Trespassing Basics

Trespassing is a legal term that can refer to a wide variety of offenses against a person or against property. Trespassing as it relates to real estate law means entering onto land without consent of the landowner. There are both criminal and civil trespass laws. Criminal trespass law is enforced by police, sheriffs, or park rangers. Civil trespass requires that the landowner initiate a private enforcement action in court to collect any damages for which the trespasser may be responsible (regardless of whether a crime has been committed).

Intent and Knowledge Requirements

Traditionally, for either type of trespass — criminal or civil — some level of intent is required. Thus, the trespasser must not simply unwittingly traverse another’s land but must knowingly go onto the property without permission. Knowledge may be inferred when the owner tells the trespasser not to go on the land, when the land is fenced, or when a no trespassing sign is posted. A trespasser would probably not be prosecuted if the land was open, the trespasser’s conduct did not substantially interfere with the owner’s use of the property, and the trespasser left immediately on request.

The landowner may indicate — verbally or in writing — permission to enter onto the land.

The existence of consent may be implied from the landowner’s conduct, from custom, or from the circumstances. Consent may be implied if the landowner was unavailable to give consent, and immediate action is necessary to save a life or prevent a serious injury.

Homeowner Liability: What if a Trespasser Gets Hurt?

As bizarre as this may sound, there are some limited protections for trespassers if they get injured while in the act, so to speak. Homeowners can typically be liable to trespassers if they willfully injured the person or knew or should have known about the presence of frequent trespassers and kept an unsafe condition.

What does all this mean? Well, let’s say you, as a homeowner, set up a booby trap for a trespasser that sets off a shotgun if someone triggers a wire. Now let’s say that happens and it causes severe injuries to the trespasser. While this might seem unjust to some, you may be a liable for the injuries the trespasser sustains. More examples include booby traps, trip wires, bear traps, bamboo tiger pits, and other devices.

What are some things you can legally do? For one, if you are concerned about trespassers coming onto your land, start with a Private Property or No Trespassing sign in a visible place. Not only does it put the trespassers on notice, it conveys your intent to keep your land to yourself and not as a make-shift easement for others. Next, you should consider installing video cameras in the traveled area. The presence of the camera itself can be a deterrent to some. Be sure you are up-to-date on your state’s laws regarding videotaping or filming before installing a camera. You can do this by speaking with a local attorney.

Despite the requirements set by stage 3, there are important upcoming changes through a new law called MACRA — or the Medicare Access and CHIP (Children’s Health Insurance Program) Reauthorization Act. MACRA will eventually modify the meaningful use program as a means to push forward with value-based reimbursement.

The meaningful use program, as it has existed, will now be effectively over and replaced with something better, said Andy Slavitt, the acting administrator of CMS, in January 2016.

As things stand, in summer 2016, meaningful use stage 3 will be optional for providers in 2017 and mandatory for all participants in 2018. Objectives and measures for all providers, regardless of prior participation, are finalized for the 2018 reporting period with this rule.

Along with meaningful use stage 1 and meaningful use stage 2. the third list of criteria and requirements mandates that all hospitals and eligible healthcare professionals use certified electronic health record (EHR ) systems.

Meaningful use program requirements

Meaningful use stage 3 includes all of the requirements that physicians must meet to receive their incentives and avoid any penalties. In this program, physicians must meet eight overall objectives, in contrast to the earlier requirement for them to choose from a core menu of options. The objectives cover the following areas:

