring after she was diagnosed with a likely stage 4 glioblastoma. She made headlines around the world when she announced she intended to die under Oregon’s Death with Dignity Act by taking a fatal dose of barbiturates, prescribed to her by a doctor, when her suffering became too great.

    “My glioblastoma is going to kill me and that’s out of my control,” she told PEOPLE last month. “I’ve discussed with many experts how I would die from it and it’s a terrible, terrible way to die. So being able to choose to go with dignity is less terrifying.”

    On Oct. 6, she launched an online video campaign with Compassion Choices. an end-of-life choice advocacy organization, to fight for expanding death-with-dignity laws nationwide.

    “For people to argue against this choice for sick people really seems evil to me,” she told PEOPLE. “They try to mix it up with suicide and that’s really unfair, because there’s not a single part of me that wants to die. But I am dying.”

    A Heartbreaking Choice

    Arriving at her decision was a gradual one, she said.

    “It’s not a decision you make one day and you snap your fingers,” she told PEOPLE.

    She said she began thinking about death with dignity in January when she was first diagnosed with a malignant brain tumor after coming across an article on it while researching possible treatments.

    “Really, from the beginning, all the doctors said when you have a glioma you’re going to die,” she told PEOPLE. “You can just Google it. People don’t survive this disease. Not yet.”

    Doctors removed as much of the tumor as they could, but it came back larger than ever two months later, she said.

    After researching her options, she decided not to try chemotherapy or radiation.

    “They didn’t seem to make sense for me,” she said, because of “the level of side effects I would suffer and it wouldn’t save my life. I’ve been told pretty much no matter what, I’m going to die and treatments would extend my life but affect the quality pretty negatively.”

    In June, she moved to Oregon with her husband, Dan Diaz, 43, her mother, Debbie Ziegler, 56. and her stepfather, Gary Holmes, 72, so she could have access to the state’s Death with Dignity Act, which allows physicians to prescribe life-ending medication to certain terminally ill patients.

    Maynard originally told PEOPLE she’d chosen Nov. 1 to end her life, but on Thursday she released a new video saying she might not do it that day.

    “I still smile and laugh with my family and friends enough that it doesn’t seem like the right time now,” she said in the video recorded Oct. 13 and 14, “but it will come because I feel myself getting sicker; it’s happening each week.”

    Her Final Months

    Maynard spent the last months of her life making the most of the time she had left. She traveled to Alaska, British Columbia and Yellowstone National Park with her loved ones and explored more local attractions like Olympic National Park in Washington.

    On Oct. 21, she and her family took a helicopter ride to the Grand Canyon. a place she’d been longing to see before she died.

    “It was breathtakingly beautiful,” she said in a statement.

    The following morning, though, she had her “worst seizure” so far, she said: “The seizure was a harsh reminder that my symptoms continue to worsen as the tumor runs its course.”

    Maynard said she was deeply touched by the “outpouring of support” she got after going public with her diagnosis and her decision.

    “I want to thank people for that, for the words of kindness, for the time they’ve taken in personal ways,” she told PEOPLE.

    “And then beyond that, to encourage people to make a difference,” she said. “If they can relate to my story, if they agree with this issue on a philosophical level, to get out there and do what we need to do to make a change in this country.”

    Maynard also talked to PEOPLE about her legacy.

    “For me what matters most is the way I’m remembered by my family and my husband as a good woman who did my best to be a good wife and a good daughter,” she said.

    “Beyond that, getting involved with this campaign, I hope to be making a difference here,” she said. “If I’m leaving a legacy, it’s to change this health-care policy or be a part of this change of this health-care policy so it becomes available to all Americans. That would be an enormous contribution to make, even if I’m just a piece of it.”

    Before she died, Maynard asked her husband and her mother if they would carry on the work she started to get death with dignity passed in every state.

    “I want to work on the cause,” Ziegler told PEOPLE last month. “I have so much admiration for people who are terminally ill and just fight and fight. They are so dignified and brave. This is a different choice, but it is also brave and dignified.”

    She also shared with them her hopes and dreams for their future. Upstairs in the home she shares with her family are neatly wrapped Christmas and birthday gifts for her loved ones for the next year.

