        The year 2009 proved to be another great year for the commercial truck financing industry.     We highly recommend speaking to your movers well in advance about the items that you are unsure of in order to avoid any confusion or conflict on your moving day. This way, you’ll have plenty of time to make other arrangements.

    Here is a list of items that our movers are not able to transport:

    • Any flammable, explosive, or corrosive items. Some items in this category include propane, paint, car batteries, antifreeze, household cleaners, weed killer, and ammunition. Federal law prohibits the transportation of these items, so under no circumstances will it be moved.
    • Gasoline-filled engines or machines. Any items that run on gasoline must be emptied prior to move day. Items such as lawnmowers, grills, tractors, or mopeds must be completely empty in order for movers to transport them.
    • Any living thing. In order to ensure the safety and well-being of your plants and animals, we do not transport any type of plant or pet, including potted plants.
    • Perishable foods. We have banned food from our trucks to prevent rotting, spoiling, or producing odors in the truck.
    • Sensitive or sentimental: Items such as cash, jewelry, insurance papers, or birth certificates.
    • Prescription drugs. We do not move prescriptions to prevent any emergencies where you may need to access these medications.

    Driver vs. Company Liability in Commercial Truck Accidents

    After a vehicle accident involving a commercial truck, even if it is clear that the truck driver caused the accident, it’s not always easy to figure out who is legally liable. In this article, we’ll discuss some key things to consider when answering the liability question.

    When is a Company Liable for Its Driver’s Conduct?

    “Respondeat superior” is the primary theory of liability that holds a company responsible for a traffic accident caused by a truck driver employee. “Respondeat superior” is a Latin phrase that means “let the superior make answer.”

    Under this principle, an employer is liable for the wrongful acts committed by its employees or agents, provided the acts were unintentional and were committed within the scope of employment. Essentially, respondeat superior imputes the employee’s liability to the employer, making the employer liable as if it had committed the wrongful act itself.

    The policy governing this rule is a realization that, practically speaking, certain wrongful conduct is bound to occur during the course of the employer’s business. As a result, the losses caused by this wrongful conduct should be placed on the employer as a cost of doing business. Another rationale for respondeat superior is that businesses generally have “deep pockets”, when compared to its employees, and are better able to protect themselves by purchasing insurance, spreading the cost over the entire business.

    Is the Driver an Employee or Independent Contractor?

    The first thing the injured person must show is that the truck driver is an employee of the company, rather than an independent contractor. That’s because a company is generally not liable for wrongful acts committed by independent contractors.

    Although each state’s laws may differ, generally the emphasis is placed on whether the employer has the right to control the detailed manner and means that the work must be performed. If the employer controls the result of the work, but not how the result is accomplished, then an independent contractor relationship is established.

    For example, if a truck driver used his own truck, furnished his own gas and oil and own liability insurance, assumed the cost of repairs, was paid on a “per route” basis, and received no employee benefits, and the company did not withhold taxes from the driver’s paychecks or instruct the driver how to make deliveries or how to drive the truck, likely the truck driver is an independent contractor.

    What Acts are “Within The Scope Of Employment”?

    Determining what constitutes an act committed “within the scope of employment” can be a difficult task. Courts have adopted a number of factors to help resolve this issue. Although each state’s laws may differ, common factors can include:

    • intent of the employee
    • nature, time, and place of the employee’s conduct
    • type of work the employee was hired to do
    • incidental acts the employer should reasonably expect the employee to do
    • amount of freedom allowed to the employee in performing his or her duties, and
    • amount of time consumed in the personal activity.

    For example, if a truck driver rear ends a car while making a delivery, the employer would be liable for any harm that results because the truck driver was acting “within the scope of employment”. Now suppose that the truck driver leaves work early to go to a basketball game and hits another car outside of the stadium. Here, an argument can be made that the company should not be liable for the accident because the truck driver was not acting “within the scope of employment”.

    What If the Driver’s Acts Were Intentional?

    There is an exception to the general rule that a company is liable for accidents caused by its employees. Generally, an employer is not liable for the intentional torts (i.e. assault, battery, kidnapping) committed by its employee. The rationale is that the purpose of the “respondeat” principle is not being met when the employee’s acts are not related to the business enterprise.

    For example, if a truck driver slams into another vehicle because the driver of the other vehicle was sleeping with the truck driver’s spouse, the company will probably not be liable.

    Colonial Boulevard opens after garbage truck accident

    Colonial Boulevard is now open after being closed off for the majority of the day.

    Early Tuesday morning a flaming garbage truck halted traffic along Colonial for several hours at the intersection with DeLeon Street. The closed portion stretched from Midpoint Bridge to US-41.

    It was not opened back up to traffic until late in the afternoon.

    A garbage truck went up in flames creating massive delays for morning commuters along busy Colonial Boulevard early Tuesday morning.