  1. Protected health information (PHI): Eligible physicians must attest to conducting a security risk analysis to assess vulnerabilities to PHI that could lead to data breaches. In addition to the fact that the Health Insurance Portability and Accountability Act (HIPAA ) requires practices to perform risk analysis and other security audits. the requirements attached to meaningful use objectives make it a must-have in order to receive incentives.
  2. Electronic prescribing: Eligible physicians are required to have more than 80% of their permissible prescriptions queried for drug formulary and transmitted to pharmacies electronically.
  3. Clinical decision support (CDS): For this objective, there are two different measures available for eligible physicians. The first measure covers implementing five CDS interventions. The second measure relates to the active use of drug-drug and drug-allergy interaction checks during the reporting period, which are available within a certified EHR platform.
  4. Computerized provider order entry (CPOE): Eligible physicians are required, under this objective, to meet three different measures for medication, lab and diagnostic imaging orders.
  5. Patient electronic access: To help encourage patient engagement, meaningful use stage 3 includes an objective in which eligible physicians must provide access to EHRs to more than 80% of patients, with the option to view and download the records. In addition, eligible physicians must offer the option to receive educational data to more than 35% of their patients.
  6. Coordination of care through patient engagement. The measures included in this objective encourage patients to actively engage in their care by necessitating physicians to educate them on and offer capabilities to view patient health data. The measures in this objective cover three different aspects. The first measure requires physicians to have more than 25% of patients interact with their EHR. The second measure requires that more than 35% of patients receive a secure digital communication from a care provider. The third measure focuses on encouraging the collection of patient generated health data from fitness trackers or wearable devices from more than 15% of patients. Eligible providers must attest to all three measures, but meet the thresholds for two of the three.
  7. Health information exchange (HIE): The measures included in this meaningful use objective encourage interoperability. The first measure requires that more than 50% of care transition and referrals include the exchange of care records. such as continuity of care documents (CCD ), electronically. The second measure requires physicians who are seeing a patient for the first time to receive care documents electronically from a secondary source more than 40% of the time. The final measure requires physicians to use e-prescribing services to reconcile medication lists from online sources with their own for more than 80% of new patients they see. Eligible providers must attest to all three measures, but meet the thresholds for two of the three.
  8. Public health and clinical data registry reporting: In this objective, providers must choose three out of five available EHR reporting destinations to which they will submit data periodically. Reporting options include an immunization registry, syndromic surveillance, cases, a public health registry and a clinical data registry.

Stage 3 also promotes the use of APIs to bridge the gaps between health IT systems and to provide increased data access.

Meaningful use and MACRA

MACRA is federal legislation signed into law on April 16, 2015 that establishes ways to pay physicians for caring for Medicare beneficiaries and includes funding for technical assistance for providers and related measure development. The law also sets requirements for data sharing .

More EHR incentive program updates

It is important to note that in July 2016, CMS published an outline describing changes that it proposed for the Hospital Outpatient Prospective Payment System (OPPS) for 2017. In the document, CMS requested that Congress enact changes to the meaningful use program, including:

  • Reduction of the EHR reporting period from a full year to 90 days.
  • The elimination of CDS and CPOE objectives.
  • Reduction of the thresholds for a subset of the remaining objectives and measures in meaningful use stage 2 for 2017 and meaningful use stage 3 for 2017-2018 for eligible and critical access hospitals.
  • Flexibility for those who have not successfully demonstrated meaningful use in a prior year, enabling them to attest to a modified stage 2 by October 1, 2017.

Lawmakers must formally vote in these changes to meaningful use in order for them to take effect.

Despite the recent meaningful use stage 3 final ruling release and proposed changes, physicians in 2017 will have access to a newly introduced program called Advancing Care Information (ACI) with the Medicare Incentive Payment System (MIPS), which are both part of MACRA. Under the new law, ACI will only affect Medicare physicians’ offices and not Medicare hospitals or Medicaid programs. These new programs are designed to offer flexibility such as:

  • Reduced number of measures to meet.
  • Elimination of CDS and CPOE.
  • More emphasis on interoperability and health information exchange .
  • Multiple options to receive incentives for physicians.
  • Exception for certain physicians from reporting when EHR technology is less applicable.

The recent proposed changes to meaningful use rules have received praise from a number of different medical associations throughout the nation, but it remains to be seen how physicians will navigate the different programs and requirements they face under each one.

Uses

Loratadine does not prevent hives or prevent/treat a serious allergic reaction (e.g. anaphylaxis ). Therefore, if your doctor has prescribed epinephrine to treat allergic reactions, always carry your epinephrine injector with you. Do not use loratadine in place of your epinephrine.

Missed Dose

If you miss a dose, take it as soon as you remember. If it is near the time of the next dose, skip themissed dose and resume your usual dosing schedule. Do not double the dose to catch up.

Storage

The HITECH Act outlined the intended plans for the adoption of electronic health records through meaningful use. The CMS Medicare and Medicaid EHR Incentive programs have evolved into three stages of meaningful use with their own goals, priorities, and their own final rule. Meaningful use means providers need to show they re using certified EHR technology in ways that can be measured significantly in quality and in quantity.