    “She made it clear she wants me to live a good life,” Ziegler says.

    In her second video, Maynard, who is an only child, said she hoped her mother does not “break down” or “suffer from any kind of depression.”

    And for Diaz, “I hope he moves on and becomes a father,” she said. “There’s no part of me that wants him to live out the rest of his life just missing his wife.”

    The Real Issues of End-of-Life Care

    The health-care-reform bill the U.S. House of Representatives will debate when it returns from recess next month contains a provision that would have Medicare reimburse doctors for counseling patients on end-of-life care every five years. Opponents of health-care reform have latched onto the provision, claiming it would lead to forced euthanasia or “death panels” to decide whether lifesaving care for the elderly is cost-effective despite the fact that the bill says nothing about either of these frightening issues. In fact, geriatricians doctors trained specifically to care for the elderly support the provision, arguing that it will encourage patients to express their own preferences rather than leave doctors and family members to guess what they want once they’re no longer able to say so themselves. There are only about 7,500 geriatricians in the U.S. and one of them is Dr. Laurie Jacobs, vice chairman of the Department of Medicine at Albert Einstein College of Medicine and Montefiore Medical Center in New York City. Jacobs, who has been a practicing geriatrician since 1988, talked to TIME about why end-of-life counseling is important, when it should start and how to talk to patients and families about planning for death.     Does this House provision for funding end-of-life counseling concern you?
    This provision says that people should talk about what their goals of care are and what they want at the end of life. That could be anything. This is an opportunity for patients and physicians to share information with each other and come up with a plan. It is one of the special things about being a physician. You get to know your patient and what matters to them, and their inner thoughts, and their lives, and that’s a very special role that most physicians value and that patients appreciate.

    How important is Medicare reimbursement for doctors counseling patients about end-of-life care?
    For some people one conversation is enough, and you get the whole picture and they tell you exactly what they want. For other people, 10 conversations in 10 weeks won’t suffice. Coverage for this is expensive, but I think offering it is a wonderful first step in highlighting the importance of it by paying for it.

    What kind of end-of-life-care counseling do you provide to your patients? How does it work?
    Many patients have chronic illness and some disability or medical issue, and part of providing care is to speak with them about what to expect with their illness, what alternatives exist, and to have a conversation about what their preferences are. This shouldn’t just happen at the end of life. You should get to know people and have these conversations throughout providing care. I like to talk individually with the patient if they are comfortable with that. If they are more comfortable with having family members there at the time, then I do it with the group. What I need to know from the patients is how they view their illness in the context of their life. Did they know somebody else with the same condition and therefore they have some preconceived idea about this? What are their values? How to they want to live their life? I also talk to them about whether there is someone who could make decisions for them if they are unable in the future.

    How often do you provide end-of-life counseling?
    It comes up very frequently in our practice, either with new patients who present very ill, or patients we have known for a very long time that have encountered a new serious condition that may be life-threatening. Death is not an option. Everyone is going to die at some point.

    How important is for you to talk with people about options like hospice or do-not-resuscitate orders? This must be really stressful for patients and their families.
    That’s why it’s so important to talk about values and preferences long before you are at the moment of having to do an intervention. If I have a patient who has early dementia, they still may be able to participate in a conversation about what matters to them, how they want to live their life, who they want to make decisions, and it may be 10 years before the point at which an illness happens and an intervention may be required. So, it enables me to get a sense of who they are and what’s important to them. When you talk to family members when a patient cannot participate in the conversation, it’s even more difficult. If it was for themselves, they might say, “Gee, I don’t want to go through that,” but they are afraid to limit options for family members, and I can understand that. If a proxy knows that the patient always said, “This is how I want to live my life, this is how I want my life to end,” they feel very much more comfortable in making those decisions. So I think the fact that there is some national conversation about this is good in that it starts people talking to their friends and family about what is important to them.

    How often does money come up with families or patients when you are talking about end-of-life care?