    It happened at the intersection of DeLeon Street, between the Midpoint Bridge and US-41.

    Police tell NBC2 a garbage truck hit a pole before slamming into a tree, causing diesel and hydraulic fluid to spill onto the roadway.

    The crash caused the vehicle to go up in flames, prompting a response from firefighters who worked quickly to battle the blaze.

    The driver escaped with minor injuries. It is unknown at this time if the driver will face charges.

    Coming to Scranton for Fall 2017!

    Lackawanna College’s Surgical Technology Program is designed to be completed over a two-year period with day, evening, and Saturday courses as well as on- and off-campus clinical hours. Each program also includes summer session courses and clinical lab hours.

    Acceptance into Lackawanna College’s Surgical Technology Program is based on a selective admissions process with a maximum of 15 students selected annually.

    Degree information

    Through a balance of classroom instruction and clinical experience, the student will acquire applied skills and knowledge in the field of Surgical Technology.

    Surgical technologists work in the operating room under the direct supervision of a surgeon and a registered nurse. Surgical technologists help facilitate the draping, and prepping of the surgical patient. They gown, and glove other team members. They get all the instruments, supplies, equipment necessary for specific surgical procedures. As a member of the sterile team, surgical technologists will hand all necessary instruments and supplies to the surgeon and other team members.

    A surgical technologist has a broad knowledge of anatomy and physiology, microbiology, sterile techniques, and patient safety concepts as well as ethical and legal concepts. A surgical technologist must have an understanding of the hospital organization, policies, and procedures.

    Job opportunities and salaries in the healthcare specialty of surgical technology have been rising steadily over the last few years, and the U.S. Department of Labor predicts employment of surgical technologists is projected to grow 30% from 2012 to 2022, much faster than the average for all occupations. Advances in medical technology have made surgery safer, and more operations are being done to treat a variety of illnesses and injuries. The median annual wage for surgical technologists was $41,790 in May 2012.

    Most surgical technologists are employed by hospitals, day-surgery centers with the remainder working in the offices of physicians. After two years of experience, a certified surgical technologist may apply to become a traveling surgical technologist.

    Lackawanna College’s Surgical Technology program combines classroom instruction with practical clinical externships at local hospitals. Both career-specific and academic core courses are included. Students successfully completing the program are eligible to sit for the National Certifying Exam (CST).

    Surgical Technology Program classes are given days, nights and on weekends (based on the availability of the instructors). Clinical externships, however, must take place during the daytime.

    Objectives

    • To give students an understanding the need for surgical intervention
    • To develop an understanding of the role of surgical technologist as a member of the surgical team
    • To instruct students in the responsibilities which the performance of this role entails
    • To assist students in developing the knowledge of the organizational structure of the hospitals, its departments and the operating room
    • To develop a basic understanding of biological science as it relates to safe operating room procedure
    • To facilitate the hands-on, supervised experience in the operating room performing the duties of a surgical technologist.

    Admissions criteria and requirements

    Prospective students must meet the college’s minimum requirements. Applicants must submit proof of high school or GED completion with official high school transcript or GED equivalent. Lackawanna College will determine the applicant’s current academic ability based on a combination of following:

    • SAT or ACT test scores, if applicable
      • Recommended SAT scores: 470 Verbal and 470 Math.
      • Recommended ACT scores: 20 or higher in each relevant section.
      • Most scores are valid up to 3 years from test date.
    • College Transfer Credits
      • If transferring credits from another college/university, official college transcripts are required.
    • Placement Test
      • Applicants without valid SAT/ACT scores and who have not previously earned college credits will be required to take the ACCUPLACER exam for determination of current academic ability. Applicants must achieve College Ready scores in Reading, Writing, and Math to be considered qualified for the Surgical Technology program.

    Due to the very specific nature of these degree programs, applicants with transfer credits may only transfer credits related to program core courses including the following:

    • Anatomy and Physiology I – 4 credits
    • Anatomy and Physiology II – 4 credits with lab (if taken within two years)
    • College Algebra
    • Computer Applications
    • College Writing
    • Effective Speaking
    • Introduction to Psychology
    • Medical Ethics (subject to review)
    • Medical Terminology (subject to review)

    Items for official placement into program

    Interviews will be scheduled for qualified Surgical Technology program applicants who submit a fully completed application. A mandatory informational meeting will be required prior to start of the selected program.Qualified students will be notified of the date and time upon selection into program. The meeting will review the Surgical Technology department’s policies and expectations. The meeting will also allow for question and answer session and tour of the Lackawanna College facilities.

    Curriculum

    Changes in the curriculum for this program have been approved by ARC/STSA and will be in effect for students beginning their studies in the Fall 2017 cohort.

    This degree program is moving to our Scranton campus in Fall 2017.