On October 6, 2015, the Centers for Medicare Medicaid Services (CMS) and Office of the National Coordinator for Health Information Technology (ONC) released final rules that simplify requirements and add new flexibilities for providers to make electronic health information available when and where it matters most and for health care providers and consumers to be able to readily, safely, and securely exchange that information. The final rule for 2015 Edition Health IT Certification Criteria (2015 Edition) and final rule with comment period for the Medicare and Medicaid Electronic Health Records (EHRs) Incentive Programs will help continue to move the health care industry away from a paper-based system, where a doctor’s handwriting needed to be interpreted and patient files could be misplaced.

The Benefits of Achieving Meaningful Use

Dr. Stasia Kahn’s persistence and motivation led her to be a vanguard among her colleagues. Being an owner of a newly formed two provider practice presents many challenges and barriers, but Dr. Kahn leverages clinical experience along with a positive outlook about technology to find solutions to challenges and improve healthcare quality.

Achieving Meaningful Use in a Small Practice

As an Internal Medicine physician, Dr. Kahn frequently shares data with other healthcare providers and patients, making a system to efficiently collect patient data vital. With the release of the Meaningful Use Stage 1 core and menu objectives. Dr. Kahn’s practice planned for an electronic health record (EHR) implementation that would not only meet the needs of the practice but position them to achieve meaningful use. For a small practice this meant a significant investment of time and resources with barriers including:

  • Hardware, software, and interface costs
  • Slowdowns in productivity due to staff training
  • Limited physician time to devote to meaningful use project management

Despite these barriers, Dr. Kahn made achieving meaningful use a priority, and the practice started the attestation process in 2011. Beginning the process early allowed time for Dr. Kahn to complete a meaningful use gap analysis and map meaningful use measures to data fields she wanted to incorporate into her practice’s EHR. As the physician champion in her practice, Dr. Kahn worked with IT consultants to create training materials and checklists for providers and staff that explain how to:

Benefits of Achieving Meaningful Use

Dr. Kahn found that achieving meaningful use required physicians and staff members to work outside of their comfort zones, which resulted in new policies and procedures that improved healthcare quality.

While the financial and time resources required to achieve meaningful use were demanding on Dr. Kahn’s small practice, the benefits are tangible. By implementing an EHR and achieving meaningful use, Dr. Kahn’s practice is now using technology to help improve patient care such as:

  • E-prescribing
  • Automated recall processes for preventative services and chronic disease follow-up
  • Patient registries (e.g. diabetes and coronary artery registries)

Dr. Kahn’s practice has seen improved safety and reduced healthcare costs, as well as improved population health. For example, Dr. Kahn notes that “being alerted when my patients’ BMI falls out of range prompts me to do something about it and has resulted in more frequent discussions with my patients on the importance of weight management.”

Achieving meaningful use also fostered a relationship between Dr. Kahn’s practice and the State of Illinois Immunization Registry. Without the meaningful use incentive payments, it was unlikely that the practice would have gone to the trouble of implementing a system that was able to participate in a statewide immunization registry. While the path to Stage 1 Meaningful Use was steep, Dr. Kahn believes having a positive attitude about technology and being willing to address barriers will lead to excellent patient care delivery and practice transformation. Dr. Kahn is already reviewing Stage 2 Meaningful Use to assess the measures and find solutions for her practice’s next step on the path to making meaningful use meaningful for her patients.

It’s not hard to find drugs, and sometimes it may seem like everyone’s doing them or wanting you to do them. But as with anything that seems too good to be true, there are downsides (and dangers) to taking drugs.

How Drugs Work

Drugs are chemicals or substances that change the way our bodies work. Some are medicines that help people when doctors prescribe them. Many have no medical use or benefits.

When taken (usually by swallowing, inhaling, or injecting), abused drugs find their way into the bloodstream. From there, they move to the brain and other parts of the body. In the brain, drugs may intensify or dull the senses, change how alert or sleepy people feel, and sometimes decrease physical pain.

Because of the way these drugs work on the brain, they affect the ability to make healthy choices and decisions. Even drinking makes people more likely to get involved in dangerous situations, like driving under the influence or having unprotected sex .

How drugs affect people depends on lots of things:

  • the kind of drug taken
  • how much is taken
  • how often someone uses it
  • how quickly it gets to the brain
  • what other drugs, food, or substances are taken at the same time
  • the person’s body size, shape, and chemistry

Although substances can feel good at first, they can do a lot of harm to the body and brain. Drinking alcohol, smoking or using tobacco. taking illegal drugs, even sniffing glue all damage the human body.