    Look, over there. Floating above that hospital bed. Isn’t that Mrs. Johnson’s mother? Wait, she’s not gone yet. Maybe she just went on a trial run to the great beyond, since she’s not going to be with us for too much longer. If we hang around for a day or two, we might really get to see dead people. There’s just something calming about someone (not us, of course) getting ready to hop aboard with The Boatman. getting ready to cross the old River Styx.

    Really, you might think of this old woman’s transition, the one from life to death, as the ultimate escape. maybe the best vacation of her life. For her family, not so much. Mrs. Johnson is pretty broken up, but she’s happy the hospice nurses have kept her mother comfortable and pain free. This palliative care, as they call it, includes some pretty powerful pain medication. Tania, the hospice social worker, has been a big help, too. She’s outside in the sitting room, trying to give the family some privacy. However, they know she’s nearby if they get into emotional overload. and when Mrs. Johnson’s mom decides to make her final exit stage left.

    Before we delve any further into a hospice social worker career, let’s clarify that this job is completely different than a hospice worker/health care aide position. A hospice social worker position involves years of social work education and professional experience; whereas a hospice worker/health care aide is generally an entry-level, medically based position.

    So… hospice social workers. We have seen that this caring, compassionate professional provides emotional support to families of terminally ill patients. The hospice social worker also focuses on patients’ emotional needs, helping to guide the patient through the end-of-life challenges he or she faces. These family and patient discussions can take place at any time – day or night.

    In order for the hospice social worker to provide the best possible service to the patient and family, the social worker must first determine their respective needs. She performs a preliminary assessment that helps her identify the patient’s and family’s strengths and coping abilities. She notes any unusual or especially difficult challenges they face, and recommends resources to help them deal with the turmoil. She may provide counseling if she feels it’s appropriate. Finally, she may mediate conflicts between the family and caregivers, or even between family members themselves.

    However, our hospice social worker also performs several more mundane functions. She may work with the family to coordinate financial resources so the patient can continue to receive hospice care. She may help the family navigate the endless paperwork that seems to accompany health care services. In her spare time(!), the hospice social worker may serve as an advocate for hospice care for everyone, regardless of their (or their family’s) ability to pay.

    Note that the hospice social worker does not function as Superwoman. She considers herself one part of an interdisciplinary care team, consisting of the patient’s physician, nurse(s), chaplain, rabbi, or priest and, of course, family members. In some cases, volunteers may also be part of the care team. A volunteer might stay with the patient much of the time, informing trained medical personnel if something of concern arises.

    Now that we know what a hospice social worker does, the next logical question is: who does she work for? Although hospice organizational structures vary, you’ll probably find that some hospice facilities are registered non-profits. A non-profit structure will definitely open the door to community fundraising events. A hospital may also operate its own hospice facility. Unless you operate the hospice facility as your own business, you’ll likely function as an employee with the benefits that accrue to other company staffers.

    You’ve probably realized that a hospice social worker has wide-ranging responsibilities. You might also wonder if your personality traits make you a good fit for this career. First, you’ve got to have compassion and patience. You will be working with patients and families who may be in fragile emotional states. Otherwise rational adults may refuse to acknowledge a simple point due to emotional duress. You must be patient, tolerant, and willing to put your irritation aside to help them work through it.

    You must also have a really good sense of organization. You will probably be working with multiple patients and families; this means you can’t afford to get your paperwork and appointments mixed up. You must also be comfortable working with different types of professionals on the interdisciplinary care team.

    Finally, you must be able to handle unexpected circumstances without batting an eye. Patients don’t always take a turn for the worse between 9 a.m. and 5 p.m. Doctors may call you when they finish their surgeries and patient rounds, whether it’s 6 a.m. or 4 p.m. They might not call you at all, which might mean you have to chase them down on the golf course (by telephone, of course).

    You will, of course, have numerous ups and downs in this career. Although some people might find working with terminally ill patients and their families depressing, you might consider it a privilege to help them through this life-changing event. You may receive emotional and spiritual benefits you never even considered. However, the downside is that most of your patients will die at some point, and you must be prepared to handle that. In addition, you may find yourself working with some younger hospice patients, including children. This may prove especially unsettling, but could also provide you with examples of the true meaning of courage and optimism.