Why People Take Drugs

Just as there are many kinds of drugs available, there are as many reasons for trying or using them. People take drugs for the pleasure they believe they can bring. Or maybe someone else talked them into it, making them think they’ll have a better time if they take drugs. Often people try to talk friends into taking drugs just because they don’t want to be the only ones doing them.

Some people believe drugs will help them think better. be more popular, or become better artists or athletes. Others are curious. And some people want to fit in and take drugs because of peer pressure .

Many people use drugs because they’re depressed or think drugs will help them escape their problems. But drugs just mask feelings and problems, they don’t solve them. People find that when a drug wears off, the feelings and problems remain and might even be worse. This can put people on the hamster wheel of chasing a high just to feel better.

If you think you or a friend may be addicted to drugs, talk to a parent, your doctor. school counselor. or nurse. They can help you get the help you need.

Several kinds of treatment are available for drug addiction. The two main types are behavioral (helping a person change behaviors) and pharmacological (treating a person by using medicine).

Experts in drug treatment teach people how to live without drugs dealing with cravings, avoiding situations that could lead to drug use, and preventing and handling relapses.

It can be hard to overcome drug addiction without professional help and treatment. It takes time and isn’t something that can be done alone everyone needs support. Experts who help people with addictions are trained to help, not judge. Some people try to cope with their Posttraumatic Stress Disorder (PTSD) symptoms by drinking heavily, using drugs, or smoking too much. People with PTSD have more problems with drugs and alcohol both before and after getting PTSD. Also, even if someone does not have a problem with alcohol before a traumatic event, getting PTSD increases the risk that he or she will develop a drinking or drug problem.

Eventually, the overuse of these substances can develop into Substance Use Disorder (SUD), and treatment should be given for both PTSD and SUD to lead to successful recovery. The good news is that treatment of co-occurring (happening at the same time) PTSD and SUD works.

How common is co-occurring PTSD and SUD in Veterans?

Studies show that there is a strong relationship between PTSD and SUD, in both civilian and military populations, as well as for both men and women.

Specific to Veterans:

  • More than 2 of 10 Veterans with PTSD also have SUD.
  • War Veterans with PTSD and alcohol problems tend to be binge drinkers. Binges may be in response to bad memories of combat trauma.
  • Almost 1 out of every 3 Veterans seeking treatment for SUD also has PTSD.
  • The number of Veterans who smoke (nicotine) is almost double for those with PTSD (about 6 of 10) versus those without a PTSD diagnosis (3 of 10).
  • In the wars in Iraq and Afghanistan, about 1 in 10 returning soldiers seen in VA have a problem with alcohol or other drugs.

How can co-occurring PTSD and SUD create problems?

If someone has both PTSD and SUD, it is likely that he or she also has other health problems (such as physical pain), relationship problems (with family and/or friends), or problems in functioning (like keeping a job or staying in school). Using drugs and/or alcohol can make PTSD symptoms worse.

  • PTSD may create sleep problems (trouble falling asleep or waking up during the night). You might “medicate” yourself with alcohol or drugs because you think it helps your sleep, but drugs and alcohol change the quality of your sleep and make you feel less refreshed.
  • PTSD makes you feel “numb,” like being cut off from others, angry and irritable, or depressed. PTSD also makes you feel like you are always “on guard.” All of these feelings can get worse when you use drugs and alcohol.
  • Drug and alcohol use allows you to continue the cycle of “avoidance” found in PTSD. Avoiding bad memories and dreams or people and places can actually make PTSD last longer. You cannot make as much progress in treatment if you avoid your problems.
  • You may drink or use drugs because it distracts you from your problems for a short time, but drugs and alcohol make it harder to concentrate, be productive, and enjoy all parts of your life.

VA has made it easier to get help. It is important to know that treatment can help and you are not alone.

What treatments are offered for co-occurring PTSD and SUD?

Evidence shows that in general people have improved PTSD and SUD symptoms when they are provided treatment that addresses both conditions. This can involve any of the following (alone or together):

Talk with your provider about treatment for specific symptoms like pain, anger, or sleep problems.

What should I do if I think I have co-occurring PTSD and SUD?

The first step is to talk to a health professional and ask for more information about treatment options. Each VA medical center has an SUD-PTSD Specialist trained in treating both conditions to reach the best health outcomes. If there are signals you are at risk for both disorders, you will be encouraged to talk with a provider about how to best support your recovery. There are treatment resources at every VA medical center. The VA wants you to have the best possible care for co-occurring PTSD and SUD.

I ve used hotelsclick.com and never had a problem. I booked a quad room in VAN DER VALK HOTEL SCHIPHOL A4 – Amsterdam for less than £200 for 3 nights including breakfast and that was for all of us. £50 each for 3 nights. I was a bit nervous at booking as they say if it s too good to be true, it probably is and it was down to me to get it right. What a great decision I made. I received a confirmation email and it didn t occur to me that anything would go wrong and it didn t. The place was amazing. They state that a continental breakfast was included however it was like a banquet, you couldn t want for anything, including smoked salmon. and it wasn t even Christmas. The hotel put on a courtesy coach to go back and forth to the Airport to get the train into the heart of Amsterdam. I can t praise this hotel enough however as I said, I booked it through hotelsclick.com . There is a phone number and email address on their site so I don t know why the other poster had a problem. However, I have noticed that there is a hotelclick.com (no s ) which is also a sponsered link to this site. So very confusing! I ve looked at both sites and the latter uses 32 reservation websites. Therefore you are not booking with them.

For one, mine was not a late booking. Yes they get good prices but isn t that we want. I ve read your link however the poster is not complaining about hotelsclick.com. They booked the accommodation in good faith and of course they are going to take payment. The fact that the hotel was overbooked wasn t down to them, they have their allocation and the fact that the hotel was overbooked is not their fault, it was down to the Midland Hotel for overbooking.

No, yours was not a late booking but that does not mean that Hotelsclick did not book it or confirm the booking with the hotel until much later when the discounted rates kicked in. Exactly when (or if) a discounted rate kicks in will depend on the hotel, but some booking companies trust to luck that they will. If the lower rates turn out not to be available all they have to do is tell their customers that the hotel overbooked.

The reviewer referred to only knows what Hotelsclick told them. If the hotel had not received a confirmed booking from Hotelsclick and the hotel was full, there is nothing much they could do. Hotelsclick then comes to the rescue with another hotel.

My comments are based on some of the threads on this site about Hotelsclick. It s strange that this seems to happen so much more often with this company than with others.

In 2004, the National Association for Home Care Hospice reported that more than 7 million people in the United States receive home health care annually.

As patients move to the use of home health care services for recuperation or long-term care, the medical devices necessary for their care have followed them. As a result, complex medical devices are used more frequently in the home, many times under unsuitable conditions. This in turn has implications for the safe and effective operation of these devices, especially those with sophisticated requirements for proper operation or maintenance.

CDRH regulates medical devices; however, the regulatory authority alone is not enough to ensure that devices are safe and effective when used in the home. CDRH has been receiving an increasing number of adverse event reports about medical devices that are used in the home.

Drugs: What to Know

It’s not hard to find drugs, and sometimes it may seem like everyone’s doing them or wanting you to do them. But as with anything that seems too good to be true, there are downsides (and dangers) to taking drugs.

How Drugs Work

Drugs are chemicals or substances that change the way our bodies work. Some are medicines that help people when doctors prescribe them. Many have no medical use or benefits.

When taken (usually by swallowing, inhaling, or injecting), abused drugs find their way into the bloodstream. From there, they move to the brain and other parts of the body. In the brain, drugs may intensify or dull the senses, change how alert or sleepy people feel, and sometimes decrease physical pain.

Because of the way these drugs work on the brain, they affect the ability to make healthy choices and decisions. Even drinking makes people more likely to get involved in dangerous situations, like driving under the influence or having unprotected sex .

How drugs affect people depends on lots of things:

  • the kind of drug taken
  • how much is taken
  • how often someone uses it
  • how quickly it gets to the brain
  • what other drugs, food, or substances are taken at the same time
  • the person’s body size, shape, and chemistry

Although substances can feel good at first, they can do a lot of harm to the body and brain. Drinking alcohol, smoking or using tobacco. taking illegal drugs, even sniffing glue all damage the human body.

Why People Take Drugs

Just as there are many kinds of drugs available, there are as many reasons for trying or using them. People take drugs for the pleasure they believe they can bring. Or maybe someone else talked them into it, making them think they’ll have a better time if they take drugs. Often people try to talk friends into taking drugs just because they don’t want to be the only ones doing them.

Some people believe drugs will help them think better. be more popular, or become better artists or athletes. Others are curious. And some people want to fit in and take drugs because of peer pressure .