    Finally, let’s say you enjoy working with patients or clients, although you don’t think you’re suited for a hospice social worker career. You might consider a licensed clinical social worker career, which also requires a Master’s Degree in Social Work, but may provide more wide-ranging professional opportunities. A licensed psychologist, child psychologist, or rehabilitation counselor career may interest you as well.

    This motel thinks they are the Hilton. The staff in every department including manegment are some of the rudest people I have encountered. You walk in the building and it smells aweful of the pot smell. This is known even in wyoming as a drug motel. The rooms are nothing to brag about. We had to stay for months to due work. We were put on the back side for a quieter stay. The garbage trucks and alarms makes sure that doesn’t happen. The police are in the parking lot and motel ALL the time. So if you wanted to be treated like dirt by the staff and stay in a stinky dirty place this is it. We travel all over the usa and this is the worst place we have ever stayed.

    American Motel is our mainstay. We live over 2 hours away farther into the rocky mountains. Whenever we go down to the Denver area for doctors visits, etc. we always stay the night here at the American Motel. Its very inexpensive, clean, and everyone is always so nice and courteous. We are both disabled and American has a few rooms for those who are handicapped. These are great. The rooms are on the first floor, and you have a slider door that opens to the parking side of the hotel, which makes easy access for my oxygen machine and equipment, you can park right up to your door to unload and pack. That is so important to us. This hotel satisfies virtually every requirement. My only complaint is, I didn’t have easy access for my computer, however, with the hotel’s location, I was able to easily access the many networks in the area.
    Bottom line, I give this hotel at least 4 stars for the cost and cleanliness and courtesy alone!

    I guess it was a wrong choice to visit Phuket city as there wasn t much to explore within city and.

    considering the fact the places that we wanted to visit were situated far away from our hotel and taxi fares were too expensive. We visited Tiger Kingdom, Trick Eye Museum, Phi Phi Island, a bit of shopping at City Centre, Thalang, etc. May be next time if I come to visit Phuket, I’d prefer to stay at Patong beach instead.

    Truth be known even though both of the hotels I stayed at were clean and comfortable, I doubt I will.

    ever return to Phuket. The beaches are amazing, but there is garbage everywhere, and with the exeption of a few taxis, Tuk Tuks and restaraunts, the shopping and taxis at the Airport is way over-priced. It is more expensive than just about everywhere else I visited, although the soup I got from the vendor stand across the alley from the family mart (accross the street and to the left from the airport) was some of the best soup I had in Thailand.

    Phuket is blessed with many beautiful beaches and islands nearby. It also have good facilities and.

    We ve stayed at 2 hotels in Phuket one is in Patong and the other one is in Laguna. The difference.

    about the two is that Patong would cater more from the young adults to a more mature crowd, who wanted to party and experience the local food. As for Laguna this would cater to families and business men as this is more laid back and more on the upper class as it’s a little bit more expensive than the usual hotels in Patong.

    You love it or not. You can go for partying or with your family and enjoy a calm stay with enjoying.

    Terminally Ill Woman Brittany Maynard Has Ended Her Own Life

    Brittany Maynard. who became the public face of the controversial right-to-die movement over the last few weeks, ended her own life Saturday at her home in Portland, Oregon. She was 29.

    “Goodbye to all my dear friends and family that I love. Today is the day I have chosen to pass away with dignity in the face of my terminal illness, this terrible brain cancer that has taken so much from me … but would have taken so much more,” she wrote on Facebook. “The world is a beautiful place, travel has been my greatest teacher, my close friends and folks are the greatest givers. I even have a ring of support around my bed as I type … Goodbye world. Spread good energy. Pay it forward!”

    Doctors told Maynard she had six months to live last spring after she was diagnosed with a likely stage 4 glioblastoma. She made headlines around the world when she announced she intended to die under Oregon’s Death with Dignity Act by taking a fatal dose of barbiturates, prescribed to her by a doctor, when her suffering became too great.

    “My glioblastoma is going to kill me and that’s out of my control,” she told PEOPLE last month. “I’ve discussed with many experts how I would die from it and it’s a terrible, terrible way to die. So being able to choose to go with dignity is less terrifying.”