Many people use drugs because they’re depressed or think drugs will help them escape their problems. But drugs just mask feelings and problems, they don’t solve them. People find that when a drug wears off, the feelings and problems remain and might even be worse. This can put people on the hamster wheel of chasing a high just to feel better.

If you think you or a friend may be addicted to drugs, talk to a parent, your doctor. school counselor. or nurse. They can help you get the help you need.

Several kinds of treatment are available for drug addiction. The two main types are behavioral (helping a person change behaviors) and pharmacological (treating a person by using medicine).

Experts in drug treatment teach people how to live without drugs dealing with cravings, avoiding situations that could lead to drug use, and preventing and handling relapses.

It can be hard to overcome drug addiction without professional help and treatment. It takes time and isn’t something that can be done alone everyone needs support. Experts who help people with addictions are trained to help, not judge. Meaningful Use: 6 things you need to know about the CMS Final Rule changes

After ongoing feedback from medical providers, professional medical associations, and Congress, the Centers for Medicare and Medicaid Services (CMS) released changes to the Meaningful Use program on October 16, 2015. These changes take effect starting 2015 and continue through 2017. The intended aim of this Final Rule is to reduce the complexity of the EHR Incentive Program and address the many challenges that prevented providers from meeting Stage 2 Meaningful Use requirements.

Here are the six most important things you need to know about the changes and how Practice Fusion is supporting you through this transition.

Meaningful Use Rules

1. Every provider will now be completing a 90-day reporting period for the 2015 reporting year.

No matter what stage or year you were previously in, the Final Rule states that all providers will attest for a 90-day reporting period in 2015. By shortening the reporting period time-frame, CMS hopes to ease providers through the transition to the new modified Meaningful Use program. We are working to update your dashboard to default to a 90-day reporting period for 2015. In the meantime, select “Custom period” and then enter the desired 90-day reporting period.

2. All providers are now in Stage 2 of Meaningful Use — with a “Modified Stage 2” for providers that were previously in Stage 1.

CMS has removed Stage 1 from the program in order to simplify the requirements by placing everyone into the same Stage. However, any providers who were previously in Stage 1 for 2015 will now be placed in “Modified Stage 2” which only requires them to meet Stage 1 requirements.

3. The core and menu measures have been simplified into 10 “Objectives.”

Every provider will complete and attest to 10 objectives, with one or several measures per objective. There is no longer a concept of “core” or “menu” measures.

4. The Stage 2 measures that required patient engagement have been greatly reduced.

The threshold for the measure Patient Electronic Access: View Download and Transmit health information dropped from 5% to “at least one patient seen by the EP during the reporting period.” The 5% threshold for Secure Messaging was removed and replaced with “the capability for patients to send and receive a secure electronic message with the EP was fully enabled during the EHR reporting period.” These measures have been adjusted in order to minimize the burden and challenges that providers were experiencing in meeting Meaningful Use Stage 2.

5. Many data-entry measures have been eliminated.

Record Demographics, Record Vital Signs, Record Smoking Status, Clinical Summaries, Structured Lab Results, Patient List, Patient Reminders, Summary of Care Measure 1 – Any Method and Measure 3 – Test, Electronic Notes, Imaging Results, and Family Health History have been removed from the reporting requirements.

6. Attestation will not be available to providers until January 4, 2016. The current attestation deadline is February 29, 2016.

CMS needs time to update the attestation process to support the changes to the Meaningful Use program. We’ll continue to update you with additional information on attestation as we approach the attestation window in 2016.

I ve used hotelsclick.com and never had a problem. I booked a quad room in VAN DER VALK HOTEL SCHIPHOL A4 – Amsterdam for less than £200 for 3 nights including breakfast and that was for all of us. £50 each for 3 nights. I was a bit nervous at booking as they say if it s too good to be true, it probably is and it was down to me to get it right. What a great decision I made. I received a confirmation email and it didn t occur to me that anything would go wrong and it didn t. The place was amazing. They state that a continental breakfast was included however it was like a banquet, you couldn t want for anything, including smoked salmon. and it wasn t even Christmas. The hotel put on a courtesy coach to go back and forth to the Airport to get the train into the heart of Amsterdam. I can t praise this hotel enough however as I said, I booked it through hotelsclick.com . There is a phone number and email address on their site so I don t know why the other poster had a problem. However, I have noticed that there is a hotelclick.com (no s ) which is also a sponsered link to this site. So very confusing! I ve looked at both sites and the latter uses 32 reservation websites. Therefore you are not booking with them.

Meals: Buffet breakfast costs EUR 15 per person per night. Buffet breakfast costs EUR 7.50 per night per child under 12 years.

Taxes: 6 % city tax is excluded.

So add £50+ per night for 4 for breakfast, £150 that s £489.54 then add 6% city tax. Ouch, that works out expensive for FREE cancellation. Take out insurance, it s cheaper!

They state on their site – •Best Price Guarantee. Found your room online at a lower price? We ll match it. Bet they are kept busy

Now, Hotesclick.com – 25 – 28 Nov for a quad room, £321.75 including all taxes and breakfast. Now that s uncomplicated, no add ons.

For one, mine was not a late booking. Yes they get good prices but isn t that we want. I ve read your link however the poster is not complaining about hotelsclick.com. They booked the accommodation in good faith and of course they are going to take payment. The fact that the hotel was overbooked wasn t down to them, they have their allocation and the fact that the hotel was overbooked is not their fault, it was down to the Midland Hotel for overbooking.

Nowhere does the poster state that it was down to hotelsclick.com . However, they looked after them which is more can be said for the hotel staff.

Although the reviewer blames the Midland Hotel, it seems far more likely that Hotelsclick had not confirmed the booking .

That s heresay on your part and not constructive being that you are obviously biased for some reason. Mine was confirmed, booked and honoured.

Just a parting shot iggyfitz have you been affected by hotelsclick.com ?

No, yours was not a late booking but that does not mean that Hotelsclick did not book it or confirm the booking with the hotel until much later when the discounted rates kicked in. Exactly when (or if) a discounted rate kicks in will depend on the hotel, but some booking companies trust to luck that they will. If the lower rates turn out not to be available all they have to do is tell their customers that the hotel overbooked.

The reviewer referred to only knows what Hotelsclick told them. If the hotel had not received a confirmed booking from Hotelsclick and the hotel was full, there is nothing much they could do. Hotelsclick then comes to the rescue with another hotel.

My comments are based on some of the threads on this site about Hotelsclick. It s strange that this seems to happen so much more often with this company than with others.

Understanding Auto Insurance

What is auto insurance?

Auto insurance is a product that provides financial protection for cars, trucks, motorcycles, and other road vehicles from loss, physical damage and/or bodily injury liability resulting from traffic collision, theft or other losses.

By law, all drivers in Nevada must purchase auto insurance.

How much auto insurance am I required to have in Nevada?

Nevada drivers are required to have protection levels of at least $15,000 per person for bodily injury, $30,000 per accident for bodily injury, and $10,000 per accident for property damage. This minimum level of coverage is often referred to as 15/30/10. It is possible to purchase more coverage protection than the minimum level of coverage required.
Liability insurance coverage protects you only if you are liable for an accident and pays for the injuries to others or damages to their property. It does not provide coverage for you, your passengers who are your resident relatives, or your property. Property Damage coverage is also available but is a separate coverage and is not required by law.

What other types of coverage can I buy?

Drivers who want to protect their vehicles against physical damage can need to purchase:

  • Collision – This coverage is for damage to your vehicle resulting from a collision, regardless of who is at fault. It provides for repair of the damage to your vehicle or a monetary payment to compensate you for your loss.
  • Comprehensive – This coverage insures you against theft or other damage to your vehicle resulting from causes other than collision. Other causes may include damage from wind, falling objects, fire, flood or vandalism.

None of the above insurance coverages will pay for your injuries or your passengers’ injuries in the case of an accident.

The following two coverages help ensure that everyone in your vehicle has the protection needed to pay for medical treatment costs.

  • Uninsured / Underinsured Motorist (UM/UIM) – If you or your passengers are injured in an accident in which the other driver is at fault and either does not have insurance (uninsured) or does not have enough insurance (underinsured) to pay all of your loss, this coverage pays for the medical costs of you and your passengers.
  • Medical Payments (Medpay) – This pays for treating injuries to you and your passengers without regard to fault. It also pays for treating injuries resulting from being struck as a pedestrian by a motor vehicle.

What is a deductible?

Your auto insurance deductible is the amount of money you must pay out-of-pocket before your insurance compensates you. A deductible only applies to Collision and Comprehensive coverages.