    On Oct. 6, she launched an online video campaign with Compassion Choices. an end-of-life choice advocacy organization, to fight for expanding death-with-dignity laws nationwide.

    “For people to argue against this choice for sick people really seems evil to me,” she told PEOPLE. “They try to mix it up with suicide and that’s really unfair, because there’s not a single part of me that wants to die. But I am dying.”

    A Heartbreaking Choice

    Arriving at her decision was a gradual one, she said.

    “It’s not a decision you make one day and you snap your fingers,” she told PEOPLE.

    She said she began thinking about death with dignity in January when she was first diagnosed with a malignant brain tumor after coming across an article on it while researching possible treatments.

    “Really, from the beginning, all the doctors said when you have a glioma you’re going to die,” she told PEOPLE. “You can just Google it. People don’t survive this disease. Not yet.”

    Doctors removed as much of the tumor as they could, but it came back larger than ever two months later, she said.

    After researching her options, she decided not to try chemotherapy or radiation.

    “They didn’t seem to make sense for me,” she said, because of “the level of side effects I would suffer and it wouldn’t save my life. I’ve been told pretty much no matter what, I’m going to die and treatments would extend my life but affect the quality pretty negatively.”

    In June, she moved to Oregon with her husband, Dan Diaz, 43, her mother, Debbie Ziegler, 56. and her stepfather, Gary Holmes, 72, so she could have access to the state’s Death with Dignity Act, which allows physicians to prescribe life-ending medication to certain terminally ill patients.

    Maynard originally told PEOPLE she’d chosen Nov. 1 to end her life, but on Thursday she released a new video saying she might not do it that day.

    “I still smile and laugh with my family and friends enough that it doesn’t seem like the right time now,” she said in the video recorded Oct. 13 and 14, “but it will come because I feel myself getting sicker; it’s happening each week.”

    Her Final Months

    Maynard spent the last months of her life making the most of the time she had left. She traveled to Alaska, British Columbia and Yellowstone National Park with her loved ones and explored more local attractions like Olympic National Park in Washington.

    On Oct. 21, she and her family took a helicopter ride to the Grand Canyon. a place she’d been longing to see before she died.

    “It was breathtakingly beautiful,” she said in a statement.

    The following morning, though, she had her “worst seizure” so far, she said: “The seizure was a harsh reminder that my symptoms continue to worsen as the tumor runs its course.”

    Maynard said she was deeply touched by the “outpouring of support” she got after going public with her diagnosis and her decision.

    “I want to thank people for that, for the words of kindness, for the time they’ve taken in personal ways,” she told PEOPLE.

    “And then beyond that, to encourage people to make a difference,” she said. “If they can relate to my story, if they agree with this issue on a philosophical level, to get out there and do what we need to do to make a change in this country.”

    Maynard also talked to PEOPLE about her legacy.

    “For me what matters most is the way I’m remembered by my family and my husband as a good woman who did my best to be a good wife and a good daughter,” she said.

    “Beyond that, getting involved with this campaign, I hope to be making a difference here,” she said. “If I’m leaving a legacy, it’s to change this health-care policy or be a part of this change of this health-care policy so it becomes available to all Americans. That would be an enormous contribution to make, even if I’m just a piece of it.”

    Before she died, Maynard asked her husband and her mother if they would carry on the work she started to get death with dignity passed in every state.

    “I want to work on the cause,” Ziegler told PEOPLE last month. “I have so much admiration for people who are terminally ill and just fight and fight. They are so dignified and brave. This is a different choice, but it is also brave and dignified.”

    She also shared with them her hopes and dreams for their future. Upstairs in the home she shares with her family are neatly wrapped Christmas and birthday gifts for her loved ones for the next year.

    “She made it clear she wants me to live a good life,” Ziegler says.

    In her second video, Maynard, who is an only child, said she hoped her mother does not “break down” or “suffer from any kind of depression.”

    And for Diaz, “I hope he moves on and becomes a father,” she said. “There’s no part of me that wants him to live out the rest of his life just missing his wife.”