For example: You have a Subaru Outback that has Collision Coverage with a $1,000 deductible. You rear end another driver, and your Subaru is damaged. You take it to the body shop and the total cost to repair all the damage is $6,500. In this scenario, you would pay the body shop $1,000. This is your deductible. Once you have met your $1,000 deductible the insurance company will pay the remaining $5,500.

How does my deductible affect the cost of my insurance?

Generally, the lower your deductible, the higher the cost of your insurance will be. The higher your deductible is, the lower the cost of your insurance will be. This is because the insurance company is assuming more or less liability for repair costs.

How do I buy auto insurance?

When buying insurance, the Division of Insurance recommends that you seek the advice of a qualified insurance professional. There are three types of professionals that typically sell insurance:

Independent agents: can sell insurance from multiple unaffiliated insurers.

Exclusive agents: can only sell insurance from the company or group of companies with which they are affiliated.

Direct writers: are insurers that do not always use agents as intermediaries; instead, some of their employees are licensed as agents in Nevada and are authorized to sell insurance.

Regardless of what type of professional you choose to use, it is important to confirm that they are licensed to conduct business in the State of Nevada. You can check the license of an insurance professional or company here.

Remember – Always verify that an insurance company or agent are licensed before giving them personal information or payment.

Getting a Cheap Hotel: Does It Matter What Booking Site You Use?

There are countless hotel booking sites out there, but how do you decide which one to use? They all deliver a wide range of search results when you re looking for a hotel, and it s hard to tell if there are any differences. I decided to do some testing and find out which sites offer the best deals.

As much as I love hostels and other forms of cheap accommodation, there is something nice about the luxuriousness of hotels. They are clean and quiet, feature comfy beds, strong showers, and lots of soap I can take for later.

But luxury comes at a price. Hotels certainly aren t cheap and I hate spending a lot of money for a room I am only going to be in for a few hours. It s why I mostly avoid hotels—I don t think they are a good use of money (and there are far better accommodation options out there ). If I m not in a hostel, you can usually find me at a cheap guesthouse or at an Airbnb.

But I ve been traveling a lot for work lately, and with the seemingly endless hotel booking sites out there, I decided this was a good time to do some testing. Does it matter which site you use to book a hotel?

I also picked five cities to research: London, Los Angeles, Paris, NYC, and Seattle. I picked bookings close to the current date of research as well as far in advance, on both weekdays and weekends. (I did my research end of March, which is why the dates are different than what you d expect from a post published in early May.)

I searched six booking websites: Expedia. Hotels.com. Booking.com. Hotwire. Priceline. and a new one called TravelPony in two, three, and four star categories. Below are the data tables with the lowest price shown (Priceline rates are based on their search listings, not the bidding section of the site). What is a Home Use Device?

A home use medical device is a medical device intended for users in any environment outside of a professional healthcare facility. This includes devices intended for use in both professional healthcare facilities and homes.

  • A user is a patient (care recipient), caregiver, or family member that directly uses the device or provides assistance in using the device.
  • A qualified healthcare professional is a licensed or non-licensed healthcare professional with proficient skill and experience with the use of the device so that they can aid or train care recipients and caregivers to use and maintain the device.

Why is FDA’s Center for Devices and Radiological Health (CDRH) interested?

Changes in health care have moved care from the hospital environment to the home environment. In fact, according to results of the 2000 National Home and Hospice Care Survey approximately 1,355,300 patients were receiving home health care services from 7,200 agencies. In 2004, the National Association for Home Care Hospice reported that more than 7 million people in the United States receive home health care annually.

As patients move to the use of home health care services for recuperation or long-term care, the medical devices necessary for their care have followed them. As a result, complex medical devices are used more frequently in the home, many times under unsuitable conditions. This in turn has implications for the safe and effective operation of these devices, especially those with sophisticated requirements for proper operation or maintenance.

CDRH regulates medical devices; however, the regulatory authority alone is not enough to ensure that devices are safe and effective when used in the home. CDRH has been receiving an increasing number of adverse event reports about medical devices that are used in the home.

What can CDRH do?

CDRH wants to decrease the number of problems that occur in the home environment; but the issues are complex. To be successful, the government agencies involved in home care need to collaborate with relevant stakeholders:

  • Manufacturers and Distributors
  • Health care professionals
  • Health care organizations
  • Accrediting bodies (Private or governmental bodies that grant recognition that an institution has met certain standards or requirements)
  • Human factors experts
